The committee on Ways and Means, to whom was referred the Senate Bill authorizing the continued employment of Jerry Shampang as an environmental police officer in the Executive Office of Energy and Environmental Affairs (Senate, No. 2691), reports recommending that the same ought to pass with amendments striking out all after the enacting clause and inserting in place thereof the text contained in House document numbered 5241; and by inserting in place thereof the following emergency preamble: “Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide forthwith for the continued employment of a certain environmental police officer, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.”. The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ By striking out all after the enacting clause and inserting in place thereof the following: 1 “(a) Notwithstanding any general or special law to the contrary, Jerry Shampang, an 2environmental police officer in the executive office of energy and environmental affairs, may 3continue to serve in that position until he reaches 70 years of age or the date of his retirement or 4non-reappointment, whichever occurs first; provided, however, that he is mentally and physically 5capable of performing the duties of his position. The director of law enforcement in the executive 6office of energy and environmental affairs may, at the office’s expense, require that Jerry 7Shampang be examined annually by a physician designated by the select board to determine his 8physical and mental capability to perform the duties of his position. While continuing to serve as 9an environmental police officer, Jerry Shampang shall comply with all requirements of chapter 106E of the General Laws, including: (i) maintaining certification and good standing with the 11Massachusetts peace officer standards and training commission; and (ii) complying with all in- 12service and other training requirements mandated by the municipal police training committee. 2 of 2 13 (b) No further deductions shall be made from the regular compensation of Jerry 14Shampang under chapter 32 of the General Laws for any service performed subsequent to his 15reaching the age of 65 and, upon retirement, Jerry Shampang shall receive a superannuation 16retirement allowance equal to the allowance to which he would have been entitled had he retired 17upon reaching the age of 65”; and by inserting before the enacting clause the following 18emergency preamble: 19 “Whereas, The deferred operation of this act would tend to defeat its purpose, which is to 20provide forthwith for the continued employment of a certain environmental police officer, 21therefore it is hereby declared to be an emergency law, necessary for the immediate preservation 22of the public convenience.”.
