No. 4971 Text of an amendment, recommended by the committee on Ways and Means, to the Senate Bill authorizing the town of Tewksbury to use a certain parcel of land for general recreational purposes (Senate, No. 2916). August 1, 2024. The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ By striking out all after the enacting clause and inserting in place thereof the following:– 1 SECTION 1. Section 1 of chapter 314 of the acts of 1993 is hereby amended by striking 2out the words “the expansion of the town of Tewksbury baseball facilities” and inserting in place 3thereof the following words:- general recreational purposes, including, but not limited to, 4Tewksbury baseball facilities and other active and passive recreational activities. 5 SECTION 2. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General 6Laws, section 2 of chapter 314 of the acts of 1993 or any other general or special law to the 7contrary, the commissioner of capital asset management and maintenance may amend the 8restriction in a deed recorded in the Middlesex northern district registry of deeds in book 10054, 9page 109 to allow the parcel of land described therein to be used for general recreational 10purposes. 11 SECTION 3. The town of Tewksbury shall be responsible for all costs and expenses of 12any transaction authorized in this act as determined by the commissioner of capital asset 13management and maintenance, including, but not limited to, the costs of any recording fees or 14deed preparation.
