Gobi for legislation relative to the appointment of Special State Police officers. Public Safety and Homeland Security. The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to the appointment of Special State Police officers. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Chapter 22C of the General Laws is hereby amended by inserting after section 51 the 2following section:- 3 Section 51A. The colonel may appoint as special state police officers retired uniformed 4members who, as the colonel deems necessary, may perform police details or any police duties 5arising therefrom during the course of police detail work, whether or not related to the detail 6work. 7 Retired uniformed members appointed under this section shall: 8 (i) have retired by reason of superannuation not more than 3 years prior to the date of the 9appointment as a special state police officer; 10 (ii) have a state police discharge status of honorable; 2 of 2 11 (iii) be deemed necessary, suitable, qualified and fit to perform the same essential 12functions and duties as uniformed members of the department; 13 (iv) be certified by the police officer standards and training commission pursuant 14to section 4 of chapter 6E; 15 (v) be subject to or exempt from department rules as determined by the colonel; 16 (vi) be equipped, trained and deployed as determined by the colonel; and 17 (vii) not have reached the age of 68 as of the date of appointment. 18 Retired uniformed members appointed shall, in accordance with sections 91 and 91A of 19chapter 32, be at-will employees subject to appointment and removal by the colonel in a manner 20consistent with sections 52 and 53 of this chapter and shall be appointed for a term of 1 year 21subject to renewal in the colonel's sole discretion. Such retired uniformed members shall not be 22subject to the civil service law or rules, shall not be entitled to any benefits of such law or rules, 23but shall, in the performance of assigned duties and for the purposes of section 9A of chapter 24258, be deemed a member of the state police.
