[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE SENATE, NO. 2150 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to electric ratepayer protections. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 164 of the General Laws is hereby amended by inserting after 2section 1K the following section: 3 Section 1L. Beginning on January 1, 2024, no supplier, energy marketer, or energy 4broker shall execute a new contract for generation services with any individual residential retail 5customer. This provision shall not apply to, or otherwise affect, any government body that 6aggregates the load of residential retail customers as part of a municipal aggregation plan 7pursuant to chapter 164, ยง 134. Any violation of this provision shall be deemed an unfair and 8deceptive act pursuant to the provisions of chapter 93A, and the attorney general is hereby 9authorized to bring an action under section 4 of chapter 93A to enforce this provision and to 2 of 2 10obtain restitution, civil penalties, injunctive relief, and any other relief awarded pursuant to said 11chapter 93A.
