The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to moving violations. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Section 3 of Chapter 90C of the General Laws, as appearing in the 2020 Official Edition, 2is hereby amended by inserting at the end thereof the following paragraph:- 3 A person’s first civil motor vehicle infraction, as defined in section 1 of this chapter, shall 4not be considered as a conviction of a moving violation of the motor vehicle laws or a 5surchargeable incident or offense under section 113B of chapter 175 or under any merit rating 6plan or safe driver insurance plan. This provision shall not apply to violations that include 7charges of driving while under the influence or violations that result in grievous bodily harm or 8death.
