An Act relative to retrofit headlights in vehicles.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Section 7 of chapter 90 of the General Laws, as appearing in the 2022 
2Official Edition, is hereby amended by inserting, in line 80, after the words “such way.” the 
3following sentence:- No motor vehicle so operated shall display a headlamp that: (i) flickers or 
4cannot reliably sustain a consistent brightness level; (ii) is improperly installed; (iii) does not 
5utilize pulse width modulation, or similar technology to prevent flickering; or (iv) does not meet 
6certain other quality standards, as determined by the registrar.
7 SECTION 2. Said chapter 90 is hereby further amended by inserting after section 9D the 
8following section:-
9 Section 9E. No person shall manufacture, sell or offer for sale or trade any motor vehicle 
10headlamp that: (i) flickers or cannot reliably sustain a consistent brightness level; (ii) does not 
11utilize pulse width modulation, or similar technology to prevent flickering; or (iii) does not meet 
12certain other quality standards, as determined by the registrar 2 of 2
13 SECTION 3. Not later than 180 days following the passage of this act, the registrar of 
14motor vehicles shall, pursuant to chapter 30A, promulgate regulations for the implementation of 
15this act, which shall include quality standards for motor vehicle headlamps.
