BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 10 That the Laws of Maryland read as follows: 11 Article – Health – General 12 13–4202. 13 (a) There is a Maryland Behavioral Health and Public Safety Center of Excellence 14 in the Governor’s Office of Crime Prevention, Youth, and Victim Services. 15 (b) The purposes of the Center are to: 16 (1) Act as the statewide information repository for behavioral health 17 treatment and diversion programs related to the criminal justice system; 18 (2) Lead the development of a strategic plan to increase treatment and 19 reduce the detention of individuals with behavioral health disorders involved in the criminal 20 justice system; 21 (3) Provide technical assistance to local governments for developing effective 22 behavioral health systems of care that prevent and minimize involvement with the criminal 23 justice system for individuals with behavioral health disorders; 24 (4) Facilitate local or regional planning workshops using the Sequential 25 Intercept Model; 26 (5) Coordinate with the Department and the Behavioral Health 27 Administration to implement and track the progress of creating an effective behavioral 28 health system of care in the State relating to individuals involved in the criminal justice 29 system; and 30 (6) Identify and inform any relevant stakeholders of any federal funding 31 available to the Center to carry out the mission of the Center, including through the provision 32 of grants, scholarships, and other funding to recipients engaged in training, the provision of 33 services, or the study of matters relating to behavioral health, public safety, and criminal 34 justice. 35 4 HOUSE BILL 1018 (c) In carrying out its duties, the Center shall continuously monitor and analyze 1 its models, plans, policies, strategies, programs, technical assistance, and training for their 2 validity and for opportunities to reduce and eliminate disparities in the criminalization of 3 racial minorities with behavioral health disorders and increase access to culturally 4 competent care. 5 (d) (1) The Governor’s Office of Crime Prevention, Youth, and Victim Services 6 shall appoint the following individuals to jointly oversee the Center: 7 (i) A crisis intervention law enforcement coordinator; 8 (ii) A mental health coordinator; and 9 (iii) Any other individuals determined necessary by the Office. 10 (2) The individuals appointed under paragraph (1) of this subsection may 11 be associated with the Crisis Intervention Team Center of Excellence within the Governor’s 12 Office of Crime Prevention, Youth, and Victim Services. 13 (e) The Center may designate points of contact throughout the State who specialize 14 in behavioral health treatment within the criminal justice system to brief the Center on the 15 progress of statewide implementation of diversion programs. 16 (f) The Center may coordinate with the Justice Reinvestment Oversight Board and 17 other State entities working to reduce State and local detention facility populations and 18 recidivism. 19 (g) (1) The Center may enter into contracts with the University of Maryland 20 System, Maryland HBCUs, or other entities or organizations for the purposes of carrying 21 out its mission. 22 (2) FOR FISCAL YEAR 2024 AND EACH FISCAL YEAR THEREAFTER , THE 23 GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDG ET BILL AN APPROPRIA TION OF 24 $500,000 FOR THE CENTER TO ENTER INTO CONTRACTS FOR THE PU RPOSES OF 25 CARRYING OUT ITS MIS SION, INCLUDING: 26 (I) FACILITATING THE GATH ERING OF INFORMATION FROM ALL 27 COUNTIES IN THE STATE; 28 (II) SUPPORTING LOCAL OR R EGIONAL PLANNING WOR KSHOPS; 29 AND 30 (III) SUPPORTING THE PURPOSES OF THE CENTER ESTABLISHED 31 UNDER SUBSECTION (B) OF THIS SECTION. 32 HOUSE BILL 1018 5 (h) The operation of the Center is subject to the limitations of the State budget. 1 Article – Health – General 2 SUBTITLE 9. BEHAVIORAL HEALTH CRISIS RESPONSE SERV ICES 18 AND CONDITIONS; 19 2. CRISIS INTERVENTION ; AND 20 3. THE DIVERSION OF IND IVIDUALS WITH BEHAVI ORAL 21 HEALTH CONDITIONS AW AY FROM LAW ENFORCEM ENT RESPONSE TO MORE 22 APPROPRIATE RESOURCE S; AND 23 4. PROCEDURES TO TRIAGE AND MAKE APPROPRIATE 24 DISPATCH DECISIONS F OR INDIVIDUALS SUFFE RING AN ACUTE BEHAVI ORAL 25 HEALTH CRISIS; 26 10 HOUSE BILL 1018 (e) (1) The standards established by the Board under subsection (b)(15) of this 1 section shall include onboarding standards for newly hired 9–1–1 specialists and minimum 2 continuing education standards for 9–1–1 specialists. 3 (2) (i) At least once each year, the Board shall provide for an audit of 4 each public safety answering point in order to ensure that 9–1–1 specialists and other 5 personnel employed by the public safety answering point have satisfied the training 6 requirements established in accordance with subsection (b)(15) of this section. 7 (ii) The audit described under subparagraph (i) of this paragraph 8 may be conducted concurrently with an inspection of the public safety answering point in 9 accordance with subsection (b)(10) of this section. 10 (H) (1) THE BOARD SHALL ESTABLISH A PROCESS BY WHICH A PUBLIC 11 SAFETY ANSWERING POI NT MAY APPLY FOR A G RANT TO EXPAND PUBLI C SAFETY 12 ANSWERING POINT PERS ONNEL TRAINING DESCRIBED I N SUBSECTION (B)(15)(II) 13 OF THIS SECTION. 14 (2) FOR FISCAL YEAR 2024, THE GOVERNOR SHALL INCLUD E IN THE 15 ANNUAL BUDGET BILL A N APPROPRIATION OF $500,000 FOR THE BOARD TO 16 PROVIDE GRANTS TO LO CAL JURISDICTIONS TO EXPAND TRAINING DESC RIBED IN 17 SUBSECTION (B)(15)(II) OF THIS SECTION. 18 Article – State Government 19 SUBTITLE 35. AND BE IT FURTHER ENACTED, That the Executive Director of the 6 Governor’s Office of Crime Prevention, Youth, and Victim Services who is serving on the 7 effective date of this Act may continue to serve until 2 years after the effective date of this 8 Act and may be reappointed after the expiration of the Executive Director’s term. 9 SECTION 3. 2.
