State Personnel – Professional Service and Grievances – Baltimore City 2 
Community College – Faculty 3 
 
FOR the purpose of establishing that full–time faculty members employed by Baltimore 4 
City Community College are in the professional service in the State Personnel 5 
Management System; allowing certain faculty to participate in a certain grievance 6 
procedure; and generally relating to the State Personnel Management System and 7 
faculty employed by Baltimore City Community College. 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2 
That the Laws of Maryland read as follows: 3 
 
Article – Education 4

 (c) “College” means Baltimore City Community College, formerly known as the 6 
New Community College of Baltimore. 7 
 
16–510. 8 
 
 (a) (1) [All] EXCEPT AS PROVIDED UN DER PARAGRAPH (3) OF THIS 9 
SUBSECTION, employees of the College are in an independent personnel system. 10 
 
 (2) The personnel system established under PARAGRAPH (1) OF this 11 
subsection shall include provisions for consideration of hiring a contractual employee to fill 12 
a vacant position in the same or similar classification in which the contractual employee is 13 
employed. 14 
 
 (3) EACH FULL–TIME MEMBER OF THE FACULTY EMPLOYED BY THE 15 
COLLEGE IS IN THE PRO FESSIONAL SERVICE IN THE STATE PERSONNEL 16 
MANAGEMENT SYSTEM. 17 
 
 (b) If an employee was employed by the State in the skilled service of the State 18 
Personnel Management System, beginning January 1, 1996, the employee’s years of service 19 
as an employee of Baltimore City shall be added to the employee’s years of service with the 20 
State for the purpose of determining: 21 
 
 (1) The annual leave accrual rate provided in § 9–302 of the State 22 
Personnel and Pensions Article; 23 
 
 (2) Seniority under Title 11, Subtitle 2 of the State Personnel and Pensions 24 
Article, relating to layoffs; and 25 
 
 (3) Seniority under § 7–207(b) of the State Personnel and Pensions Article, 26 
relating to promotions. 27

 (a) Except as otherwise provided by law, this title applies to all employees in the 30 
State Personnel Management System within the Executive Branch and independent 31   	HOUSE BILL 1028 	3 
 
 
personnel systems. 1 
 
 (b) This title does not apply to: 2 
 
 (8) [a member of the faculty,] an officer[,] or an administrative employee 3 
of Baltimore City Community College; 4 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 5 
1, 2022. 6
