AN ACT concerning 1 
 
State Personnel – Professional Service – Juvenile Services Education Teachers 2 
and Correction Education Teachers 3 
 
FOR the purpose of providing that certain teachers employed by the Department of 4 
Juvenile Services and the Maryland Department of Labor are in the professional 5 
service in the State Personnel Management System; and generally relating to the 6 
State Personnel Management System.  7

 SECTION 1. BE IT ENACTED B Y THE GENERAL ASSEMBLY OF MARYLAND, 23 
That the Laws of Maryland read as follows: 24

 There is a Juvenile Services Education Program within the Department. 2 
 
9–603. 3 
 
 (a) (1) Beginning July 1, 2022, the Department and the Board, subject to the 4 
memorandum of understanding, jointly shall have the authority and responsibility for 5 
implementing the juvenile services educational programs in the State. 6 
 
 (2) The Superintendent shall provide and oversee educational services to 7 
all juveniles in a residential facility. 8 
 
 (b) The Superintendent shall implement for each residential facility an 9 
educational program as approved by the Board that: 10 
 
 (1) meets the special needs and circumstances of the juveniles in the 11 
residential facility; and 12 
 
 (2) is accredited by an approved accrediting agency. 13 
 
 (c) (1) The Department, subject to the memorandum of understanding, shall 14 
employ any staff necessary to carry out the Juvenile Services Education Program as 15 
provided in the State budget. 16 
 
 (2) Educational staff in the Department shall be subject to the career 17 
ladder and salary provisions under Title 6, Subtitle 10 of the Education Article. 18 
 
 (3) EACH TEACHER IN THE JUVENILE SERVICES EDUCATION 19 
PROGRAM WHO IS EMPLOYED BY THE DEPARTMENT IS IN THE PROFESSIONAL 20 
SERVICE IN THE STATE PERSONNEL MANAGEMENT SYSTEM.  21 
 
 (d) The Department shall adopt regulations to carry out the requirements of this 22 
section. 23 
 
 (e) The Board may authorize the Department to contract with a nonprofit private 24 
party or a county board of education to provide educational services for juveniles in a 25 
residential facility. 26 
 
 (f) For fiscal year 2023 and each fiscal year thereafter, the Governor shall include 27 
in the annual budget bill an appropriation in an amount sufficient to meet the requirements 28 
of this subtitle. 29 
 
Article – Labor and Employment 30

 (a) The Department is responsible for the provision of education and workforce 1 
skills training programs in the adult correctional institutions in the State. 2 
 
 (b) The Secretary shall appoint a Director of Education and Workforce Skills 3 
Training for Correctional Institutions. 4 
 
 (c) The Director shall receive the salary provided in the budget of the 5 
Department. 6 
 
 (d) The Director shall: 7 
 
 (1) implement and operate the educational and workforce skills training 8 
programs developed by the Council in the correctional institutions; 9 
 
 (2) meet with and advise the Council about the programs; and 10 
 
 (3) consult with the Commissioner of Correction and the warden of each 11 
institution about the operation of the programs. 12 
 
 (E) EACH TEACHER IN AN EDUCATIONAL AND WORK FORCE SKILLS 13 
TRAINING PROGRAM WHO IS EMPLO YED BY THE DEPARTMENT IS IN THE 14 
PROFESSIONAL SERVICE IN THE STATE PERSONNEL MANAGEMENT SYSTEM.  15 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 16 
1, 2022. 17
