Criminal Procedure Baltimore City – Pretrial Release of Defendant – Notice 2 
 
FOR the purpose of requiring a court and the Office of the State’s Attorney the Department 3 
of Public Safety and Correctional Services to notify a certain law enforcement agency 4 
the Baltimore Police Department if a defendant charged with certain crimes is 5 
released prior to trial; and generally relating to pretrial release procedures in 6 
Baltimore City. 7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 
That the Laws of Maryland read as follows: 2 
 
Article – Criminal Procedure 3 
 
5–105. 4 
 
 (A) THIS SECTION APPLIES ONLY TO A DEFENDANT WHO I S CHARGED WITH : 5 
 
 (1) MURDER IN THE FIRST DEGREE; 6 
 
 (2) MURDER IN THE SECOND DEGREE; 7 
 
 (3) ATTEMPTED MURDER IN THE FIRST DEGREE ; 8 
 
 (4) ATTEMPTED MURDER IN THE SECOND DEGREE ; 9 
 
 (5) ROBBERY WITH A DANGE ROUS WEAPON ; OR 10 
 
 (6) ARMED CARJACKING IN BALTIMORE CITY. 11 
 
 (B) IF A DEFENDANT IS REL EASED BEFORE TRIAL , THE COURT AND THE 12 
OFFICE OF THE STATE’S ATTORNEY DEPARTMENT OF PUBLIC SAFETY AND 13 
CORRECTIONAL SERVICES SHALL PROVIDE NOTICE WITHIN 48 24 HOURS OF THE 14 
RELEASE TO THE LAW ENFORCEMENT AGEN CY THAT ARRESTED THE DEFENDANT 15 
BALTIMORE POLICE DEPARTMENT . 16 
 
 (C) NOTICE PROVIDED UNDER THIS SECTION SHALL B E PROVIDED IN A 17 
MANNER THAT ALLOWS T HE SORTING AND FILTERING OF THE INFORMATION 18 
PROVIDED BY THE DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL 19 
SERVICES.  20 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 21 
October 1, 2022. 22
