[Brackets] indicate matter deleted from existing law. *hb0512* HOUSE BILL 512 F1 2lr1333 By: Delegate Guyton Introduced and read first time: January 21, 2022 Assigned to: Ways and Means A BILL ENTITLED AN ACT concerning 1 Professional Standards and Teacher Education Board – Composition – 2 Alteration 3 FOR the purpose of altering the composition of the Professional Standards and Teacher 4 Education Board by adding a member of the Maryland Association of Nonpublic 5 Special Education Facilities; and generally relating to the Professional Standards 6 and Teacher Education Board. 7 BY repealing and reenacting, with amendments, 8 Article – Education 9 Section 6–703 10 Annotated Code of Maryland 11 (2018 Replacement Volume and 2021 Supplement) 12 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 That the Laws of Maryland read as follows: 14 Article – Education 15 6–703. 16 (a) (1) The Board consists of [25] THE FOLLOWING members[. 17 (2) Of the 25 Board members]: 18 (i) [8 shall be] EIGHT public school classroom teachers, as follows: 19 1. [6 shall be] SIX chosen from a list of nominees provided by 20 the statewide teachers’ organization representing a majority of teachers in the State for 21 collective bargaining purposes; and 22 2 HOUSE BILL 512 2. [2 shall be] TWO chosen from a list of nominees provided 1 by a statewide teachers’ organization representing teachers in at least one jurisdiction 2 within the State for collective bargaining purposes other than the majority organization 3 provided for in item 1 of this subparagraph; 4 (ii) [1 shall be a] ONE certified nonpublic school classroom teacher, 5 chosen from a list of nominees provided by the Association of Independent Schools; 6 (iii) [6 shall be] SIX teacher education faculty members from colleges 7 of the State, chosen from a list of nominees provided by: 8 1. The Maryland Association of Teacher Educators; and 9 2. The Maryland Association of Colleges of Teacher 10 Education; 11 (iv) [4 shall be] FOUR administrative or supervisory staff members 12 of public schools, as follows: 13 1. [2 shall be] TWO chosen from a list of nominees provided 14 by the Public School Superintendents’ Association of Maryland; 15 2. [1 shall be] ONE chosen from a list of nominees provided 16 by the Maryland Association of Secondary Principals; and 17 3. [1 shall be] ONE chosen from a list of nominees provided 18 by the Maryland Association of Elementary School Administrators; 19 (v) [2 shall be] ONE administrative or supervisory staff of the 20 approved nonpublic schools of the State, chosen from a list of nominees provided by the 21 Association of Independent Schools; 22 (vi) [1 shall be a] ONE member of a local board of education, chosen 23 from a list of nominees provided by the Maryland Association of Boards of Education; 24 (VII) ONE MEMBER OF THE MARYLAND ASSOCIATION OF 25 NONPUBLIC SPECIAL EDUCATION FACILITIES, CHOSEN FROM A LIST O F NOMINEES 26 PROVIDED BY THE MARYLAND ASSOCIATION OF NONPUBLIC SPECIAL EDUCATION 27 FACILITIES; 28 [(vii)] (VIII) [2 shall be] TWO representatives of the general public, as 29 follows: 30 1. [1 shall be] ONE chosen from a list of nominees provided 31 by the Speaker of the House of Delegates of Maryland; and 32 HOUSE BILL 512 3 2. [1 shall be] ONE chosen from a list of nominees provided 1 by the President of the Senate of Maryland; and 2 [(viii)] (IX) [1 shall be] the State Superintendent or a designee of the 3 State Superintendent. 4 [(3)] (2) The Board shall include all the members of the Professional 5 Standards and Teacher Education Advisory Board serving on July 1, 1991. 6 (b) (1) The Governor, with the advice and consent of the Senate of Maryland, 7 shall appoint the members of the Board described in subsection [(a)(2)(i)] (A)(1)(I) through 8 [(vii)] (VIII) of this section. 9 (2) In making the appointments required under this subsection, the 10 Governor shall ensure that the Board is representative of: 11 (i) The geographic regions of the State; and 12 (ii) Minority populations of the State as defined in § 9–301 of the 13 State Government Article. 14 (c) (1) The term of an appointed member is 3 years. 15 (2) The terms of the appointed members are staggered as required by the 16 terms provided for members of the Board on October 1, 1991. 17 (3) At the end of a term, a member continues to serve until a successor is 18 appointed. 19 (4) A member who is appointed after a term has begun serves only for the 20 remainder of the term and until a successor is appointed and qualifies. 21 (d) The Governor may remove a member for incompetence or misconduct. 22 (e) From among its members, the Board annually shall elect a chairman. 23 (f) A majority of the members of the Board then serving on the Board is a quorum. 24 (g) The staff for the Board shall be provided by the State Board. 25 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 26 1, 2022. 27
