Strike out indicates matter stricken from the bill by amendment or deleted from the law by amendment. *hb0512* HOUSE BILL 512 F1 2lr1333 By: Delegate Guyton Introduced and read first time: January 21, 2022 Assigned to: Ways and Means Committee Report: Favorable with amendments House action: Adopted Read second time: March 9, 2022 CHAPTER ______ AN ACT concerning 1 Professional Standards and Teacher Education Board – Composition – 2 Alteration Composition and Regulations 3 FOR the purpose of altering the composition of the Professional Standards and Teacher 4 Education Board by adding a member of the Maryland Association of Nonpublic 5 Special Education Facilities; requiring the State Board of Education and the 6 Professional Standards and Teacher Education Board to develop for consideration 7 rules and regulations to attract and provide certification to teachers from groups 8 historically underrepresented in the teaching profession; and generally relating to 9 the Professional Standards and Teacher Education Board. 10 BY repealing and reenacting, with amendments, 11 Article – Education 12 Section 6–703 and 6–704 13 Annotated Code of Maryland 14 (2018 Replacement Volume and 2021 Supplement) 15 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16 That the Laws of Maryland read as follows: 17 Article – Education 18 6–703. 19 (a) (1) The Board consists of [25] THE FOLLOWING members[. 20 2 HOUSE BILL 512 (2) Of the 25 Board members]: 1 (i) [8 shall be] EIGHT public school classroom teachers, as follows: 2 1. [6 shall be] SIX chosen from a list of nominees provided by 3 the statewide teachers’ organization representing a majority of teachers in the State for 4 collective bargaining purposes; and 5 2. [2 shall be] TWO chosen from a list of nominees provided 6 by a statewide teachers’ organization representing teachers in at least one jurisdiction 7 within the State for collective bargaining purposes other than the majority organization 8 provided for in item 1 of this subparagraph; 9 (ii) [1 shall be a] ONE certified nonpublic school classroom teacher, 10 chosen from a list of nominees provided by the Association of Independent Schools; 11 (iii) [6 shall be] SIX teacher education faculty members from colleges 12 of the State, chosen from a list of nominees provided by: 13 1. The Maryland Association of Teacher Educators; and 14 2. The Maryland Association of Colleges of Teacher 15 Education; 16 (iv) [4 shall be] FOUR administrative or supervisory staff members 17 of public schools, as follows: 18 1. [2 shall be] TWO chosen from a list of nominees provided 19 by the Public School Superintendents’ Association of Maryland; 20 2. [1 shall be] ONE chosen from a list of nominees provided 21 by the Maryland Association of Secondary Principals; and 22 3. [1 shall be] ONE chosen from a list of nominees provided 23 by the Maryland Association of Elementary School Administrators; 24 (v) [2 shall be] ONE administrative or supervisory staff of the 25 approved nonpublic schools of the State, chosen from a list of nominees provided by the 26 Association of Independent Schools; 27 (vi) [1 shall be a] ONE member of a local board of education, chosen 28 from a list of nominees provided by the Maryland Association of Boards of Education; 29 (VII) ONE MEMBER OF THE MARYLAND ASSOCIATION OF 30 NONPUBLIC SPECIAL EDUCATION FACILITIES, CHOSEN FROM A LIST O F NOMINEES 31 HOUSE BILL 512 3 PROVIDED BY THE MARYLAND ASSOCIATION OF NONPUBLIC SPECIAL EDUCATION 1 FACILITIES; 2 [(vii)] (VIII) [2 shall be] TWO representatives of the general public, as 3 follows: 4 1. [1 shall be] ONE chosen from a list of nominees provided 5 by the Speaker of the House of Delegates of Maryland; and 6 2. [1 shall be] ONE chosen from a list of nominees provided 7 by the President of the Senate of Maryland; and 8 [(viii)] (IX) [1 shall be] the State Superintendent or a designee of the 9 State Superintendent. 10 [(3)] (2) The Board shall include all the members of the Professional 11 Standards and Teacher Education Advisory Board serving on July 1, 1991. 12 (b) (1) The Governor, with the advice and consent of the Senate of Maryland, 13 shall appoint the members of the Board described in subsection [(a)(2)(i)] (A)(1)(I) through 14 [(vii)] (VIII) of this section. 15 (2) In making the appointments required under this subsection, the 16 Governor shall ensure that the Board is representative of: 17 (i) The geographic regions of the State; and 18 (ii) Minority populations of the State as defined in § 9–301 of the 19 State Government Article. 20 (c) (1) The term of an appointed member is 3 years. 21 (2) The terms of the appointed members are staggered as required by the 22 terms provided for members of the Board on October 1, 1991. 23 (3) At the end of a term, a member continues to serve until a successor is 24 appointed. 25 (4) A member who is appointed after a term has begun serves only for the 26 remainder of the term and until a successor is appointed and qualifies. 27 (d) The Governor may remove a member for incompetence or misconduct. 28 (e) From among its members, the Board annually shall elect a chairman. 29 (f) A majority of the members of the Board then serving on the Board is a quorum. 30 4 HOUSE BILL 512 (g) The staff for the Board shall be provided by the State Board. 1 6–704. 2 (a) (1) In accordance with Title 10, Subtitle 1 of the State Government Article, 3 both the State Board and the Board shall develop for consideration rules and regulations 4 for: 5 (i) Except as provided in item (iii) of this paragraph, the 6 certification of teachers and other professional personnel in accordance with this article; 7 (ii) Requirements for preparation of teachers and other education 8 personnel; [and] 9 (iii) The certification of social workers employed by a local school 10 employer as professional personnel; AND 11 (IV) ATTRACTING AND PROVID ING CERTIFICATION TO 12 TEACHERS FROM GROUPS HISTORICALLY UNDERRE PRESENTED IN THE TEA CHING 13 PROFESSION . 14 (2) Rules and regulations developed by the State Board shall be reviewed 15 by the Board. 16 (3) Rules and regulations developed by the Board shall be reviewed by the 17 State Board. 18 (4) Rules and regulations that are initiated by either the State Board or 19 the Board and submitted for review to each other shall be acted upon within 60 days of 20 their receipt by the other party. 21 (5) Recommendations on rules and regulations shall be implemented if 22 both the Board and the State Board approve them. 23 (6) An individual who is otherwise qualified may not be denied the right to 24 receive credentials from the Board, to receive training to become a teacher, or to practice 25 teaching in any school because that individual is totally or partially blind. 26 (7) A county board may not refuse to contract with or engage a teacher 27 because of blindness if the blind teacher is capable of performing the duties of the position 28 for which he has applied. 29 (8) The right of a school psychologist, who is certified by the Board to 30 practice school psychology consistent with the provisions of that certification, may not be 31 limited by Title 18 of the Health Occupations Article with respect to the practice of school 32 psychology in an educational institution. 33 HOUSE BILL 512 5 (b) (1) The Board may establish a fee, not to exceed $10, for issuance or 1 renewal of a teacher certificate. 2 (2) The Board may not require a fee: 3 (i) For the addition of any new area of certification to a currently 4 valid certificate; or 5 (ii) Except for the fee authorized under this subsection, for the 6 evaluation of credentials for the certification of teachers. 7 SECTION 2.
