BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 6 That the Laws of Maryland read as follows: 7 Article – State Finance and Procurement 8 5–812. 9 There is a Patuxent River Commission in the Department. 10 5–814. 11 (a) The Commission consists of the following [34] 35 36 voting members 12 [appointed by the Governor]: 13 (1) 7 individuals, 1 from each of the following 7 counties, APPOINTED BY 14 THE GOVERNOR on the recommendation of the governing body of that county: 15 (i) Anne Arundel County; 16 (ii) Calvert County; 17 (iii) Charles County; 18 (iv) Howard County; 19 (v) Montgomery County; 20 (vi) Prince George’s County; and 21 (vii) St. Mary’s County; 22 (2) 1 individual representing the Washington Suburban Sanitary 23 Commission, APPOINTED BY THE GOVERNOR; 24 (3) 1 individual from each of the following regional planning agencies, 25 APPOINTED BY THE GOVERNOR: 26 (i) the Maryland–National Capital Park and Planning Commission, 27 Montgomery County; 28 HOUSE BILL 716 3 (ii) the Maryland–National Capital Park and Planning Commission, 1 Prince George’s County; and 2 (iii) the Tri–County Council for Southern Maryland; 3 (4) 1 individual, representing a municipality in the watershed, 4 APPOINTED BY THE GOVERNOR on the recommendation of the corresponding governing 5 body of that municipality; 6 (5) 1 individual representing a large federal facility in the watershed, 7 APPOINTED BY THE GOVERNOR; 8 (6) as far as possible, the following individuals appointed by the Governor 9 with the advice and consent of the Senate, shall be selected to represent broad geographic, 10 economic, and social interests within the watershed: 11 (i) 2 individuals representing farming interests; 12 (ii) 1 individual representing business interests; 13 (iii) 4 individuals representing environmental and citizen interests; 14 (iv) 2 individuals representing developer interests; 15 (v) 2 individuals 1 INDIVIDUAL representing academic interests; 16 (vi) 2 individuals, 1 each, representing 2 soil conservation districts; 17 (vii) 1 individual representing the University of Maryland 18 Cooperative Extension Service; and 19 (viii) 1 individual representing watermen interests; [and] 20 (IX) 1 INDIVIDUAL REPRESENT ING AN ORGANIZATION OR UNIT 21 OF LOCAL GOVERNMENT ENGAGED IN WATERSHED MANAGEMENT AND 22 RESTORATION ; 23 (7) THE PATUXENT RIVERKEEPER; AND 24 (8) as ex officio members: 25 (i) the Secretary of Agriculture or a designee; 26 (ii) the Secretary of the Environment or a designee; 27 4 HOUSE BILL 716 (iii) the Secretary of Natural Resources or a designee; 1 (iv) the Secretary of Planning or a designee; 2 (v) the Secretary of Transportation or a designee; and 3 (vi) the Chief of the Planning Division, U.S. Army Corps of 4 Engineers, Baltimore District or a designee; AND 5 (VII) THE PRESIDENT OF THE UNIVERSITY OF MARYLAND 6 CENTER FOR ENVIRONMENTAL SCIENCE OR A DESIGNEE . 7 (b) (1) The term of a member appointed under subsection (a)(1) through (6) of 8 this section is 4 years. 9 (2) At the end of a term, a member appointed under subsection (a)(1) 10 through (6) of this section continues to serve until a successor is appointed and qualifies. 11 (3) A member who is appointed under subsection (a)(1) through (6) of this 12 section after a term has begun serves only for the rest of the term and until a successor is 13 appointed and qualifies. 14 (4) The terms of the members are staggered as required by the terms 15 provided for members of the Commission on October 1, 1995. 16 (c) (1) The Commission may establish and abolish nonvoting memberships. 17 (2) A nonvoting member shall be appointed by the Commission for a term 18 set by the Commission. 19 SECTION 2. AND BE IT FURTHER ENACTED, That the Patuxent Riverkeeper 20 shall become a full voting member of the Patuxent River Commission on June 1, 2022. 21 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect June 22 1, 2022 is an emergency measure, is necessary for the immediate preservation of the public 23 health or safety, has been passed by a yea and nay vote supported by three–fifths of all the 24 members elected to each of the two Houses of the General Assembly, and shall take effect 25 from the date it is enacted. 26
