BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 That the Laws of Maryland read as follows: 20 2 SENATE BILL 174 Article – Health – General 1 5–802. 2 (a) There is a Mortality and Quality Review Committee established within the 3 Department. 4 (b) The purpose of the Committee is to prevent avoidable injuries and avoidable 5 deaths and to improve the quality of care provided to persons with developmental 6 disabilities. 7 5–803. 8 The Committee shall: 9 (2) Review aggregate incident data regarding facilities or programs that 10 are licensed or operated by the Developmental Disabilities Administration or operating by 11 waiver under § 7–903(b) of this article; 12 (4) Make recommendations to the Secretary and the Secretary of 13 Disabilities to prevent avoidable injuries and avoidable deaths and improve quality of care. 14 5–806.1. 15 (a) (1) The Office of Health Care Quality shall provide aggregate incident data 16 to the Committee once every 3 months. 17 (2) When providing aggregate incident data to the Committee, to the extent 18 practicable, the Office of Health Care Quality shall identify trends and patterns that may 19 threaten the health, safety, or well–being of an individual. 20 (b) The Committee shall review the aggregate incident data and make findings 21 and recommendations to the Department on system quality assurance needs. 22 (c) The Committee may consult with experts as needed to carry out the provisions 23 of this section. 24 5–808. 25 (a) (1) At least once in a calendar year, the Committee shall prepare a report 26 for public distribution. 27 (2) The report shall include aggregate information that sets forth the 28 numbers of deaths reviewed, the ages of the deceased, causes and circumstances of death, 29 a review of aggregate incident data, a summary of the Committee’s activities, and summary 30 findings. 31 SENATE BILL 174 3 (5) The Developmental Disabilities Administration shall provide the report 1 to the facilities or programs that are operated or licensed by the Developmental Disabilities 2 Administration or operating by waiver under § 7–903(b) of this article. 3 (b) (1) In addition to the public report issued under subsection (a) of this 4 section, the Committee or its subcommittee may at any time issue preliminary findings or 5 make preliminary recommendations to the Secretary, the Secretary of Disabilities, the 6 Director of the Developmental Disabilities Administration, the Director of the Behavioral 7 Health Administration, or to the Director of the Office of Health Care Quality. 8 Chapter 268 of the Acts of 2006, as amended by Chapters 48 and 49 of the Acts of 9 2009 and Chapters 340 and 341 of the Acts of 2012 10 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 11 1, 2006. It shall remain effective for a period of [16] 26 years and 6 months and, at the end 12 of December 31, [2022] 2032, with no further action required by the General Assembly, 13 this Act shall be abrogated and of no further force and effect. 14 SECTION 2.
