AN ACT concerning 1 
 
Vehicle Laws – Driver’s Licenses and Identification Cards – Temporary Renewal 2 
 
FOR the purpose of authorizing the Motor Vehicle Administration to issue a temporary 3 
renewal for a driver’s license or identification card for a certain amount of time for 4 
certain applicants; and generally relating to the temporary renewal of driver’s 5 
licenses and identification cards. 6

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 22 
That the Laws of Maryland read as follows: 23

 (a) On application, the Administration shall issue an identification card to any 2 
applicant who: 3 
 
 (1) Is a resident of this State; 4 
 
 (2) Does not have a driver’s license; 5 
 
 (3) Presents a birth certificate or other proof of age and identity acceptable 6 
to the Administration; 7 
 
 (4) Provides satisfactory documentary evidence that the applicant has 8 
lawful status; 9 
 
 (5) (i) Provides satisfactory documentary evidence that the applicant 10 
has a valid Social Security number by presenting the applicant’s Social Security 11 
Administration account card or, if the Social Security Administration account card is not 12 
available, any of the following documents bearing the applicant’s Social Security number: 13 
 
 1. A current W–2 form; 14 
 
 2. A current SSA–1099 form; 15 
 
 3. A current non–SSA–1099 form; or 16 
 
 4. A current pay stub with the applicant’s name and Social 17 
Security number on it; or 18 
 
 (ii) Provides satisfactory documentary evidence that the applicant is 19 
not eligible for a Social Security number; and 20 
 
 (6) Presents a completed application for an identification card on a form 21 
furnished by the Administration. 22 
 
 (i) (1) Subject to paragraphs (2) [and (3)] THROUGH (4) of this subsection, an 23 
identification card issued to an applicant expires at the end of a period of not more than 8 24 
years determined in regulations adopted by the Administration. 25 
 
 (2) Before the expiration of an identification card, if an individual does not 26 
possess all of the documents required for renewal, the Administration may extend the 27 
individual’s identification card for a period not to exceed 90 days. 28 
 
 (3) (i) If an applicant has temporary lawful status, the Administration 29 
may not issue an identification card to the applicant for a period that extends beyond the 30 
expiration date of the applicant’s authorized stay in the United States or, if there is no 31   	SENATE BILL 218 	3 
 
 
expiration date, for a period longer than 1 year. 1 
 
 (ii) Nothing contained in this paragraph may be construed to allow 2 
the issuance of an identification card for a period longer than the period described in 3 
paragraph (1) of this subsection. 4 
 
 (iii) The Administration shall indicate on the face and in the 5 
machine–readable zone of a temporary identification card issued under this paragraph that 6 
the card is a temporary identification card. 7 
 
 (4) (I) NOTWITHSTANDING ANY O THER PROVISION OF TH IS 8 
SECTION, THE ADMINISTRATION MAY IS SUE A TEMPORARY RENE WAL FOR AN 9 
IDENTIFICATION CARD THAT EXTENDS THE EXP IRATION DATE FOR A P ERIOD NOT 10 
EXCEEDING 2 YEARS FOR AN APPLICA NT WHO: 11 
 
 1. HAS THE DOCUMENTATION REQUIRED BY FEDERAL 12 
LAW, AS ENUMERATED IN SUB SECTION (A)(4) AND (5) OF THIS SECTION , ON FILE 13 
WITH THE ADMINISTRATION ; 14 
 
 2. HAS A PHOTOGRAPH ON F	ILE WITH THE 15 
ADMINISTRATION THAT W ILL NOT BE 16 YEARS OLD OR OLDER BY THE EXPIRATION 16 
DATE OF THE TEMPORAR Y RENEWAL; AND 17 
 
 3. HAS AN IDENTIFICATION CARD THAT WAS ISSUED FOR 18 
THE FULL TERM UNDER PARAGRAPH (1) OF THIS SUBSECTION . 19 
 
 (II) THE ADMINISTRATION MAY MA KE TEMPORARY RENEWAL 20 
OF AN IDENTIFICATION CARD AVAILABLE TO: 21 
 
 1. AN ACTIVE DUTY MEMBER OF THE ARMED FORCES OF 22 
THE UNITED STATES OR A SPOUSE OR DEPENDENT OF THE MEM BER; 23 
 
 2. A MEMBER OF THE FOREIGN SERVICE OF THE 24 
UNITED STATES OR A SPOUSE OR DEPENDENT OF THE MEM BER; 25 
 
 3. A RESIDENT OF THE STATE WHO IS A STUDEN T 26 
STUDYING OUTSIDE THE STATE; 27 
 
 4. A RESIDENT OF THE STATE WHO IS TEMPORAR ILY 28 
RESIDING OUTSIDE THE STATE FOR AT LEAST 6 MONTHS; 29 
 
 5. A RESIDENT OF THE STATE WHO HOLDS A N 30 
IDENTIFICATION CARD THAT WOULD HAVE OTHE RWISE EXPIRED DURING A STATE 31 
OF EMERGENCY DECLARE D BY THE GOVERNOR; OR 32  4 	SENATE BILL 218  
 
 
 
 6. ANY OTHER RESIDENT OF THE STATE WHO MEETS 1 
ANY REQUIREMENTS APP ROVED BY THE ADMINISTRATION . 2 
 
 (III) THE ADMINISTRATION SHALL ADOPT REGULATIONS TO 3 
CARRY OUT THIS PARAGRAPH . 4 
 
 (5) An identification card may be renewed on application and payment of 5 
the fee required by this section. 6

 (a) (1) Subject to paragraph (5) of this subsection, a license issued under this 8 
title to a driver at least 21 years old shall expire on the birth date of the licensee at the end 9 
of a period of not more than 8 years determined in regulations adopted by the 10 
Administration following the issuance of the license. 11 
 
 (L) (1) NOTWITHSTANDING ANY OTHER PROVISION OF THIS SECTION , 12 
THE ADMINISTRATION MAY ISSUE A TEMPORAR Y RENEWAL FOR A DRIVER’S LICENSE 13 
THAT EXTENDS THE EXP IRATION DATE FOR A P ERIOD NOT EXCEEDING 2 YEARS FOR 14 
AN APPLICANT WHO: 15 
 
 (I) HAS THE DOCUMENTATION REQUIRED BY FEDERAL LAW , AS 16 
ENUMERATED IN § 16–103.1(10) AND (11) OF THIS SUBTITLE , ON FILE WITH THE 17 
ADMINISTRATION ; 18 
 
 (II) HAS A PHOTOGRAPH ON FILE WITH THE ADMINISTRATION 19 
THAT WILL NOT BE 16 YEARS OLD OR OLDER BY THE EXPIRATION DA TE OF THE 20 
TEMPORARY RENEWAL ; AND 21 
 
 (III) HAS A DRIVER’S LICENSE THAT WAS I SSUED FOR THE FULL 22 
TERM UNDER SUBSECTION (A)(1) OF THIS SECTION. 23 
 
 (2) THE ADMINISTRATION MAY MA KE TEMPORARY RENEWAL OF A 24 
DRIVER’S LICENSE AVAILABLE TO: 25 
 
 (I) AN ACTIVE DUTY MEMBER O F THE ARMED FORCES O F THE 26 
UNITED STATES OR A SPOUSE OR DEPENDENT OF THE MEM BER; 27 
 
 (II) A MEMBER OF THE FOREIGN SERVICE OF THE UNITED 28 
STATES OR A SPOUSE OR DEPENDENT OF THE MEM BER; 29 
 
 (III) A RESIDENT OF THE STATE WHO IS A STUDEN T STUDYING 30 
OUTSIDE THE STATE; 31   	SENATE BILL 218 	5 
 
 
 
 (IV) A RESIDENT OF THE STATE WHO IS TEMPORAR ILY RESIDING 1 
OUTSIDE THE STATE FOR AT LEAST 6 MONTHS; 2 
 
 (V) A RESIDENT OF THE STATE WHO HOLDS A DRI VER’S 3 
LICENSE THAT WOULD H AVE OTHERWISE EXPIRED DURING A STA TE OF EMERGENCY 4 
DECLARED BY THE GOVERNOR; OR 5 
 
 (VI) ANY OTHER RESIDENT OF TH E STATE WHO MEETS ANY 6 
REQUIREMENTS APPROVE D BY THE ADMINISTRATION . 7 
 
 (3) THE ADMINISTRATION MAY NO T ISSUE A TEMPORARY RENEWAL 8 
TO AN APPLICANT WHO HOLDS A COMMERCIAL D RIVER’S LICENSE. 9 
 
 (4) THE ADMINISTRATION SHALL ADOPT REGULATIONS TO CARRY 10 
OUT THIS SUBSECTION. 11 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 12 
October 1, 2022. 13
