AN ACT concerning 1 
 
Land Use – Agritourism – Definition 2 
 
FOR the purpose of altering the definition of “agritourism” to include camping and 3 
incidental outdoor stays for the purpose of a certain provision of law authorizing a 4 
local jurisdiction to adopt the definition of “agritourism”; and generally relating to 5 
agritourism. 6 
 
BY repealing and reenacting, with amendments, 7 
 Article – Land Use 8 
Section 4–212 9 
 Annotated Code of Maryland 10 
 (2012 Volume and 2021 Supplement) 11 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13 
 
Article – Land Use 14 
 
4–212.  15 
 
 (a) (1) In this section, “agritourism” means an activity conducted on a farm 16 
that is offered to a member of the general public or to invited guests for the purpose of 17 
education, recreation, or active involvement in the farm operation. 18 
 
 (2) “Agritourism” includes: 19  2 	SENATE BILL 296  
 
 
 
 (i) farm tours; 1 
 
 (ii) hayrides; 2 
 
 (iii) corn mazes; 3 
 
 (iv) seasonal petting farms; 4 
 
 (v) farm museums; 5 
 
 (vi) guest farms; 6 
 
 (vii) pumpkin patches; 7 
 
 (viii) “pick your own” or “cut your own” produce; 8 
 
 (IX) CAMPING; 9 
 
 (X) INCIDENTAL OUTDOOR S TAYS; 10 
 
 [(ix)] (XI) classes related to agricultural products or skills; and 11 
 
 [(x)] (XII) picnic and party facilities offered in conjunction with any 12 
agritourism activity. 13 
 
 (b) A local jurisdiction may adopt the definition of “agritourism” as defined in this 14 
section by local ordinance, resolution, law, or rule. 15 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 16 
October 1, 2022.  17
