A BILL ENTITLED 
 
AN ACT concerning 1 
 
Maryland Recycling Act – Recyclable Materials and Solid Waste Stream 2 
 – Alteration 3 
 
FOR the purpose of altering the definitions of “recyclable materials” and “solid waste 4 
stream” under the Maryland Recycling Act to include construction and demolition 5 
debris; and generally relating to the Maryland Recycling Act. 6

 SECTION 1. BE IT ENACTED BY THE GENERAL ASS EMBLY OF MARYLAND, 17 
That the Laws of Maryland read as follows: 18 
 
Article – Environment 19 
 
9–1701. 20 
 
 (a) In this subtitle the following words have the meanings indicated. 21 
 
 (p) (1) “Recyclable materials” means those materials that: 22 
 
 (i) Would otherwise become solid waste for disposal in a refuse 23  2 	SENATE BILL 490  
 
 
disposal system; and 1 
 
 (ii) May be collected, separated, composted, or processed and 2 
returned to the marketplace in the form of raw materials or products. 3 
 
 (2) “RECYCLABLE MATERIALS ” INCLUDES CONSTRUCTION AND 4 
DEMOLITION DEBRIS , SUCH AS RUBBLE , SCRAP MATERIAL , AND LAND CLEARING 5 
DEBRIS. 6 
 
 (3) “Recyclable materials” does not include incinerator ash. 7 
 
 (s) (1) “Solid waste stream” means garbage or refuse that would, unless 8 
recycled, be disposed of in a refuse disposal system. 9 
 
 (2) “Solid waste stream” includes [organic]: 10 
 
 (I) ORGANIC material capable of being composted that is not 11 
composted in accordance with regulations adopted under § 9–1725(b) of this subtitle; AND 12 
 
 (II) CONSTRUCTION AND DEMOLITION DEBRIS , SUCH AS 13 
RUBBLE, SCRAP MATERIAL , AND LAND CLEARING DE BRIS. 14 
 
 (3) “Solid waste stream” does not include: 15 
 
 (i) Hospital waste; 16 
 
 [(ii) Rubble; 17 
 
 (iii) Scrap material; 18 
 
 (iv) Land clearing debris;] 19 
 
 [(v)] (II) Sewage sludge; or 20 
 
 [(vi)] (III) Waste generated by a single individual or business and 21 
disposed of in a facility dedicated solely for that entity’s waste. 22 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 23 
October 1, 2022. 24
