A BILL ENTITLED 
 
AN ACT concerning 1 
 
Baltimore City – Use of Highway User Revenues for Traffic Functions and 2 
Enforcement – Modification 3 
 
FOR the purpose of altering a certain limitation applicable to Baltimore City relating to 4 
the use of highway user revenues to pay or finance costs incurred for carrying out 5 
traffic functions and enforcing traffic laws; and generally relating to highway user 6 
revenues distributed to Baltimore City. 7 
 
BY repealing and reenacting, with amendments, 8 
 Article – Transportation 9 
Section 8–408(a) 10 
 Annotated Code of Maryland 11 
 (2020 Replacement Volume and 2021 Supplement) 12 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 
That the Laws of Maryland read as follows: 14 
 
Article – Transportation 15 
 
8–408. 16 
 
 (a) Highway user revenues distributed to Baltimore City and Kent County may 17 
be used only to pay or finance: 18 
 
 (1) Costs incurred in the construction, reconstruction, or maintenance of 19 
its highways and streets; 20 
 
 (2) (I) [Costs] AS TO BALTIMORE CITY, COSTS incurred [by its police 21 
department] for carrying out traffic functions and enforcing the traffic laws; AND 22

 (II) AS TO KENT COUNTY, COSTS INCURRED BY IT S POLICE 1 
DEPARTMENT FOR CARRY ING OUT TRAFFIC FUNC TIONS AND ENFORCING THE 2 
TRAFFIC LAWS; 3 
 
 (3) Costs incurred in its other highway related activities for: 4 
 
 (i) Lighting the highways; 5 
 
 (ii) Stormwater drainage of the highways; and 6 
 
 (iii) Street cleaning, but not including the cost of collection of 7 
garbage, trash, and refuse; 8 
 
 (4) The payment of its debt service on bonds or other evidences of obligation 9 
for: 10 
 
 (i) The construction, reconstruction, or maintenance of its highways 11 
and streets; and 12 
 
 (ii) Any other of its highway activities, including lighting the 13 
highways and providing stormwater drainage; 14 
 
 (5) The cost of transportation facilities, as defined in § 3–101 of this article; 15 
or 16 
 
 (6) As to Kent County: 17 
 
 (i) The cost of maintaining county owned boat landings; and 18 
 
 (ii) Costs incurred in providing traffic crossing guards. 19 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 20 
1, 2022. 21
