Baltimore City – Use of Highway User Revenues for Traffic Functions and 2
Enforcement – Modification 3
FOR the purpose of altering a certain limitation applicable to Baltimore City relating to 4
the use of highway user revenues to pay or finance costs incurred for carrying out 5
traffic functions and enforcing traffic laws; and generally relating to highway user 6
revenues distributed to Baltimore City. 7
BY repealing and reenacting, with amendments, 8

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14
Article – Transportation 15
8–408. 16
(a) Highway user revenues distributed to Baltimore City and Kent County may 17
be used only to pay or finance: 18

(1) Costs incurred in the construction, reconstruction, or maintenance of 1
its highways and streets; 2
(2) (I) [Costs] AS TO BALTIMORE CITY, COSTS incurred [by its police 3
department] for carrying out traffic functions and enforcing the traffic laws; AND 4
(II) AS TO KENT COUNTY, COSTS INCURRED BY IT S POLICE 5
DEPARTMENT FOR CARRY ING OUT TRAFFIC FUNC TIONS AND ENFORCING THE 6
TRAFFIC LAWS; 7
(3) Costs incurred in its other highway related activities for: 8
(i) Lighting the highways; 9
(ii) Stormwater drainage of the highways; and 10
(iii) Street cleaning, but not including the cost of collection of 11
garbage, trash, and refuse; 12
(4) The payment of its debt service on bonds or other evidences of obligation 13
for: 14
(i) The construction, reconstruction, or maintenance of its highways 15
and streets; and 16
(ii) Any other of its highway activities, including lighting the 17
highways and providing stormwater drainage; 18
(5) The cost of transportation facilities, as defined in § 3–101 of this article; 19
or 20
(6) As to Kent County: 21
(i) The cost of maintaining county owned boat landings; and 22
(ii) Costs incurred in providing traffic crossing guards. 23
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 24
1, 2022. 25
