AN ACT concerning 1 
 
Health Occupations Boards – Investigations – Right to Counsel 2 
 
FOR the purpose of authorizing a licensee or certificate holder to be represented by counsel 3 
during an investigation by a health occupations board that may result in charges or 4 
sanctions; and generally relating to investigations by health occupations boards and 5 
the right to counsel. 6

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13 
 
Article – Health Occupations 14 
 
1–610. 15 
 
 IF A HEALTH OCCUPATIONS BOARD INVESTIGATES A LICENSEE OR 16 
CERTIFICATE HOLDER AND THE INVESTIGATIO N MAY RESULT IN CHARGES OR 17 
SANCTIONS AGAINST TH E LICENSEE OR CERTIF ICATE HOLDER , THE LICENSEE OR 18 
CERTIFICATE HOLDER MAY: 19 
 
 (1) BE REPRESENTED BY COU NSEL DURING THE INVESTIGATION ; 20 
AND 21 
 
 (2) HAVE COUNSEL PRESENT AT ANY INTERVIEW OF THE LICENSEE 22  2 	SENATE BILL 77  
 
 
OR CERTIFICATE HOLDE R CONDUCTED BY OR ON BEHALF OF THE HEALTH 1 
OCCUPATIONS BOARD DU RING THE INVESTIGATION . 2 
 
 SECTION 2. AND BE IT FURTHER ENA CTED, That this Act shall take effect 3 
October 1, 2022. 4
