CHAPTER ______ AN ACT concerning 1 Higher Education – Senatorial and Delegate Scholarships – Program 2 Accreditation 3 FOR the purpose of authorizing each Senator to award not more than a certain percentage 4 of funds available under the Senatorial Scholarship Program, and authorizing 5 Delegates to award Delegate Scholarships, to applicants planning to attend certain 6 accredited institutions outside the State, provided that the applicant will be studying 7 in an academic area that is not offered in a program that is accredited by a national 8 accrediting association approved by the United States Department of Education in 9 any institution in the State; and generally relating to the Senatorial and Delegate 10 Scholarship Program Programs. 11 BY repealing and reenacting, with amendments, 12 Article – Education 13 Section 18–405 and 18–501 14 2 SENATE BILL 79 Annotated Code of Maryland 1 (2018 Replacement Volume and 2021 Supplement) 2 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 3 That the Laws of Maryland read as follows: 4 Article – Education 5 18–405. 6 (a) Except as provided in subsection (d) of this section, a senatorial scholarship 7 may be used only at any community college or undergraduate, graduate, or professional 8 school in the State. 9 (b) A senatorial scholarship may be used: 10 (1) If the curriculum is approved by the Commission, at a degree granting 11 institution of higher education, a hospital diploma school for training registered nurses, or 12 to attend a private postsecondary proprietary institution that is accredited by a national 13 accrediting association approved by the United States Department of Education as a 14 full–time student; and 15 (2) For educational expenses as defined by the Office, including: 16 (i) Tuition and mandatory fees; and 17 (ii) Room and board. 18 (c) If on–campus housing is available, a senatorial scholarship may not be used 19 to pay for off–campus housing. 20 (d) Each Senator may award not more than [10 percent] 10% of the funds 21 available under this subtitle to applicants planning to attend accredited undergraduate, 22 graduate, or professional institutions outside the State, provided the applicant: 23 (1) Will be studying in an academic area that is not [available] OFFERED 24 IN A PROGRAM THAT IS ACCREDITED BY A NATI ONAL ACCREDITING ASS OCIATION 25 APPROVED BY THE UNITED STATES DEPARTMENT OF EDUCATION IN ANY 26 INSTITUTION in the State; 27 (2) Is a hearing impaired person who will be studying at an institution 28 outside the State that makes special provisions for hearing impaired students, and 29 comparable special provisions are not available to the applicant at an institution in the 30 State; or 31 SENATE BILL 79 3 (3) Is an individual who is on active duty with the United States military 1 who is domiciled in this State. 2 18–501. 3 (a) There is a program of Delegate Scholarships in this State that are awarded 4 under this subtitle. 5 (b) A scholarship awarded under this subtitle may be used at: 6 (1) An eligible institution for a program of undergraduate, graduate, or 7 professional studies; 8 (2) An accredited undergraduate, graduate, or professional institution 9 outside the State, if the applicant: 10 (i) Will be studying in an academic area that is not [available] 11 OFFERED IN A PROGRAM THAT IS ACCREDITED B Y A NATIONAL ACCREDI TING 12 ASSOCIATION APPROVED BY THE UNITED STATES DEPARTMENT OF EDUCATION IN 13 ANY INSTITUTION in this State; 14 (ii) Is disabled and will be studying at an institution outside the State 15 that makes special provisions for disabled students that are not available to the applicant 16 at an institution in the State; or 17 (iii) Is an individual who is on active duty with the United States 18 military who is domiciled in this State; and 19 (3) A private career school within the State that is approved by the 20 Maryland Higher Education Commission under § 11 –202 of this article and that is 21 accredited by a national accrediting association that is approved by the United States 22 Department of Education. 23 (c) Money appropriated to the Commission for scholarships awarded under this 24 section that is not used by the end of the fiscal year shall be retained by the Commission for 25 use by the awarding Delegate in the Delegate Scholarship Program during subsequent fiscal 26 years. 27 SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency 28 measure, is necessary for the immediate preservation of the public health or safety, has 29 been passed by a yea and nay vote supported by three–fifths of all the members elected to 30 each of the two Houses of the General Assembly, and shall take effect from the date it is 31 enacted. 32
