Strike out indicates matter stricken from the bill by amendment or deleted from the law by amendment. *sb0801* SENATE BILL 801 P6, P4 2lr1272 By: Senator Guzzone Introduced and read first time: February 7, 2022 Assigned to: Budget and Taxation Committee Report: Favorable with amendments Senate action: Adopted Read second time: March 3, 2022 CHAPTER ______ AN ACT concerning 1 State Health Plan – Chesapeake Bay Commission – Retirees 2 FOR the purpose of including employment with the Chesapeake Bay Commission as 3 eligible for participation as a retiree in the State Employee and Retiree Health and 4 Welfare Benefits Program; authorizing the State to charge the Commission for the 5 participation in the Program by active employees; providing the subsidy for 6 employees and retirees of the Commission shall be the same subsidy provided for 7 active and retired State employees; prohibiting the State from charging the 8 Commission for certain costs for retired participants in the Program; and generally 9 relating to participation in the State Employee and Retiree Health and Welfare 10 Benefits Program. 11 BY repealing and reenacting, with amendments, 12 Article – State Personnel and Pensions 13 Section 2–511 14 Annotated Code of Maryland 15 (2015 Replacement Volume and 2021 Supplement) 16 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17 That the Laws of Maryland read as follows: 18 Article – State Personnel and Pensions 19 2–511. 20 2 SENATE BILL 801 (a) This section applies to employees of: 1 (1) the Maryland Environmental Service; 2 (2) the Northeast Maryland Waste Disposal Authority; 3 (3) the Baltimore Metropolitan Council; 4 (4) the Maryland Automobile Insurance Fund; [and] 5 (5) the City of Hyattsville; AND 6 (6) THE CHESAPEAKE BAY COMMISSION. 7 (b) Subject to the regulations adopted under § 2–503 of this subtitle, an employee 8 or, while receiving an allowance under the Employees’ Retirement System of the State of 9 Maryland or the Employees’ Pension System of the State of Maryland, an employee’s 10 surviving spouse: 11 (1) may enroll and participate in the health insurance or other benefit 12 options established under the Program; and 13 (2) except as provided in subsection (d) of this section, is subject to the same 14 terms and conditions as those provided under § 2–507 of this subtitle. 15 (c) While receiving an allowance under the Employees’ Retirement System of the 16 State of Maryland or the Employees’ Pension System of the State of Maryland, a former 17 employee or a former employee’s surviving spouse or dependent child: 18 (1) may enroll and participate in the health insurance benefit options 19 established under the Program; and 20 (2) except as provided in subsection (d) of this section, is subject to the same 21 terms and conditions as those provided under § 2–508 of this subtitle, with the employee’s 22 service with the Maryland Environmental Service, Northeast Maryland Waste Disposal 23 Authority, the Baltimore Metropolitan Council, the Maryland Automobile Insurance Fund, 24 [and] the City of Hyattsville, AND THE CHESAPEAKE BAY COMMISSION being included 25 as part of the employee’s State service. 26 (d) (1) (i) The State may charge the Maryland Environmental Service, the 27 Northeast Maryland Waste Disposal Authority, the Baltimore Metropolitan Council, THE 28 CHESAPEAKE BAY COMMISSION, and the Maryland Automobile Insurance Fund, or any 29 successor agency, the respective participant’s total cost resulting from participation in the 30 Program under this section. 31 SENATE BILL 801 3 (ii) The respective employer share of the cost of the Program under 1 this paragraph shall be based on the State subsidy allowed under this subtitle. 2 (2) (i) The State may charge the City of Hyattsville the participant’s 3 total cost resulting from participation in the Program under this section. 4 (ii) The City of Hyattsville shall determine the extent to which the 5 City will subsidize participation in the Program. 6 (3) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH (III) OF THIS 7 PARAGRAPH , THE STATE MAY CHARGE THE CHESAPEAKE BAY COMMISSION THE 8 RESPECTIVE PARTICIPA NT’S TOTAL COST RESULTI NG FROM PARTICIPATIO N IN THE 9 PROGRAM UNDER THIS SE CTION. 10 (II) THE RESPECTIVE EMPLOYER SHARE OF TH E COST OF THE 11 PROGRAM UNDER THIS PA RAGRAPH SHALL BE BAS ED ON THE STATE SUBSIDY 12 ALLOWED UNDER THIS S UBTITLE. 13 (III) THE STATE MAY NOT CHARGE THE CHESAPEAKE BAY 14 COMMISSION FOR ANY CO STS RESULTING FROM T HE PARTICIPATION OF A RETIREE 15 OR THE RETIREE’S SURVIVING SPOUSE O R DEPENDENT CHILD IN THE PROGRAM 16 UNDER SUBSECTION (C) OF THIS SECTION. 17 SECTION 2.
