AN ACT concerning 1 
 
Family Investment Program – Eligibility, Work Experience, Community Service, 2 
and Reports – Alterations 3 
 
FOR the purpose of altering the manner in which certain work activities may be reported 4 
for determining a certain work participation rate in the Family Investment Program; 5 
altering the manner in which the Department of Human Services may require an 6 
individual in the Program to verify the hours that the individual participated in 7 
certain work activities; establishing a limit on the number of hours the Department 8 
may require an individual in the Program to participate in certain work activities; 9 
establishing the manner in which an individual in the Program may participate in 10 
certain work experience or community service work activities; and generally relating 11 
to the Family Investment Program.  12

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 
That the Laws of Maryland read as follows: 2 
 
Article – Human Services 3 
 
5–101. 4 
 
 (a) In this title the following words have the meanings indicated. 5 
 
 (c) “Department” means the Department of Human Services. 6 
 
5–301. 7 
 
 (a) In this subtitle the following words have the meanings indicated. 8 
 
 (b) “COMMUNITY SERVICE ” MEANS A STRUCTURED P ROGRAM WITH 9 
EMBEDDED ACTIVITIES IN WHICH INDIVIDUALS PERFORM UNPAID WORK: 10 
 
 (1) FOR THE DIRECT BENEF IT OF THE COMMUNITY ; AND 11 
 
 (2) UNDER THE GUIDANCE A ND SUPPORT OF A PUBL IC OR NONPROFIT 12 
ORGANIZATION .  13 
 
 (C) “FIP” means the Family Investment Program. 14 
 
 [(c)] (D) “Nonprofit organization” means a religious, charitable, or volunteer 15 
organization that is exempt from taxation under § 501(c) of the Internal Revenue Code. 16 
 
 [(d)] (E) “Recipient” means each individual in a FIP case. 17 
 
 [(e)] (F) “Temporary cash assistance” means the cash assistance component of 18 
the FIP that is funded wholly or partly through Title IV, Part A, of the Social Security Act. 19 
 
 [(f)] (G) “Third party payee” means: 20 
 
 (1) an individual that the Department approves; 21 
 
 (2) a nonprofit organization; 22 
 
 (3) a for–profit organization; or 23 
 
 (4) a governmental unit, including a local department. 24 
 
 [(g)] (H) “Transitional assistance” means assistance provided to a recipient 25 
whose temporary cash assistance has been terminated for noncompliance with FIP 26

 [(h)] (I) “Work activity” means: 1 
 
 (1) job search activity; 2 
 
 (2) subsidized employment in either the public or private sector; 3 
 
 (3) work experience; 4 
 
 (4) on–the–job training; 5 
 
 (5) community service; 6 
 
 (6) training directly related to employment; or 7 
 
 (7) education directly related to employment. 8 
 
 (J) “WORK EXPERIENCE ” MEANS UNPAID WORK AC TIVITY, PERFORMED IN 9 
RETURN FOR TEMPORARY CASH ASSISTANCE , THAT PROVIDES AN IND IVIDUAL WITH 10 
AN OPPORTUNITY TO AC QUIRE THE GENERAL SK ILLS, KNOWLEDGE , AND WORK 11 
HABITS NECESSARY TO OBTAIN EMPLOYME NT.  12

 (a) (1) (i) In this subsection the following words have the meanings 14 
indicated. 15 
 
 (ii) “Target work rate” means the rate established for the State by 16 
the U.S. Department of Health and Human Services based on the State’s caseload reduction 17 
credit under the federal Temporary Assistance for Needy Families program, 42 U.S.C.  18 
22–601 et seq. 19 
 
 (iii) “Work participation rate” means the federal work participation 20 
rate established by the U.S. Department of Health and Human Services under the federal 21 
Temporary Assistance for Needy Families program, 42 U.S.C. 22–601 et seq. 22 
 
 (2) A family may be eligible for assistance under this subtitle only if the 23 
family includes: 24 
 
 (i) a minor child who resides with a custodial parent or other adult 25 
caretaker who is a relative of the child; or 26 
 
 (ii) a pregnant individual. 27 
 
 (3) Assistance shall be provided to an applicant or recipient under this 28 
subtitle only if the applicant or recipient: 29

 (i) resides in the State at the time of application for assistance; 1 
 
 (ii) if applicable: 2 
 
 1. has applied for child support services with the appropriate 3 
local child support enforcement office at the time of application for assistance; and 4 
 
 2. complies with the requirements of the local child support 5 
enforcement office; 6 
 
 (iii) [has engaged in job search activities as requested by the 7 
Department; 8 
 
 (iv)] participates in work activity under this subtitle; and 9 
 
 [(v)] (IV) meets all other FIP requirements that the Secretary 10 
establishes by regulation. 11 
 
 (4) Subject to paragraph (5) of this subsection, the Department shall allow 12 
an applicant or a recipient to meet the work activity requirement for a maximum of 24 13 
months by engaging in: 14 
 
 (i) a minimum of 20 hours per week of vocational education that 15 
leads to an associate degree, a diploma, or a certificate; or 16 
 
 (ii) an average of at least 20 hours per week of education directly 17 
related to employment, which may include: 18 
 
 1. an adult basic education program; 19 
 
 2. an English as a second language program; or 20 
 
 3. a GED program. 21 
 
 (5) (I) 1. FOR PURPOSES OF REPOR	TING THE WORK 22 
PARTICIPATION RATE , THE STATE SHALL REPORT ON LY THE WORK ACTIVITI ES IN 23 
WHICH AN INDIVIDUAL IS ENGAGED IN WORK .  24 
 
 2. AN INDIVIDUAL SHALL B E CONSIDERED ENGAGED IN 25 
WORK IF THE INDIVIDU AL PARTICIPATES IN A NY OF THE FOLLOWING WORK 26 
ACTIVITIES: 27 
 
 A. SATISFACTORY ATTENDA NCE AT A SECONDARY 28 
SCHOOL OR IN A COURS E OF STUDY LEADING T O A HIGH SCHOOL EQUI VALENCY 29 
CREDENTIAL;  30

 B. ON–THE–JOB TRAINING; 1 
 
 C. SUBSIDIZED EMPLOYMEN T IN EITHER THE PUBL IC OR 2 
PRIVATE SECTOR ; OR 3 
 
 D. UNSUBSIDIZED EMPLOYM ENT.  4 
 
 3. THE DEPARTMENT MAY NOT REQUIRE AN 5 
INDIVIDUAL TO VERIFY THE HOURS OF PARTICI PATION IN WORK ACTIV ITY THAT IS 6 
NOT CONSIDERED BEING ENGAGED IN WORK . 7 
 
 (II) If the work participation rate does not exceed the target work 8 
rate by AT LEAST 10% in any month, the Department, after providing at least 30 days prior 9 
notice to the Senate Finance Committee and the House Appropriations Committee, may, 10 
UNTIL THE WORK PARTI CIPATION RATE EXCEED S THE TARGET WORK RA TE BY AT 11 
LEAST 10% FOR 3 CONSECUTIVE MONTHS , suspend the application of: 12 
 
 1. paragraph (4) of this subsection to new applicants [until 13 
the work participation rate exceeds the target work rate by 10% for 3 consecutive months]; 14 
OR 15 
 
 2. SUBPARAGRAPH (I) OF THIS PARAGRAPH . 16 
 
 (III) 1. SUBJECT TO SUBSUBPARA GRAPHS 2 AND 3 OF THIS 17 
SUBPARAGRAPH , TO VERIFY SUBSIDIZED AND UNSUBSIDIZED EMP LOYMENT AND 18 
ON–THE–JOB TRAINING FOR PUR POSES OF THE WORK PA RTICIPATION RATE , THE 19 
DEPARTMENT SHALL VERI FY AN INDIVIDUAL ’S EMPLOYMENT ON COMM ENCEMENT 20 
OF THE WORK ACTIVITY AND USE THE ACTUAL H OURS OF EMPLOY MENT 21 
PARTICIPATION TO PRO JECT THE HOURS OF EM PLOYMENT PARTICIPATI ON FOR A 22 
MAXIMUM PERIOD OF 6 MONTHS. 23 
 
 2. NOT LATER THAN AT THE END OF A 6–MONTH PERIOD 24 
OR AT THE TIME THE DEPARTMENT RECEIVES I NFORMATION THAT AN I NDIVIDUAL’S 25 
ACTUAL HOURS OF EMPL OYMENT PARTICIPATION HAVE CHANGED , WHICHEVER IS 26 
SOONER, THE DEPARTMENT SHALL VERI FY THE INDIVIDUAL ’S CURRENT, ACTUAL 27 
AVERAGE HOURS OF EMPL OYMENT PARTICIPATION TO PROJECT THE HOURS OF 28 
EMPLOYMENT PARTICIPA TION FOR UP TO AN AD DITIONAL 6 MONTHS.  29 
 
 3. THE DEPARTMENT MAY NOT RE	QUIRE AN 30 
INDIVIDUAL TO VERIFY ACTUAL HOURS OF EMPL OYMENT PARTICIPATION AT A 31 
FREQUENCY OTHER THAN THAT REQUIRED UNDER T HIS SUBPARAGRAPH .  32

 (6) THE DEPARTMENT MAY REQUIR E A WORK–ELIGIBLE INDIVIDUAL 1 
TO PARTICIPATE IN WO RK ACTIVITY FOR A MA XIMUM OF: 2 
 
 (I) 30 HOURS PER WEEK FOR A N INDIVIDUAL WITH A CHILD AT 3 
LEAST 6 YEARS OLD; 4 
 
 (II) 20 HOURS PER WEEK FOR A SINGLE PARENT OR CARETAKER 5 
RELATIVE WITH A CHIL D UNDER THE AGE OF 6 YEARS; 6 
 
 (III) A COMBINED AVERAGE O F 35 HOURS PER WEEK FOR A 7 
FAMILY WITH TWO WORK –ELIGIBLE PARENTS WHO DO NOT RECEIVE FEDER ALLY 8 
FUNDED CHILD CARE AS SISTANCE; OR 9 
 
 (IV) A COMBINED AVERAGE OF 55 HOURS PER WEEK FOR A 10 
FAMILY WITH TWO WORK –ELIGIBLE PARENTS WHO RECEIVE FEDERALLY FU NDED 11 
CHILD CARE ASSISTANC E, PROVIDED THAT AN ADU LT IN THE FAMILY DOE S NOT 12 
HAVE A DISABILITY OR IS NOT CARING FOR A CHILD WITH A DISABIL ITY. 13 
 
 (7) (I) A WORK–ELIGIBLE INDIVIDUAL MAY CHOOSE TO 14 
PARTICIPATE IN WORK ACTIVITY FOR MORE TH AN THE REQUIRED WEEK LY HOURS 15 
UNDER PARAGRAPH (6) OF THIS SUBSECTION , UP TO A MAXIMUM OF 40 HOURS PER 16 
WEEK, PROVIDED THAT WORKIN G THE ADDITIONAL HOU RS DOES NOT VIOLATE THE 17 
FEDERAL FAIR LABOR STANDARDS ACT.  18 
 
 (II) THE DEPARTMENT MAY NOT RE DUCE THE TEMPORARY 19 
CASH ASSISTANCE OF A N INDIVIDUAL, AS PROVIDED IN § 5–312(E)(1)(I) OF THIS 20 
SUBTITLE, IF THE INDIVIDUAL IS MEETING THE DEPARTMENT ’S MINIMUM WORK 21 
ACTIVITY PARTICIPATI ON REQUIREMENT A ND PARTICIPATING IN WORK ACTIVITY 22 
FOR LESS THAN 40 HOURS PER WEEK .  23 
 
 (8) THE DEPARTMENT SHALL ACCE PT VERIFICATION OF A N 24 
INDIVIDUAL’S WORK ACTIVITY PART ICIPATION THROUGH MU LTIPLE METHODS , 25 
INCLUDING ELECTRONIC SUBMISSION.  26 
 
 (b) (1) An individual may not be required to meet the work activity 27 
requirement under subsection [(a)(2)(iv)] (A)(3)(III) of this section if the individual is 28 
exempt under criteria the Secretary establishes. 29 
 
 (2) The criteria shall include exemptions for: 30 
 
 (i) SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , adults 31 
who are required to care for a child who is a recipient under the age of 1 year; [and] 32

 (ii) subject to paragraph [(3)] (4) of this subsection, adults and 1 
children who are recipients and who are severely disabled; AND 2 
 
 (III) ADULTS WHO HAVE NOT RECEIVED ASSISTANCE FOR AT 3 
LEAST 12 MONTHS. 4 
 
 (3) AN EXEMPTION BASED ON AN ADULT’S REQUIREMENT TO CAR E 5 
FOR A CHILD WHO IS A RECIPIENT UNDER THE AGE OF 1 YEAR MAY NOT BE 6 
RESTRICTED TO A MAXI MUM NUMBER OF MONTH S IN THE ADULT’S LIFETIME.  7 
 
 (4) An individual’s exemption because of severe disability is limited to 12 8 
months unless: 9 
 
 (i) the individual applies for Supplemental Security Income; and 10 
 
 (ii) the application is approved, pending, or on appeal. 11 
 
 [(4)] (5) Assistance for an individual who qualifies for an exemption 12 
under this subsection but who voluntarily participates in a work activity may not be 13 
reduced or terminated as a result of the participation in the work activity. 14 
 
 (c) (1) Assistance for an individual may not be reduced or terminated for 15 
noncompliance with the work activity requirement if the individual has good cause under 16 
the criteria established by the Secretary. 17 
 
 (2) The criteria shall provide that any of the following are sufficient to show 18 
good cause: 19 
 
 (i) temporary illness or incapacity; 20 
 
 (ii) court–required appearances or temporary incarceration; 21 
 
 (iii) domestic violence; 22 
 
 (iv) a family crisis that threatens normal family functioning, 23 
including: 24 
 
 1. experiencing homelessness whereby a family: 25 
 
 A. lacks a fixed, regular, and adequate nighttime residence, 26 
or shares the housing of other persons due to the loss of housing, economic hardship, or a 27 
similar reason; 28 
 
 B. lives in a motel, hotel, trailer park, or camping ground due 29 
to a lack of alternative accommodations; 30

 C. lives in an emergency shelter or transitional housing; 1 
 
 D. resides in a primary nighttime residence that is a public 2 
or private place not designed for or ordinarily used as a regular sleeping accommodation 3 
for human beings; or 4 
 
 E. lives in a car park, public space, vacant or abandoned 5 
building, substandard housing, bus station, train station, or similar setting; 6 
 
 2. a housing crisis, including eviction, foreclosure, or other 7 
loss of housing; or 8 
 
 3. receiving a utility disconnection notice or having a utility 9 
disconnected; 10 
 
 (v) a breakdown in transportation arrangements; 11 
 
 (vi) a breakdown in child care arrangements or lack of child care for 12 
a child or children who are 12 years old or younger; 13 
 
 (vii) for a single parent caring for a child younger than 6 years old 14 
who is unable to obtain child care: 15 
 
 1. the unavailability of appropriate child care within a 16 
reasonable distance from the parent’s home or work site; 17 
 
 2. the unavailability or unsuitability of informal child care 18 
by a relative or others; or 19 
 
 3. the unavailability or unsuitability of appropriate and 20 
affordable child care arrangements; 21 
 
 (viii) a lack of supportive services identified and agreed on by an 22 
individual and a local department; or 23 
 
 (ix) the failure of a local department to offer or provide a reasonable 24 
accommodation to an individual with a disability. 25 
 
 (d) Subject to the State budget, a legal immigrant is entitled to assistance under 26 
this subtitle if the immigrant: 27 
 
 (1) meets FIP eligibility requirements under this subtitle and any other 28 
requirements imposed by the State; and 29 
 
 (2) (i) arrived in the United States before August 22, 1996; or 30

 (ii) arrived in the United States on or after August 22, 1996 and is 1 
not eligible for federally funded cash assistance. 2

 (1) PRIVATE SECTOR EMPLO YMENT IS NOT AVAILAB LE; 9 
 
 (2) THE MAXIMUM WORK EXP	ERIENCE PLACEMENT FO R THE 10 
INDIVIDUAL DOES NOT EXCEED 90 DAYS IN A 3–YEAR PERIOD; 11 
 
 (3) THE DEPARTMENT OFFERS THE INDIVIDUAL AT LEAST THREE 12 
WORK ACTIVITY OPTION S THAT INCLUDE : 13 
 
 (I) SUBJECT TO SUBSECTIO N (C) OF THIS SECTION , ONLY ONE 14 
WORK EXPERIENCE OPTI ON; AND 15 
 
 (II) AT LEAST ONE OPTION THAT IS WORK ACTIVIT Y OR A 16 
PROGRAM FUNDED BY TH E FEDERAL WORKFORCE INNOVATION AND OPPORTUNITY 17 
ACT;  18 
 
 (4) THE INDIVIDUAL CHOOS ES THE WORK EXPERIEN CE FOR WORK 19 
ACTIVITY; 20 
 
 (5) THE DEPARTMENT INFORMS TH E INDIVIDUAL THAT TH E 21 
INDIVIDUAL MA Y SUBSEQUENTLY CHANG E TO DIFFERENT WORK ACTIVITY; 22 
 
 (6) THE WORK EXPERIENCE PROVIDES SKILLS THAT MATCH THE 23 
INDIVIDUAL’S PERSONAL, CAREER, AND FAMILY GOALS TO SUPPORT ECONOMIC 24 
MOBILITY; AND 25 
 
 (7) THE WORK SITE MEETS THE REQUIREMENTS OF SUBSECTION (D) 26 
OF THIS SECTION. 27 
 
 (C) IF THE DEPARTMENT OFFERS WOR K EXPERIENCE AS WORK ACTIVITY, 28 
THE DEPARTMENT MAY NOT OF FER COMMUNITY SERVIC E AS WORK ACTIVITY .  29

 (D) (1) FOR A WORK SITE TO QU ALIFY AS AN APPROPRI ATE PLACEMENT 1 
FOR WORK EXPERIENCE UNDER THIS SECTION , THE WORK SITE MUST: 2 
 
 (I) BE SUPERVISED BY AN EMPLOYER, A WORK SITE SPONSOR , 3 
OR ANY OTHER RESPONS IBLE PARTY ON AN ONG OING BASIS AT LEAST ONCE EACH 4 
DAY IN WHICH THE IND IVIDUAL IS SCHEDULED TO PARTICIPATE IN TH E WORK 5 
EXPERIENCE; 6 
 
 (II) OFFER PARTICIPANTS M ARKETABLE SKILLS NECESSAR Y TO 7 
OBTAIN EMPLOYMENT IN LOCAL HIGH–GROWTH INDUSTRIES ID ENTIFIED IN THE 8 
STATE; AND 9 
 
 (III) BE LIMITED TO NOT MO RE THAN FIVE WORK EX PERIENCE 10 
PLACEMENTS AT ANY GI VEN TIME.  11 
 
 (2) SUBJECT TO SUBSECTION (E)(2) OF THIS SECTION , A WORK SITE 12 
SHALL BE DISQUALIFIE D FROM HAVING ANY IN DIVIDUALS IN WORK EX PERIENCE 13 
PLACEMENTS FOR A 5–YEAR PERIOD IF, IN A 1–YEAR PERIOD, THE WORK SITE DOES 14 
NOT HIRE THE GREATER OF: 15 
 
 (I) IF ONLY ONE INDIVIDU AL WAS PLACED IN THE WORK SITE 16 
FOR WORK EXPERIENCE , THE INDIVIDUAL; OR 17 
 
 (II) 50% OF INDIVIDUALS PLACE D IN THE WORK SITE F OR WORK 18 
EXPERIENCE. 19 
 
 (E) (1) IF AT ANY TIME THE RE QUIREMENTS OF SUBSEC TION (B) OF THIS 20 
SECTION ARE NOT MET , AN INDIVIDUAL PLACED IN WORK EXPERIENCE M AY 21 
REQUEST A TRANSFER T O DIFFERENT WORK ACT IVITY.  22 
 
 (2) AN INDIVIDUAL WHO TRA NSFERS FROM THE WORK SITE UNDER 23 
PARAGRAPH (1) OF THIS SUBSECTION MAY NOT BE C OUNTED FOR PURPOSES OF THE 24 
HIRING REQUIREMENT U NDER SUBSECTION (D)(2) OF THIS SECTION.  25

EMPLOYABILITY OF IND IVIDUALS WHO CANNOT FIND UNSUBSIDIZED FU LL–TIME 28

RECREATION , PUBLIC FACILITIES , PUBLIC SAFETY, AND CHILD CARE ; AND 4 
 
 (2) BE SUPERVISED ON AN ONGOING BASIS AT LEA ST ONCE EACH DAY 5 
IN WHICH THE INDIVID UAL IS SCHEDULED TO PARTICIPATE IN THE C OMMUNITY 6

 (C) THE DEPARTMENT MAY REFER AN INDIVIDUAL TO COM MUNITY 8

 (2) THE MAXIMUM COMMUNIT Y SERVICE PLACEMENT FOR THE 11 
INDIVIDUAL DOES NOT EXCEED 90 DAYS IN A 3–YEAR PERIOD; 12 
 
 (3) THE DEPARTMENT OFFERS TO THE INDIVIDUAL AT LE AST THREE 13 
WORK ACTIVITY OPTION S THAT SHALL INCLUDE: 14 
 
 (I) SUBJECT TO SUBSECTIO N (D) OF THIS SECTION , ONLY ONE 15

 (a) On or before October 1 each year, the Department shall report to the General 5 
Assembly, in accordance with § 2–1257 of the State Government Article, the following 6 
information: 7 
 
 (1)  for the preceding year: 8 
 
 [(1)] (I) the number of recipients who engaged in vocational education or 9 
education directly related to employment; 10 
 
 [(2)] (II) the number of recipients who completed vocational education or 11 
education directly related to employment; 12 
 
 [(3)] (III) the number of recipients who obtained or main tained 13 
employment for 6 months, 12 months, 18 months, and 24 months after completing 14 
vocational education or education directly related to employment; and 15 
 
 [(4)] (IV) the average earnings of recipients who obtained or maintained 16 
employment for 6 months, 12 months, 18 months, and 24 months after completing 17 
vocational education or education directly related to employment; AND 18 
 
 (2) FOR THE PRECEDING FI	SCAL YEAR , THE FOLLOWING 19 
INFORMATION ON WORK EXPERIENCE AND COMMU NITY SERVICE WORK AC TIVITY 20 
PLACEMENTS : 21 
 
 (I) INFORMATION ON THE W ORK SITES AND THE PU BLIC, 22

OF INDIVIDUALS IN WO RK EXPERIENCE WHO WE RE PROVIDED DIRECT E NTRY INTO 18 
A FULL–TIME JOB WITH A WAGE THAT: 19 
 
 1. EQUALS OR EXCEEDS THE STATE MINIMUM WAGE ; 20 
 
 2. EQUALS OR EXCEEDS 150% OF THE STATE MINIMUM 21 
WAGE; AND 22 
 
 3. EQUALS OR EXCEEDS 200% OF THE STATE MINIMUM 23 
WAGE. 24 
 
 (b) The information in the report required under subsection [(a)] (A)(1) of this 25 
section shall be broken down by the types of vocational education or education programs in 26 
which the recipients engaged, including: 27 
 
 (1) associate degree programs; 28 
 
 (2) vocational education programs that do not lead to an associate degree; 29 
 
 (3) postsecondary education programs that are not included in items (1) or 30

 (4) adult basic education programs; 1 
 
 (5) English as a second language programs; and 2 
 
 (6) GED programs. 3 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That th is Act shall take effect 4
