BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 That the Laws of Maryland read as follows: 16 Article – Education 17 3–5B–01. 18 2 SENATE BILL 952 (a) The Frederick County Board consists of eight members as follows: 1 (1) Seven members elected from the county at large; and 2 (2) One nonvoting student member. 3 (d) (1) The terms of voting members are staggered as provided in subsection 4 (c) of this section. 5 [(2) Subject to confirmation of the County Council, the County Executive 6 shall appoint a qualified individual to fill a vacancy on the county board for the remainder 7 of the term and until a successor is elected and qualifies.] 8 (2) IF THERE IS A VACANCY BY AN ELECTED MEMBER OF THE COUNTY 9 BOARD OCCURRING 30 DAYS OR LESS BEFORE THE CANDIDATE REGIST RATION 10 DEADLINE FOR THE NEX T PRIMARY ELECTION , THE COUNTY EXECUTIVE SHALL 11 APPOINT, SUBJECT TO CONFIRMAT ION OF THE COUNTY COUNCIL, A QUALIFIED 12 INDIVIDUAL TO FILL T HE VACANCY ON THE COUNT Y BOARD FOR THE REMA INDER 13 OF THAT TERM AND UNT IL A SUCCESSOR IS EL ECTED IN ACCORDANCE WITH 14 PARAGRAPH (4)(I) OF THIS SUBSECTION AND QUALIFIES. 15 (3) IF THERE IS A VACANCY BY AN ELECTED MEMBER OF THE COUNTY 16 BOARD OCCURRING MORE THAN 30 DAYS BEFORE THE CAND IDATE REGISTRATION 17 DEADLINE FOR THE NEX T PRIMARY ELECTION F OLLOWING THE VACATIN G 18 MEMBER’S ELECTION: 19 (I) THE COUNTY EXECUTIVE SHALL APPOI NT, SUBJECT TO 20 CONFIRMATION OF THE COUNTY COUNCIL, A QUALIFIED INDIVIDU AL TO 21 TEMPORARILY FILL THE VACANCY ON THE COUNT Y BOARD WHO SHALL SE RVE UNTIL 22 A QUALIFIED INDIVIDU AL IS ELECTED IN ACC ORDANCE WITH PARAGRA PH (4)(II) OF 23 THIS SUBSECTION ; AND 24 (II) THE INDIVIDUAL ELECTE D UNDER ITEM (I) OF THIS 25 PARAGRAPH SHALL SERV E FOR THE REMAINDER OF THAT TERM UNTIL A 26 SUCCESSOR IS ELECTED AND QUALIFIES. 27 (4) AT A GENERAL ELECTION , VACANCIES SHALL BE F ILLED AS 28 FOLLOWS: 29 (I) THE CANDIDATES WITH THE HIGHEST VOTE TOTALS SHALL 30 FIRST FILL ANY VACAN T POSITIONS FOR A FU LL TERM OF 4 YEARS; AND 31 (II) AFTER ALL VACANT POSI TIONS FOR A FULL TER M OF 4 32 YEARS ARE FILLED , THE CANDIDATE WITH T HE NEXT HIGHEST VOTE TOTAL SHALL 33 FILL THE POSITION FOR WHICH A SUCCESSO R WAS APPOINTED UNDE R PARAGRAPH 34 SENATE BILL 952 3 (3) OF THIS SUBSECTION A ND SERVE THE REMAIND ER OF THAT TERM . 1 (5) CANDIDATES FOR A VACA TED OFFICE MAY BE NO MINATED AT A 2 PRIMARY ELECTION IN THE SAME MANNER AS A NY OTHER POSITION ON THE COUNTY 3 BOARD. 4 SECTION 2.
