Harford County – Alcoholic Beverages – Performing Arts Theater License 2 
 
FOR the purpose of establishing in Harford County a performing arts theater beer and wine 3 
license that authorizes the holder to sell or serve beer and wine in certain performing 4 
arts theaters at retail for on–premises consumption; and generally relating to 5 
alcoholic beverages licenses in Harford County.  6

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 
That Section(s) 22–1005.2 of Article – Alcoholic Beverages of the Annotated Code of 2 
Maryland be renumbered to be Section(s) 22–1005.3. 3 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 4 
as follows: 5

 (A) IN THIS SECTION , “PERFORMING ARTS THEA TER” MEANS AN AREA , A 10 
BUILDING, OR A STRUCTURE DESIG NED AND USED FOR PLA YS, ACTS, DRAMAS, 11 
CONCERTS, OR HISTRIONICS BY ACTORS OR ACTRESSES PERFORMING ON A STAGE 12 
OR THE SHOWING OF MO VIES OR FILMS. 13 
 
 (B) THERE IS A PERFORMING ARTS THEATER BEER AN D WINE LICENSE. 14 
 
 (C) THE BOARD MAY ISSUE THE L ICENSE FOR USE ON TH E PREMISES OF A 15 
PERFORMING ARTS THEA TER OPERATED BY A NONPROFIT ORGANIZATI ON. 16 
 
 (D) THE LICENSE AUTHORIZE S THE HOLDER TO SELL OR SERVE BEER AND 17 
WINE AT RETAIL FOR O N–PREMISES CONSUMPTION . 18 
 
 (E) THE LICENSE HOLDER MA Y SELL OR SERVE BEER AND WINE: 19 
 
 (1) 1 HOUR BEFORE AND AFTE R A PERFORMANCE ; 20 
 
 (2) DURING A PERFORMANCE ; 21 
 
 (3) DURING AN INTERMISSI ON; AND 22 
 
 (4) DURING A RECEPTION 1 HOUR BEFORE OR 1 HOUR AFTER A 23 
PERFORMANCE . 24 
 
 (F) THE LICENSE MAY NOT B E TRANSFERRED TO ANO THER LOCATION . 25 
 
 (G) THE LICENSE HOLDER SH ALL PURCHASE BEER AN D WINE FROM A 26 
RETAIL LICENSE HOLDER OR AN AUTHORIZED AND LI CENSED WHOLESALER OR 27

 (H) ISSUANCE OF A LICENSE UNDER THIS SECTION D OES NOT PROHIBIT THE 1 
BOARD FROM ISSUING A CLASS C PER DIEM LICENSE THA T APPLIES TO THE 2 
PERFORMING ARTS THEA TER. 3 
 
 (I) THE LICENSE HOLDER SH ALL SERVE OR OFFER FOR S ALE SNACKS AT 4 
ALL TIMES WHEN BEER AND WINE ARE SOLD . 5 
 
 (J) THE ANNUAL LICENSE FE E IS $500. 6 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 7 
1, 2023.  8
