BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 That the Laws of Maryland read as follows: 14 Article – Education 15 5–235. 16 (a) (1) (i) Subject to subsection (o) of this section and beginning in fiscal 17 year 2023, the county governing body shall levy and appropriate an annual tax sufficient 18 to provide an amount of revenue for elementary and secondary public education purposes 19 equal to the local share of major education aid as adjusted under § 5–239 of this subtitle. 20 (ii) For the purposes of calculating the local share of major education 21 aid and regardless of the source of the funds, all funds that a county board, including the 22 Baltimore City Board of School Commissioners, is authorized to expend for schools may be 23 considered as levied by the county council, board of county commissioners, or the Mayor 24 and City Council of Baltimore except for: 25 1. State appropriations; 26 2. Federal education aid payments; and 27 3. The amount of the expenditure authorized for debt service 28 and capital outlay. 29 (A–2) FOR FISCAL YEAR 2024, THE LOCAL SHARE OF M AJOR EDUCATION AID 30 UNDER SUBSECTION (A)(1) OF THIS SECTION SHAL L BE REDUCED BY AN A DDITIONAL 31 $10,000,000 FOR A LOCAL SCHOOL S YSTEM THAT: 32 HOUSE BILL 1196 3 (1) PARTICIPATED AS A WHO LE IN THE U.S. DEPARTMENT OF 1 AGRICULTURE COMMUNI TY ELIGIBILITY PROVI SION IN THE 2022–2023 SCHOOL 2 YEAR; AND 3 (2) HAD THE LARGEST FULL –TIME ENROLLMENT OF A LL LOCAL 4 SCHOOL SYSTEMS IN TH E STATE PARTICIPATING I N THE U.S. DEPARTMENT OF 5 AGRICULTURE COMMUNITY ELIGIBILITY PROVISIO N IN THE 2022–2023 SCHOOL 6 YEAR. 7 (P) (1) IN THIS SUBSECTION , “POPULATION DENSITY A MOUNT” MEANS 8 THE TOTAL COUNTY POP ULATION DIVIDED BY T HE SQUARE MILES IN T HE COUNTY. 9 (2) FOR FISCAL YEAR 2024, THE GOVERNOR MAY INCLUDE IN THE 10 ANNUAL BUDGET BILL A N APPROPRIATION OF $250,000 TO A LOCAL SCHOOL 11 SYSTEM IN A COUNTY W ITH: 12 (I) A POPULATION DENSITY A MOUNT OF LESS THAN 100; AND 13 (II) A FULL–TIME EQUIVALENT STUD ENT ENROLLMENT OF 14 FEWER THAN 2,000. 15 5–404. 16 (b) (2) State and local government units responsible for implementing an 17 element of the Blueprint for Maryland’s Future shall develop implementation plans 18 consistent with the Comprehensive Implementation Plan that describe the goals, 19 objectives, and strategies that will be used to improve student achievement and meet the 20 Blueprint for Maryland’s Future recommendations for each segment of the student 21 population. 22 (h) (1) For each of fiscal years 2022 through 2026, the governing body of a 23 county and the local school system jointly shall appoint a single implementation 24 coordinator responsible for the implementation of the Blueprint for Maryland’s Future by 25 all government units operating in the county. 26 (2) FOR EACH OF FISCAL YE ARS 2025 AND 2026, THE STATE SHALL 27 PROVIDE A GRANT OF $150,000 TO EACH COUNTY BOARD FOR THE SALARY OF TH E 28 IMPLEMENTATION COORD INATOR APPOINTED IN ACCORDANCE WITH PARA GRAPH 29 (1) OF THIS SUBSECTION . 30 (2) FOR EACH OF FISCAL YE ARS 2025 AND 2026, EACH COUNTY 31 BOARD SHALL PROVIDE $150,000 FOR THE SALARY OF TH E IMPLEMENTATION 32 COORDINATOR APPOINTE D IN ACCORDANCE WITH PARAGRAPH (1) OF THIS 33 SUBSECTION. 34 4 HOUSE BILL 1196 (3) FUNDING FOR THE SALAR Y OF THE IMPLEMENTAT ION 1 COORDINATOR PROVIDED BY THE COUNTY BOARD IN ACCORDANCE WITH 2 PARAGRAPH (2) OF THIS SUBSECTION S HALL BE PAID BY THE STATE AND THE 3 COUNTY IN THE SAME P ROPORTION AS THE FOU NDATION PROGRAM UNDER § 5–213 4 OF THIS TITLE. 5 5–410. 6 (a) In addition to its own assessments and tracking of progress, required under § 7 5–406 of this subtitle, the Board shall contract with a public or private entity to conduct an 8 independent evaluation of the State’s progress in implementing the Blueprint for 9 Maryland’s Future and achieving the expected outcomes during the implementation period. 10 (b) The independent evaluation shall include an assessment of: 11 (1) The use of additional funding to meet the goals of the Blueprint for 12 Maryland’s Future; 13 (2) Progress toward the goals of the Blueprint for Maryland’s Future and 14 whether the goals have been achieved; and 15 (3) Any recommendations to alter the goals or strategies employed to reach 16 the goals, including new uses for existing funds or additional funding. 17 (c) (1) An entity with which the Board contracts for an independent evaluation 18 shall report its results to the Board on or before: 19 (i) [October 1, 2024] DECEMBER 1, 2026; and 20 (ii) October 1, 2030. 21 (2) The Board shall contract for each independent evaluation as soon as 22 practicable. 23 (d) (1) (i) On or before [December 1, 2024] JANUARY 15, 2027, the Board 24 shall, using the first independent evaluation and its own judgment, report to the Governor 25 and, in accordance with § 2–1257 of the State Government Article, the General Assembly 26 on whether the Blueprint for Maryland’s Future is being implemented as intended and 27 achieving the expected outcomes. 28 (ii) The Board’s report shall include an assessment of the State’s 29 progress towards: 30 1. Increasing the number of teachers achieving National 31 Board Certification; 32 HOUSE BILL 1196 5 2. Providing full–day prekindergarten programs for 3– and 1 4–year–olds in accordance with Title 7, Subtitle 1A of this article; 2 3. Improving behavioral health services in accordance with § 3 7–447 of this article; and 4 4. Ensuring that students enrolled in public schools meet 5 college and career standards in accordance with § 7–205.1 of this article. 6 (iii) The Board’s report shall include any legislative or structural 7 corrections necessary to fully implement the Blueprint. 8 (2) On or before December 1, 2030, the Board shall report on the results of 9 the final independent evaluation to the Governor and, in accordance with § 2–1257 of the 10 State Government Article, the General Assembly. 11 (3) The Board’s reports under this subsection shall include: 12 (i) Practices being used to close achievement gaps between students 13 of different groups listed in § 5–408(a)(2)(i) of this subtitle; 14 (ii) Progress made in closing the achievement gaps listed under item 15 (i) of this paragraph; and 16 (iii) Assessments of student outcomes listed under § 5–408(a)(2)(ii) of 17 this subtitle, disaggregated by race, income, ethnicity, and gender. 18 Chapter 36 of the Acts of 2021 19 SECTION 16. AND BE IT FURTHER ENACTED, That: 20 (d) In the independent evaluation and report to be submitted to the Governor and 21 the General Assembly on or before [December 1, 2024] JANUARY 15, 2027, as required 22 under § 5–410(d)(1) of the Education Article as enacted by this Act, the Accountability and 23 Implementation Board shall report whether the Blueprint for Maryland’s Future is being 24 implemented as intended and is achieving expected outcomes. 25 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 26 1, 2023. 27
