A BILL ENTITLED 
 
AN ACT concerning 1 
 
Housing and Community Development – Adaptive Reuse 2 
 
FOR the purpose of establishing that adaptive reuse of existing buildings to create 3 
affordable multifamily housing is an eligible use of certain financial assistance 4 
provided by the Department of Housing and Community Development; requiring the 5 
Department to notify applicants for certain financial assistance that adaptive reuse 6 
is an eligible use of funds; and generally relating to the creation and financing of 7 
affordable multifamily housing through the adaptive reuse of existing buildings. 8

Section 1–102 to be under the amended subtitle “Subtitle 1. General Provisions” 11

 (2019 Replacement Volume and 2022 Supplement) 13 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 
That the Laws of Maryland read as follows: 15 
 
Article – Housing and Community Development 16 
 
Subtitle 1. [Definitions] GENERAL PROVISIONS. 17 
 
1–102. 18 
 
 (A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANING S 19 
INDICATED. 20 
 
 (2) “ADAPTIVE REUSE ” MEANS THE RETROFITTING AND 21 
REPURPOSING OF AN EX ISTING BUILDING TO DEVELOP NEW DWELLING UNITS. 22  2 	HOUSE BILL 150  
 
 
 
 (3) “AFFORDABLE MULTIFAMIL Y HOUSING” MEANS A MULTIFAMILY 1 
DWELLING WHERE ALL OR A PORTI ON OF THE DWELLING U NITS ARE RESERVED FOR 2 
INDIVIDUALS WHOSE HOUSEHOLD INCO ME IS LESS THAN OR EQUAL TO A CERTAIN 3 
LIMIT ON MAXIMUM HOUSEHOLD INCOME. 4 
 
 (B) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , THIS SECTION 5 
APPLIES TO ANY PROGR AM OPERATED BY THE DEPARTMENT THAT AWARD S LOANS 6 
THAT MAY BE USED TO DEVELOP AFFORDABLE MULTIFAMI LY HOUSING. 7 
 
 (2) IF THE LAWS OR REGULATIONS GOVER NING A PARTICULAR 8 
PROGRAM ESTABLISH MO RE SPECIFIC RULES REGARDING THE USE OF LOAN 9 
PROCEEDS FOR ADAPTIVE REUSE , THE MORE SPECIFIC RULES SHALL APPLY . 10 
 
 (C) (1) ADAPTIVE REUSE OF A PROPERTY TO DEV ELOP AFFORDABLE 11 
MULTIFAMILY HOUSING IS AN ELIGIBLE USE O F THE PROCEEDS OF A LOAN COVERED 12 
UNDER THIS SECTION . 13 
 
 (2) THE DEPARTMENT SHALL NOTIFY APPLICANTS FO R A LOAN 14 
COVERED UNDER THIS S ECTION THAT ADAPTIVE REUSE OF A PROPERTY TO 15 
DEVELOP AFFORDABLE M ULTIFAMILY HOUSING I S AN ELIGIBLE USE OF LOAN 16 
PROCEEDS. 17 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 18 
October 1, 2023. 19
