AN ACT concerning 1 
 
Baltimore County – School Board Nominating Commission – Vacancy 2 
Procedures 3 
 
FOR the purpose of requiring the Baltimore County School Board Nominating Commission 4 
to hold a public hearing on the selection of a nominee for a single vacancy on the 5 
Baltimore County Board of Education in a certain manner under certain 6 
circumstances; requiring the Commission to make publicly available on its website 7 
live video streaming of certain public hearings and certain archived video recordings; 8 
authorizing the Commission to retain and reactivate the applications of certain 9 
candidates for certain vacancies on the county board; and generally relating to the 10 
Baltimore County School Board Nominating Commission. 11

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17 
That the Laws of Maryland read as follows: 18 
 
Article – Education 19 
 
3–2B–03. 20 
 
 (a) (1) There is a Baltimore County School Board Nominating Commission. 21 
 
 (2) The purpose of the Commission is to select nominees to be 22 
recommended to the Governor as qualified candidates for appointment to the Baltimore 23 
County Board of Education. 24

 (3) (I) The Commission shall hold at least three public hearings, each 1 
in a different councilmanic district, on the selection of MULTIPLE nominees before 2 
recommending to the Governor nominees for appointment to the county board. 3 
 
 (II) FOR A SINGLE VACANCY ON THE CO UNTY BOARD , THE 4 
COMMISSION SHALL HOLD PUBLIC MEETINGS IN T HE FOLLOWING MANNER ON THE 5 
SELECTION OF A NOMIN EE BEFORE RECOMMENDI NG TO THE GOVERNOR THE 6 
NOMINEE FOR APPOINTM ENT TO THE COUNTY BO ARD: 7 
 
 1. FOR A VACANCY IN A CO UNCILMANIC DISTRICT , AT 8 
LEAST ONE PUBLIC MEETING IN TH AT COUNCILMANIC DIST RICT; OR 9 
 
 2. FOR A VACANCY FOR A M EMBER APPOINTED AT 10 
LARGE, AT LEAST ONE PUBLIC MEETING AT THE COUNT Y BOARD ADMINISTRATI VE 11 
OFFICES. 12 
 
 (III) THE COMMISSION SHALL MAKE PUBLICLY AVAILABLE O N 13 
ITS WEBSITE: 14 
 
 1. LIVE VIDEO STREAMING OF EACH PUBLIC MEETI NG; 15 
AND 16 
 
 2. A COMPLETE AND UNEDITE D ARCHIVED VIDEO 17 
RECORDING OF EACH PU BLIC MEETING FOR WHI CH LIVE STREAMING WA S MADE 18 
AVAILABLE UNDER ITEM 1 OF THIS SUBPARAGRAPH . 19 
 
 (b) (1) The Commission consists of 19 members who shall be appointed in 20 
accordance with this subsection. 21 
 
 (2) The Commission shall reflect the rich cultural, geographic, ethnic, and 22 
racial diversity of Baltimore County. 23 
 
 (3) The Governor, in consultation with the County Executive of Baltimore 24 
County, shall appoint eight members, one from each legislative district that lies in whole 25 
or in part in Baltimore County. 26 
 
 (4) The County Executive of Baltimore County shall appoint one member 27 
from the county at large. 28 
 
 (5) The following organizations each shall appoint one member: 29 
 
 (i) The Teachers Association of Baltimore County; 30 
 
 (ii) The Baltimore County Chamber of Commerce; 31

 (iii) The PTA Council of Baltimore County, Inc.; 1 
 
 (iv) Towson University; 2 
 
 (v) The League of Women Voters of Baltimore County; 3 
 
 (vi) The Baltimore County Branch of the National Association for the 4 
Advancement of Colored People; 5 
 
 (vii) The Baltimore County Public Schools’ Special Education 6 
Citizens’ Advisory Committee; 7 
 
 (viii) The Baltimore County Student Councils; 8 
 
 (ix) The Council of Administrative and Supervisory Employees; and 9 
 
 (x) The Education Support Personnel of Baltimore County. 10 
 
 (c) (1) The County Executive of Baltimore County shall designate one of the 11 
Commission’s members as chair of the Commission. 12 
 
 (2) The term of the chair of the Commission is 4 years. 13 
 
 (3) The term of a member of the Commission is 4 years. 14 
 
 (d) The Baltimore County Public Schools shall provide staff for the Commission. 15 
 
 (e) Beginning October 1, 2018, for each nomination for a vacancy on the county 16 
board, the Commission shall submit to the Governor a list of nominees that contains: 17 
 
 (1) At least two names for each vacancy; or 18 
 
 (2) If there are fewer than two applicants for a vacancy, the number of 19 
names that is equal to the number of applicants for the vacancy. 20 
 
 (F) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , THE 21 
COMMISSION MAY RETAIN AND REACTIVATE THE A PPLICATION OF A CAND IDATE 22 
FOR A VACANCY ON THE COUNTY BOARD FOR UP TO 2 YEARS FROM THE DATE THE 23 
COMMISSION SUBMITTED THE LI ST OF NOMINEES TO TH E GOVERNOR FOR THE 24 
VACANCY FOR WHICH TH E APPLICANT WAS INIT IALLY CONSIDERED . 25 
 
 (2) (I) THE COMMISSION MAY REACTI VATE THE APPLICATION OF 26 
A CANDIDATE UNDER PA RAGRAPH (1) OF THIS SUBSECTION O NLY WITH THE 27 
CONSENT OF THE APPLICANT. 28 
 
 (II) TO REACTIVATE AN APPL	ICATION UNDER THIS 29  4 	HOUSE BILL 348  
 
 
SUBSECTION, THE COMMISSION SHALL : 1 
 
 1. WITHIN 14 DAYS AFTER THE DATE OF THE NEW 2 
VACANCY, SEND A NOTICE TO THE APPLICANT REQUESTING CONSENT TO 3 
REACTIVATE THE APPLICANT’S APPLICATION; AND 4 
 
 2. WITHIN 14 DAYS AFTER THE DATE THE APPLICA NT 5 
RECEIVED THE NOTICE UNDER ITEM 1 OF THIS SUBPARAGRAPH , RECEIVE THE 6 
CONSENT OF THE APPLI CANT. 7 
 
 [(f)] (G) (1) Absent an extraordinary circumstance, the Governor shall 8 
appoint a member to the county board from the list provided by the Commission. 9 
 
 (2) If the Governor elects not to appoint a member from a list submitted by 10 
the Commission, the Governor shall return the list to the Commission and request that the 11 
Commission submit the names of additional qualified candidates. 12 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 13 
1, 2023. 14
