[Brackets] indicate matter deleted from existing law. *hb0363* HOUSE BILL 363 J1, J5 3lr1180 CF 3lr2862 By: Delegate Cullison Introduced and read first time: January 26, 2023 Assigned to: Health and Government Operations A BILL ENTITLED AN ACT concerning 1 Maryland Health Benefit Exchange and Maryland Department of Health 2 – Health Care Coverage for Undocumented Immigrants – Report 3 FOR the purpose of requiring the Maryland Health Benefit Exchange and the Maryland 4 Department of Health to develop a report comparing options for offering affordable 5 health care coverage to State residents who are ineligible for the Maryland Medical 6 Assistance Program, the Maryland Children’s Health Program, or qualified health 7 plans due to the individuals’ immigration status; and generally relating to a study 8 on providing health care coverage to undocumented immigrants. 9 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 10 That: 11 (a) The Maryland Health Benefit Exchange and the Maryland Department of 12 Health shall develop a report comparing options for offering affordable health care coverage 13 to State residents who are ineligible for the Maryland Medical Assistance Program, the 14 Maryland Children’s Health Program, or qualified health plans through the Maryland 15 Health Benefit Exchange due to the individuals’ immigration status. 16 (b) The report required under subsection (a) of this section shall include a 17 comparison of the cost to the State, the impact on the uninsured, potential benefits designs, 18 and implementation considerations for: 19 (1) offering health care coverage through: 20 (i) the Maryland Medical Assistance Program and the Maryland 21 Children’s Health Program to individuals who are eligible technically and financially for 22 the programs but for the individuals’ immigration status; and 23 (ii) qualified health plans offered through the Maryland Health 24 Benefit Exchange to individuals who are eligible technically and financially to enroll in 25 2 HOUSE BILL 363 coverage through the Exchange but for the individuals’ immigration status; and 1 (2) offering health care coverage to the following groups: 2 (i) all eligible individuals; 3 (ii) only individuals under the age of 21 years; 4 (iii) only individuals who are at least 65 years old; and 5 (iv) only low–income individuals. 6 (c) On or before October 31, 2023, the Maryland Health Benefit Exchange and 7 the Maryland Department of Health shall report their findings and recommendations to 8 the House Health and Government Operations Committee and the Senate Finance 9 Committee in accordance with § 2–1257 of the State Government Article. 10 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 11 1, 2023. 12
