AN ACT concerning 1 
 
State Board of Electricians – Limited Energy Contractors and Limited Energy 2 
Integrators – Licensing 3 
 
FOR the purpose of altering the composition of the State Board of Electricians; requiring 4 
the Board to license limited energy contractors and limited energy integrators as 5 
State licenses; and generally relating to the State Board of Electricians and limited 6 
energy contractors and limited energy integrators. 7 
 
BY repealing and reenacting, with amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 
That the Laws of Maryland read as follows: 15 
 
Article – Business Occupations and Professions 16 
 
6–101. 17 
 
 (a) In this title the following words have the meanings indicated. 18 
 
 (b) (1) “Assignment of local registration” means any procedure by which a 19 
licensee or registrant grants to another person a right to use a local registration to enable 20 
that person to engage in the business of providing electrical services. 21 
 
 (2) “Assignment of local registration” includes any procedure by which: 22

 (i) a licensee or registrant agrees to be the representative of another 1 
person; and 2 
 
 (ii) by virtue of that agreement, the other person is authorized to 3 
engage in the business of providing electrical services. 4 
 
 (c) “Engage in the business of providing electrical services” means to engage in 5 
providing electrical services for compensation. 6 
 
 (d) (1) “License” means, unless the context requires otherwise, a license issued 7 
by the State Board to provide or assist in providing electrical services. 8 
 
 (2) “License” includes, unless the context requires otherwise: 9 
 
 (i) a master electrician license; and 10 
 
 (ii) a journeyperson electrician license. 11 
 
 (e) “Licensed apprentice electrician” means, unless the context requires 12 
otherwise, an electrician who is licensed by the State Board to assist in providing electrical 13 
services while: 14 
 
 (1) under the direction or control of a licensed master electrician; and 15 
 
 (2) in training to become a journeyperson electrician. 16 
 
 (f) “Licensed journeyperson electrician” means, unless the context requires 17 
otherwise, an electrician who is licensed by the State Board to provide or assist in providing 18 
electrical services while: 19 
 
 (1) under the direction or control of a licensed master electrician; and 20 
 
 (2) in training to become a master electrician. 21 
 
 (G) “LICENSED LIMITED ENER GY CONTRACTOR ” MEANS A CONTRACTOR 22 
WHO IS LICENSED BY T HE STATE BOARD OR LOCAL JURISD ICTION TO ENTER 23 
CONTRACTS FOR PROVID ING LIMITED ENERGY S ERVICES. 24 
 
 [(g)] (H) “Licensed master electrician” means, unless the context requires 25 
otherwise, a master electrician who is licensed by the State Board to provide electrical 26 
services. 27 
 
 (I) “LIMITED ENERGY CONTRA CTOR” MEANS A PERSON WHO :  28 
 
 (1) PROVIDES, INSTALLS, SERVICES, MAINTAINS, DESIGNS, REPAIRS, 29 
OR CONSULTS IN THE D ESIGN OF LIMITED ENE RGY SYSTEMS FOR A CO NSUMER; AND 30   	HOUSE BILL 895 	3 
 
 
 
 (2) EMPLOYS LIMITED ENER GY INTEGRATORS .  1 
 
 (J) “LIMITED ENERGY INTEGR ATOR” MEANS AN INDIVIDUAL WHO: 2 
 
 (1) HAS EXPERIENCE , KNOWLEDGE , AND SKILL TO PROVIDE LIMITED 3 
ENERGY SERVICES IN A MANNER THAT COMPLIES WITH APPLICABLE PLAN S, 4 
SPECIFICATIONS , CODES, OR LAWS; AND 5 
 
 (2) IS EMPLOYED BY A LIM ITED ENERGY CONTRACT OR. 6 
 
 (K) “LIMITED ENERGY SYSTEM ” MEANS A CLASS 2 OR 3 CIRCUIT, AS 7 
DEFINED IN THE NATIONAL ELECTRICAL CODE, INCLUDING: 8 
 
 (1) REMOTE CONTROL , SIGNALING, AND POWER–LIMITED CIRCUITS ; 9 
AND 10 
 
 (2) OPTICAL FIBER CABLE , OTHER CABLING , OR COMMUNICATIONS 11 
CIRCUITS, INCLUDING RACEWAYS . 12 
 
 [(h)] (L) “Local board” means a board that a local jurisdiction of the State creates 13 
to regulate any aspect of the electrical trade. 14 
 
 [(i)] (M) “Local registration” means, unless the context requires otherwise, a 15 
registration that is issued by a local board to provide electrical services. 16 
 
 [(j)] (N) “Master electrician” means an individual who has the experience, 17 
knowledge, and skill to provide electrical services in all aspects of the electrical trade, in a 18 
manner that complies with applicable plans, specifications, codes, or law. 19 
 
 [(k)] (O) (1) “Provide electrical services” means to provide any service in the 20 
electrical trade. 21 
 
 (2) “Provide electrical services” includes installing, repairing, maintaining, 22 
erecting, or altering any electrical equipment, wiring, fixture, appliance, apparatus, 23 
raceway, conduit, or system that: 24 
 
 (i) generates, transmits, transforms, or uses electrical energy in any 25 
form for light, heat, power, or communication; and 26 
 
 (ii) is located within a plant, substation, or elsewhere. 27 
 
 (P) “PROVIDE LIMITED ENERG Y SERVICES” MEANS TO INSTALL , SERVICE, 28 
MAINTAIN, DESIGN, OR REPAIR LIMITED EN ERGY SYSTEMS . 29

 [(l)] (Q) “State Board” means the State Board of Electricians. 1 
 
 [(m)] (R) “State license” means a license that is issued by the State Board to an 2 
electrician. 3 
 
6–103. 4 
 
 (a) This title does not affect the right of any local jurisdiction of the State: 5 
 
 (1) to regulate locally the quality and character of work of a person who 6 
engages in the business of providing electrical services by establishing a system of 7 
registrations, permits, fees, and inspections designed to: 8 
 
 (i) ensure compliance with and implementation of State and local 9 
building laws; or 10 
 
 (ii) enforce other local laws protecting public health and safety; 11 
 
 (2) to require a person who engages in the business of providing electrical 12 
services to submit any plan or specification for approval before the electrical services are 13 
provided; 14 
 
 (3) to establish a local board to: 15 
 
 (i) carry out items (1) and (2) of this subsection; 16 
 
 (ii) take any disciplinary action, except for revocation of a license 17 
issued by the State Board, against the holder of a local registration or the holder of a local 18 
permit who violates any provision of this title or any local law; and 19 
 
 (iii) report any enforcement activity to the State Board; 20 
 
 (4) except as provided in §§ 6–504 and 6–602 of this title and subject to the 21 
requirements of this section, to require an examination before issuing a registration to 22 
provide electrical services OR LIMITED ENERGY SE RVICES within the local jurisdiction; 23 
or 24 
 
 (5) to collect, from a person who is registered with a local board, fees for: 25 
 
 (i) an examination for a registration to provide electrical services; 26 
 
 (ii) issuance and renewal of the registration; or 27 
 
 (iii) an inspection. 28

 (b) If a local jurisdiction registers any class of electricians other than master 1 
electricians, journeyperson electricians, or apprentice electricians, that class is also under 2 
the control and supervision of the local board. 3 
 
 (c) (1) [Beginning July 1, 2021, a] A local jurisdiction may not issue licenses 4 
for apprentice, journeyperson, or master electricians, LIMITED ENERGY CONTR ACTORS, 5 
OR LIMITED ENERGY IN TEGRATORS . 6 
 
 (2) (I) A local jurisdiction that licensed apprentice –level, 7 
journeyperson–level, or master–level electricians before July 1, 2021, may continue to 8 
register the electricians according to the same rules and requirements for licenses issued 9 
before July 1, 2021, if the local jurisdiction complies with subsections (d) and (e) of this 10 
section. 11 
 
 (II) A LOCAL JURISDICTION THAT LICENSED LIMITE D ENERGY 12 
CONTRACTORS OR LIMIT ED ENERGY INTEGRATOR S BEFORE JULY 1, 2023, MAY 13 
CONTINUE TO REGISTER THE LIMITED ENERGY C ONTRACTORS AND LIMIT ED 14 
ENERGY INTEGRATORS A CCORDING TO THE SAME RULES AND REQUIREMEN TS FOR 15 
LICENSES ISSUED BEFO RE JULY 1, 2023, IF THE LOCAL JURISDI CTION COMPLIES 16 
WITH SUBSECTIONS (D) AND (E) OF THIS SECTION. 17 
 
 (3) (I) A local jurisdiction that did not license apprentice–level, 18 
journeyperson–level, or master–level electricians before July 1, 2021, may choose to 19 
register apprentice–level, journeyperson–level, or master–level electricians if it complies 20 
with subsections (d) and (e) of this section. 21 
 
 (II) A LOCAL JURISDICTION T HAT DID NOT LICENSE LIMITED 22 
ENERGY CONTRACTORS O R LIMITED ENERGY INT EGRATORS BEFORE JULY 1, 2023, 23 
MAY CHOOSE TO REGIST ER LIMITED ENERGY CO NTRACTORS OR LIMITED ENERGY 24 
INTEGRATORS IF IT CO MPLIES WITH SUBSECTI ONS (D) AND (E) OF THIS SECTION. 25 
 
 (d) If a local jurisdiction chooses to register apprentice –level,  26 
journeyperson–level, or master–level electricians OR LIMITED ENERGY CO NTRACTORS 27 
OR LIMITED ENERGY IN TEGRATORS under subsection (c) of this section, the local board 28 
shall administer the same examination as the State Board as provided under § 6–306 of 29 
this title. 30 
 
 (e) On or before [July 1, 2022, and on or before] July 1 each year [thereafter], a 31 
local jurisdiction that registers apprentice–level, journeyperson–level, or master–level 32 
electricians OR LIMITED ENERGY CO NTRACTORS OR LIMITED ENERGY INTEGRATORS 33 
shall report to the Department: 34 
 
 (1) each [apprentice electrician] registration issued in the previous year 35

 (I) APPRENTICE ELECTRICI AN; 1 
 
 (II) JOURNEYPERSON ELECTR ICIAN; 2 
 
 (III) MASTER ELECTRICIAN ; 3 
 
 (IV)  LIMITED ENERGY CONTR ACTOR; AND 4 
 
 (V) LIMITED ENERGY INTEG RATOR; 5 
 
 [(2) each journeyperson electrician registration issued in the previous year; 6 
 
 (3) each master electrician registration issued in the previous year;] 7 
 
 [(4)] (2) [each individual] ALL INDIVIDUALS who sat for [a 8 
journeyperson electrician examination] ANY OF THE FOLLOWING EXAMINA TIONS in the 9 
previous year: 10 
 
 (I) JOURNEYPERSON ELECTR ICIAN;  11 
 
 (II) MASTER ELECTRICIAN ; 12 
 
 (III) LIMITED ENERGY CONTR ACTOR; AND 13 
 
 (IV) LIMITED ENERGY INTEG RATOR; AND 14 
 
 [(5) each individual who sat for a master electrician examination in the 15 
previous year; and] 16 
 
 [(6)] (3) any other information the Department requires. 17 
 
 (f) This title may not be construed to waive any requirement of an ordinance or 18 
regulation that sets out the type of work to be performed by a person who engages in the 19 
business of providing electrical services OR LIMITED ENERGY SE RVICES as required 20 
under State or local building laws. 21 
 
6–202. 22 
 
 (a) (1) The State Board consists of [9] 10 members appointed by the Governor 23 
with the advice and consent of the Senate. 24 
 
 (2) Of the [9] 10 members of the State Board: 25 
 
 (i) 6 shall be licensed master electricians; [and] 26   	HOUSE BILL 895 	7 
 
 
 
 (II) 1 SHALL BE A LICENSED LIMITED ENERGY CONTR ACTOR; 1 
AND 2 
 
 [(ii)] (III) 3 shall be consumer members. 3 
 
 (3) Of the 6 master electrician members: 4 
 
 (i) 1 shall be from Baltimore City; 5 
 
 (ii) 1 shall be from the area that consists of Caroline, Dorchester, 6 
Kent, Queen Anne’s, Somerset, Talbot, Wicomico, and Worcester counties; 7 
 
 (iii) 1 shall be from the area that consists of Baltimore, Cecil, and 8 
Harford counties; 9 
 
 (iv) 1 shall be from the area that consists of Anne Arundel, Calvert, 10 
Charles, and St. Mary’s counties; 11 
 
 (v) 1 shall be from the area that consists of Montgomery and Prince 12 
George’s counties; and 13 
 
 (vi) 1 shall be from the area that consists of Allegany, Carroll, 14 
Frederick, Garrett, Howard, and Washington counties. 15 
 
 (4) THE LICENSED LIMITED ENERGY CONTRACTOR SH ALL BE FROM 16 
THE STATE AT LARGE. 17 
 
 [(4)] (5) The consumer members shall be from the State at large. 18 
 
 [(5)] (6) A member of the State Board may not reside in the same county 19 
as another member. 20 
 
 (b) Each member of the State Board shall be a citizen and resident of the State. 21 
 
 (c) Each master electrician member of the State Board shall: 22 
 
 (1) hold an active State license; and 23 
 
 (2) be engaged actively in providing electrical services as a master 24 
electrician for at least 5 consecutive years immediately before appointment. 25 
 
 (D) THE LICENSED LIMITED ENERGY CONTRACTOR ME MBER OF THE STATE 26 
BOARD MUST: 27 
 
 (1) HOLD AN ACTIVE STATE LICENSE; AND 28  8 	HOUSE BILL 895  
 
 
 
 (2) HAVE BEEN ENGAGED AC TIVELY IN PROVIDING LIMITED ENERGY 1 
SERVICES AS A LIM ITED ENERGY CONTRACT OR FOR AT LEAST 5 YEARS 2 
IMMEDIATELY BEFORE A PPOINTMENT . 3 
 
 [(d)] (E) Each consumer member of the State Board: 4 
 
 (1) shall be a member of the general public; 5 
 
 (2) may not be a licensee or otherwise be subject to regulation by the State 6 
Board; 7 
 
 (3) may not be required to meet the qualifications for the professional 8 
members of the State Board; and 9 
 
 (4) may not, within 1 year before appointment, have had a financial 10 
interest in or have received compensation from a person regulated by the State Board. 11 
 
 [(e)] (F) While a member of the State Board, a consumer member may not: 12 
 
 (1) have a financial interest in or receive compensation from a person 13 
regulated by the State Board; or 14 
 
 (2) grade an examination given by or for the State Board. 15 
 
 [(f)] (G) Before taking office, each appointee to the State Board shall take the 16 
oath required by Article I, § 9 of the Maryland Constitution. 17 
 
 [(g)] (H) (1) The term of a member is 3 years and begins on July 1. 18 
 
 (2) The terms of members are staggered as required by the terms provided 19 
for members of the State Board on October 1, 1989. 20 
 
 (3) At the end of a term, a member continues to serve until a successor is 21 
appointed and qualifies. 22 
 
 (4) A member who is appointed after a term has begun serves only for the 23 
rest of the term and until a successor is appointed and qualifies. 24 
 
 (5) A member may not be reappointed for more than 2 consecutive 3–year 25 
terms. 26 
 
 [(h)] (I) (1) The Governor may remove a member for incompetence or 27 
misconduct. 28

 (2) Except as provided in paragraph (3) of this subsection and subject to 1 
paragraph (4) of this subsection, a member shall be considered to have resigned if the 2 
member did not attend at least two–thirds of the State Board meetings held during any 3 
consecutive 12–month period while the member was serving on the State Board. 4 
 
 (3) The Governor may waive a member’s resignation and allow the member 5 
to continue serving if the member has been unable to attend meetings for reasons 6 
satisfactory to the Governor and the reasons are made public. 7 
 
 (4) In accordance with § 8–501 of the State Government Article, the 8 
chairman shall provide notice to the Governor and the Governor shall appoint a successor. 9 
 
6–302. 10 
 
 (a) In a local jurisdiction that requires local registration and has qualified to 11 
register electricians locally under § 6–103 of this title, the State license, while the State 12 
license is in effect, serves only as a mechanism that helps a licensee in obtaining a local 13 
registration under §§ 6–601 and 6–602 of this title. 14 
 
 (b) If a county or municipal corporation does not require local registration, the 15 
State license, while the State license is in effect, authorizes the licensee to: 16 
 
 (1) provide electrical services; [or] 17 
 
 (2) PROVIDE LIMITED ENER GY SERVICES; OR 18 
 
 [(2)] (3) be the representative of another person who engages in the 19 
business of providing electrical services OR LIMITED ENERGY SE RVICES. 20 
 
6–303. 21 
 
 This subtitle does not require: 22 
 
 (1) a public utility company to employ an electrician licensed by the State 23 
Board to represent the company while the company is engaging in the business of providing 24 
electrical services to a facility of the company that: 25 
 
 (i) is regulated by the Public Service Commission; and 26 
 
 (ii) is located on any premises, roadway, or right–of–way in which 27 
the company has a lawful interest; 28 
 
 (2) an employee of a public utility company to hold a State license while 29 
the employee provides electrical services to a facility of the company that: 30 
 
 (i) is regulated by the Public Service Commission; and 31

 (ii) is located on any premises, roadway, or right–of–way in which 1 
the company has a lawful interest; [or] 2 
 
 (3) a person to hold a license issued by the State Board if the person: 3 
 
 (i) is licensed or registered under Title 18 of this article to provide 4 
security system services and is acting within the scope of that license; 5 
 
 (ii) holds a license issued under Title 12 of this article and is acting 6 
within the scope of that license; 7 
 
 (iii) holds a license issued under Title 9A of the Business Regulation 8 
Article and is acting within the scope of that license; or 9 
 
 (iv) provides wireless security systems in compliance with Title 19, 10 
Subtitle 9 of the Business Regulation Article;  11 
 
 (4) A LICENSED LIMITED E NERGY CONTRACTOR TO HOLD A MASTER 12 
ELECTRICIAN LICENSE TO PROVIDE LIMITED E NERGY SERVICES ; OR 13 
 
 (5) A PERSON TO HOLD A L IMITED ENERGY CONTRA CTOR LICENSE IF 14 
THE PERSON: 15 
 
 (I) PROVIDES OR INSTALLS HARDWIRED FIRE , BURGLARY, OR 16 
ROBBERY ALARM SYSTEM S; 17 
 
 (II) PROVIDES INSTALLATIO N, TESTING, ROUTINE 18 
MAINTENANCE , FACTORY SERVICING , SELLING, OR MONITORING OF A P ERSONAL 19 
EMERGENCY RESPONSE S YSTEM; 20 
 
 (III) SELLS LIMITED ENERGY SYSTEMS AT A RETAIL 21 
ESTABLISHMENT TO A C ONSUMER FOR SELF –INSTALLATION; 22 
 
 (IV) DOES NOT PROVIDE DIR ECT SALES, MONITORING , OR 23 
INSTALLATION OF LIMI TED ENERGY SYSTEMS T O A CONSUMER AND : 24 
 
 1. HOLDS A LICENSE UNDE R: 25 
 
 A. TITLE 12.5 OF THE BUSINESS REGULATION ARTICLE; 26 
OR 27 
 
 B. TITLE 3 OR 14 OF THIS ARTICLE; OR 28 
 
 2. IS ONE OF THE FOLLOW ING: 29   	HOUSE BILL 895 	11 
 
 
 
 A. A TELECOMMUNICATION IN STALLER OR RETAILER ; 1 
 
 B. AN EQUIPMENT DISTRIB UTOR OR SUPPLIER ; OR 2 
 
 C. AN EQUIPMENT MANAGER ; 3 
 
 (V) IS AN OFFICER OR EMP LOYEE OF THE UNITED STATES, THIS 4 
STATE, OR ANY POLITICAL SUB DIVISION WHILE ENGAG ED IN THE PERFORMANC E OF 5 
THE INDIVIDUAL’S DUTIES WITHIN THE SCOPE OF THE INDIVID UAL’S EMPLOYMENT ; 6 
 
 (VI) IS INSTALLING A LIMI TED ENERGY SYSTEM ON A MOTOR 7 
VEHICLE OR BOAT ; OR 8 
 
 (VII) IS PERSONALLY INSTAL LING A LIMITED ENERG Y SYSTEM 9 
WITHIN THE INDIVIDUA L’S OWN DWELLING UNIT OR OTHER BUILDING. 10 
 
6–308. 11 
 
 (a) Subject to the limitations in this section, on the affirmative vote of at least a 12 
majority of the authorized membership of the State Board, the State Board may waive the 13 
examination requirements of this subtitle for an individual who is licensed to provide 14 
electrical services as a master electrician or journeyperson electrician OR LIMITED 15 
ENERGY SERVICES AS A LIMITED ENERGY CONTR ACTOR OR LIMITED ENE RGY 16 
INTEGRATOR in another state. 17 
 
6–316. 18 
 
 (a) Subject to the hearing provisions of § 6–317 of this subtitle, the State Board 19 
may deny a State license to any applicant, reprimand any State licensee, or suspend or 20 
revoke a State license if the applicant or State licensee: 21 
 
 (1) fraudulently or deceptively obtains or attempts to obtain a State license 22 
for the applicant, State licensee, or another person; 23 
 
 (2) fraudulently or deceptively uses a State license; 24 
 
 (3) transfers the authority granted by a State license to another person; 25 
 
 (4) engages in an unfair or deceptive trade practice, as defined in § 13–301 26 
of the Commercial Law Article; 27 
 
 (5) willfully or deliberately disregards and violates a building code, 28 
electrical code, or law of the State or a local jurisdiction; 29

 (6) under the laws of the United States or of any state, is convicted of: 1 
 
 (i) a felony; or 2 
 
 (ii) a misdemeanor that is directly related to the fitness and 3 
qualification of the applicant or licensee to provide electrical services; 4 
 
 (7) aids or abets a person to evade a provision of this title; 5 
 
 (8) willfully or deliberately disregards disciplinary action taken by a local 6 
jurisdiction against the individual in connection with the provision of electrical services OR 7 
LIMITED ENERGY SERVI CES; 8 
 
 (9) fails in a material respect to comply with a provision of this title; 9 
 
 (10) fails to train and control adequately a person who, while under the 10 
supervision of the State licensee, sells or estimates electrical work or provides or assists in 11 
providing electrical services OR LIMITED ENERGY SE RVICES; 12 
 
 (11) fails to maintain a local registration, if required, under § 6–601 of this 13 
title; 14 
 
 (12) fails to maintain the general liability and property damage insurance 15 
required under § 6–604 of this title; 16 
 
 (13) offers or provides electrical services OR LIMITED ENERGY SE RVICES 17 
outside the scope of the license held by the licensee; 18 
 
 (14) permits another licensee employed by the individual to provide 19 
electrical services OR LIMITED ENERGY SE RVICES outside the scope of that individual’s 20 
license; 21 
 
 (15) without justification, fails to perform a contract or abandons a project 22 
to provide electrical services OR LIMITED ENERGY SE RVICES; 23 
 
 (16) provides electrical services OR LIMITED ENERGY SE RVICES that are 24 
inadequate or incomplete, according to the terms of a contract or a project; 25 
 
 (17) directly or indirectly publishes an advertisement relating to the 26 
provision of electrical services OR LIMITED ENERGY SE RVICES that contains a 27 
representation or statement that is false, deceptive, or misleading; 28 
 
 (18) certifies on a license renewal application that the continuing education 29 
requirement of license renewal has been completed if the licensee has not fully completed 30 
the continuing education requirement at the time the license renewal application is 31

 (19) violates any other provision of this title; or 1 
 
 (20) violates any regulation adopted under this title. 2 
 
6–319. 3 
 
 (a) The State Board may not suspend a State license for more than 1 year. 4 
 
 (b) The State Board may not revoke a State license for less than 1 year. 5 
 
 (c) If the State Board, after a hearing, suspends a license, the State Board may 6 
allow the licensee to complete a contract to provide electrical services OR LIMITED ENERGY 7 
SERVICES that is in progress and uncompleted at the time of suspension. 8 
 
 (d) (1) If a State license is revoked, the State Board may reinstate the State 9 
license after not less than 1 year. 10 
 
 (2) A State license that has been revoked may be reinstated under this 11 
subsection if: 12 
 
 (i) the individual whose State license has been revoked submits a 13 
written request to the State Board; 14 
 
 (ii) the State Board holds a hearing on the request; and 15 
 
 (iii) the State Board makes a determination to reinstate the State 16 
license. 17 
 
6–320. 18 
 
 Within 30 days after taking action, the State Board shall give each local board or 19 
building official notice of the name of each master electrician, LIMITED ENERGY 20 
CONTRACTOR , OR LIMITED ENERGY IN TEGRATOR whose State license has been 21 
suspended, revoked, or reinstated by the State Board. 22 
 
6–321. 23 
 
 (a) (1) When a county or municipal corporation that requires a local license 24 
initiates a disciplinary action against a licensed master electrician, LIMITED ENERGY 25 
CONTRACTOR , OR LIMITED ENERGY IN TEGRATOR, the county or municipal corporation 26 
shall report the disciplinary action to the State Board within 30 days of commencement of 27 
the action. 28 
 
 (2) When the State Board receives notice of a local disciplinary action 29 
against a licensed electrician, LIMITED ENERGY CONTR ACTOR, OR LIMITED ENERGY 30  14 	HOUSE BILL 895  
 
 
INTEGRATOR , the State Board shall provide notice of the disciplinary action to each local 1 
licensing jurisdiction. 2 
 
 (b) Each local jurisdiction that registers electricians, LIMITED ENERGY 3 
CONTRACTORS , OR LIMITED ENERGY IN TEGRATORS under § 6–603 of this title shall 4 
submit a report to the State Board on the number of complaints against electricians, 5 
LIMITED ENERGY CONTR ACTORS, OR LIMITED ENERGY IN TEGRATORS registered in 6 
the local jurisdiction on or before December 1 of each year. 7 
 
6–501. 8 
 
 (a) In this subtitle the following words have the meanings indicated. 9 
 
 (b) (1) “Reciprocal license” means a license to provide electrical services OR 10 
LIMITED ENERGY SERVI CES issued by the State Board on the basis of a registration 11 
issued by a local jurisdiction. 12 
 
 (2) “Reciprocal license” includes any type or class of license that the State 13 
Board issues to provide electrical services OR LIMITED ENERGY SE RVICES. 14 
 
 (c) (1) “Reciprocal registration” means registration with a local jurisdiction on 15 
the basis of: 16 
 
 (i) a license issued by the State Board; or 17 
 
 (ii) a registration with another local jurisdiction. 18 
 
 (2) “Reciprocal registration” includes any type or class of registration with 19 
a local jurisdiction to provide electrical services OR LIMITED ENERGY SE RVICES. 20 
 
6–504. 21 
 
 (a) Subject to the limitations in this subtitle, an individual may qualify for a 22 
reciprocal registration from a local jurisdiction of the State if the individual: 23 
 
 (1) is registered with another local jurisdiction of the State to provide 24 
electrical services OR LIMITED ENERGY SE RVICES in that local jurisdiction; 25 
 
 (2) applies for a reciprocal registration to provide the same class or type of 26 
electrical services OR LIMITED ENERGY SE RVICES as those permitted by the registration 27 
the individual holds in that local jurisdiction; and 28 
 
 (3) at the time of application, does not have: 29 
 
 (i) a registration of the same class or type suspended or revoked by 30 
a local jurisdiction of the State; or 31   	HOUSE BILL 895 	15 
 
 
 
 (ii) a record of outstanding violations of the regulations of a local 1 
jurisdiction of the State. 2 
 
 (b) A local jurisdiction of the State that registers individuals to provide electrical 3 
services OR LIMITED ENERGY SE RVICES shall waive any of the registration qualifications 4 
of the local jurisdiction for an individual who: 5 
 
 (1) (i) is a resident of the State; or 6 
 
 (ii) meets the legal requirements of the State for establishing a 7 
principal place of business in the State; 8 
 
 (2) is registered with another local jurisdiction of the State to provide 9 
electrical services OR LIMITED ENERGY SE RVICES of the same class or type as those 10 
permitted by the registration for which the applicant is seeking a waiver; and 11 
 
 (3) meets the waiver requirements of subsection (c) of this section. 12 
 
6–601. 13 
 
 (a) This section applies only to a local jurisdiction that has applied for and 14 
received authorization to offer local master, [or] journeyperson, LIMITED ENERGY 15 
CONTRACTOR , OR LIMITED ENERGY IN TEGRATOR registration under § 6–103 of this 16 
title. 17 
 
6–602. 18 
 
 (a) Subject to the limitations in this section, a local jurisdiction shall waive its 19 
examination requirements for an individual who is licensed by the State Board to provide 20 
electrical services OR LIMITED ENERGY SERVICES . 21 
 
 (b) A local jurisdiction shall grant a waiver under this section only if the 22 
applicant: 23 
 
 (1) pays any registration fee that the local jurisdiction requires; and 24 
 
 (2) provides adequate evidence that the applicant: 25 
 
 (i) is licensed as an electrician OR A LIMITED ENERGY 26 
CONTRACTOR OR A LIMI TED ENERGY INTEGRATO R under this title; 27 
 
 (ii) holds an active State license; and 28 
 
 (iii) in place of any bond requirement of a local jurisdiction, meets the 29 
insurance requirements of § 6–604 of this subtitle. 30  16 	HOUSE BILL 895  
 
 
 
 (c) Within 10 working days after payment of any local registration fee, a local 1 
jurisdiction shall issue a local registration to each applicant who meets the requirements 2 
of this section. 3 
 
6–603. 4 
 
 (a) An electrician OR LIMITED ENERGY CO NTRACTOR OR LIMITED ENERGY 5 
INTEGRATOR may obtain an electrical permit or any other similar permit from a local 6 
jurisdiction, if the electrician OR LIMITED ENERGY CO NTRACTOR OR LIMITED ENERGY 7 
INTEGRATOR : 8 
 
 (1) (i) holds a State license; and 9 
 
 (ii) is actively registered locally, if required; 10 
 
 (2) shows proof of the State license; 11 
 
 (3) pays any permit fee that the local jurisdiction requires; and 12 
 
 (4) provides proof of insurance in compliance with the requirements of §  13 
6–604 of this subtitle. 14 
 
 (b) Before a local jurisdiction issues an electrical permit or similar permit to an 15 
electrician OR A LIMITED ENERGY CONTRACTOR OR A LIMI TED ENERGY INTEGRATO R 16 
under this section, the local jurisdiction shall give the electrician OR LIMITED E NERGY 17 
CONTRACTOR OR LIMITE D ENERGY INTEGRATOR notice of any local electrical 18 
requirements with which the electrician OR LIMITED ENERGY CO NTRACTOR OR 19 
LIMITED ENERGY INTEG RATOR shall comply while providing electrical services OR 20 
LIMITED ENERGY SERVI CES in that local jurisdiction. 21 
 
 (c) (1) Except as provided in paragraph (2) of this subsection, on payment of 22 
the permit fee that the local jurisdiction requires, the local jurisdiction shall issue the 23 
appropriate permit to each applicant who meets the requirements of this section. 24 
 
 (2) A local jurisdiction may delay the issuance of an electrical permit under 25 
this subsection if, for a particular job, the local jurisdiction requires the issuance of other 26 
permits, including a building permit, before issuance of the electrical permit. 27 
 
6–604. 28 
 
 (a) This section does not apply to a State licensee on inactive status. 29 
 
 (b) A master electrician, LIMITED ENERGY CONTR ACTOR, OR LIMITED 30 
ENERGY INTEGRATOR who is licensed by the State Board and provides electrical services 31 
OR LIMITED ENERGY SE RVICES or a person to whom a master electrician, LIMITED 32   	HOUSE BILL 895 	17 
 
 
ENERGY CONTRACTOR , OR LIMITED ENERGY IN TEGRATOR licensed by the State Board 1 
assigns a local registration under this title shall: 2 
 
 (1) maintain general liability insurance in the amount of at least $300,000; 3 
 
 (2) maintain property damage insurance in the amount of at least 4 
$100,000; and 5 
 
 (3) submit proof of the required insurance to the State Board. 6 
 
 (c) (1) An applicant for a State license shall submit proof of the insurance 7 
required under this section to the State Board with the license application. 8 
 
 (2) The State Board may not issue a State license to an applicant to whom 9 
the insurance requirements of this section would apply unless the applicant submits proof 10 
of the insurance. 11 
 
 (d) Unless an applicant meets the insurance requirements of this section, the 12 
State Board may not renew a State license of the applicant to whom the insurance 13 
requirements of this section would apply. 14 
 
 (e) If the insurance required under this section is canceled, the insurer shall 15 
notify the State Board within 10 days after the date of cancellation. 16 
 
 (f) If a local jurisdiction requires an applicant for a local license to execute a bond 17 
to the local jurisdiction, the applicant may satisfy the bond requirement by submitting proof 18 
of the insurance required under this section. 19 
 
6–605. 20 
 
 (a) Except as otherwise provided in this title, a person may not employ an 21 
individual to provide electrical services OR LIMITED ENERGY SE RVICES or employ an 22 
individual to assist in providing electrical services OR LIMITED ENERGY SE RVICES unless 23 
the individual: 24 
 
 (1) is licensed by the State Board as a master electrician; 25 
 
 (2) (i) is licensed by the State Board as a journeyperson electrician; and 26 
 
 (ii) provides or assists in providing electrical services within the 27 
scope of the individual’s license; [or] 28 
 
 (3) (i) is licensed by the State Board as an apprentice electrician; and 29 
 
 (ii) provides or assists in providing electrical services within the 30 
scope of the individual’s license;  31

 (4) (I) IS LICENSED BY THE STATE BOARD AS A LIMITED EN ERGY 1 
CONTRACTOR ; AND 2 
 
 (II) PROVIDES OR ASSISTS IN PROVIDING LIMITED ENERGY 3 
SERVICES WITHIN THE SCOPE OF THE INDIVID UAL’S LICENSE; OR 4 
 
 (5) (I) IS LICENSED BY THE STATE BOARD AS A LIMITED EN ERGY 5 
INTEGRATOR ; AND 6 
 
 (II) PROVIDES OR ASSISTS IN PROVIDING LIMITED ENERGY 7 
SERVICES WITHIN THE SCOPE OF THE INDIVID UAL’S LICENSE. 8 
 
 (b) At least one licensed master electrician or journeyperson electrician shall be 9 
present at each job site in which electrical services are provided. 10 
 
6–606. 11 
 
 (a) A master electrician, LIMITED ENERGY CONTR ACTOR, OR LIMITED 12 
ENERGY INTEGRATOR shall display the master electrician’s, LIMITED ENERGY 13 
CONTRACTOR ’S, OR LIMITED ENERGY IN TEGRATOR’S license and the license number 14 
conspicuously in the principal place of business of the master electrician, LIMITED 15 
ENERGY CONTRACTOR , OR LIMITED ENERGY IN TEGRATOR. 16 
 
 (b) Each electrician, LIMITED ENERGY CONTR ACTOR, OR LIMITED ENERGY 17 
INTEGRATOR advertisement in the name of a person who engages in the business of 18 
providing electrical services OR LIMITED ENERGY SE RVICES shall contain the license 19 
number and name of a master electrician or holder of a journeyperson electrician, LIMITED 20 
ENERGY CONTRACTOR , OR LIMITED ENERGY I NTEGRATOR license whom the master 21 
electrician, LIMITED ENERGY CONTR ACTOR, OR LIMITED ENERGY IN TEGRATOR 22 
employs and designates to direct and control the provision of electrical services OR 23 
LIMITED ENERGY SERVI CES through the business of the person. 24 
 
 (c) A licensee shall give the State Board written notice of any change of name, 25 
address, or employment from what appears on the current license at least 10 working days 26 
before the change is to take effect. 27 
 
6–607. 28 
 
 Except as otherwise provided in this title, an individual may not: 29 
 
 (1) provide, attempt to provide, or offer to provide electrical services OR 30 
LIMITED ENERGY SERVI CES for compensation in the State without an appropriate license 31 
issued under this title; 32

 (2) assist, attempt to assist, or offer to assist in providing electrical services 1 
OR LIMITED ENERGY SE RVICES for compensation in the State without the required 2 
license or appropriate registration issued under this title; 3 
 
 (3) provide electrical services OR LIMITED ENERGY SERVI CES for 4 
compensation without obtaining a permit for such services if required by a local 5 
jurisdiction; or 6 
 
 (4) provide electrical services OR LIMITED ENERGY SE RVICES beyond the 7 
scope of the license issued to the individual under this title. 8 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 9 
1, 2023. 10
