AN ACT concerning 1 
 
Frederick County – Alcoholic Beverages – Miniature Golf Course License 2 
 
FOR the purpose of authorizing the Board of License Commissioners for Frederick County 3 
to issue a Class B–MGC (miniature golf course) license to a miniature golf course 4 
under certain circumstances; authorizing a license holder to sell beer, wine, and 5 
liquor for on–premises consumption under certain circumstances; requiring a license 6 
holder to submit a certain report to the Board before a license may be renewed; and 7 
generally relating to alcoholic beverages licenses in Frederick County.  8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 3 
That Section(s) 20–1009.2 of Article – Alcoholic Beverages of the Annotated Code of 4 
Maryland be renumbered to be Section(s) 20–1009.3. 5 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 6 
as follows: 7

 (A) THERE IS A CLASS B–MGC (MINIATURE GOLF COURS E) BEER, WINE, 12 
AND LIQUOR LICENSE. 13 
 
 (B) THE BOARD MAY ISSUE THE L ICENSE FOR USE BY A MINIATURE GOLF 14 
COURSE THAT : 15 
 
 (1) IS OPEN TO THE PUBLIC ; 16 
 
 (2) HAS A MINIATURE COUR SE OF AT LEAST 18 HOLES; AND 17 
 
 (3) HAS ACCOMMODATIONS THAT ARE PREDOMINA NTLY DEDICATED 18 
TO MINIATURE GOLF . 19 
 
 (C) AN APPLICANT FOR A CLASS B–MGC (MINIATURE GOLF COURS E) BEER, 20 
WINE, AND LIQUOR LICENSE SHALL SUBMIT TO THE BOARD A FLOOR PLAN OR 21 
LAYOUT OF THE PROPOS ED LICENSED PREMISES THAT ILLUSTRATES THAT THE 22 
PROPOSED LICENSED PREMISES IS PREDOMINANTLY DEDICATED TO MINIATU RE 23 
GOLF. 24 
 
 (D) THE LICENSE HOLDER MA Y SELL BEER , WINE, AND LIQUOR FOR 25 
ON–PREMISES CONSUMPTION : 26 
 
 (1) IF THE LICENSE HOLDE R OFFERS FOOD ON –PREMISES AT ALL 27 
TIMES WHEN ALCOHOLIC BEVERAGES ARE BEING SOLD; AND 28 
 
 (2) DURING NORMAL BUSINE SS HOURS AND IN ACCO RDANCE WITH § 29

 (E) (1) THE LICENSE HOLDER ’S ANNUAL SALES FROM : 1 
 
 (I) ALCOHOL IC BEVERAGES MAY NOT EXCEED 35% OF THE 2 
ANNUAL GROSS SALES OF THE MINIATURE GOL F COURSE; 3 
 
 (II) MINIATURE GOLF GAMES SHALL BE A T LEAST 50% OF THE 4 
ANNUAL GROSS SALES O F THE MINIATURE GOLF COURSE; AND 5 
 
 (III) FOOD SHALL BE AT LEAST 15% OF THE ANNUAL GROSS 6 
SALES OF THE MINIATURE GOL F COURSE. 7 
 
 (2) BEFORE THE BOARD MAY RENEW A CLASS B–MGC (MINIATURE 8 
GOLF COURSE ) BEER, WINE, AND LIQUOR LICENSE, THE LICENSE HOLDER S HALL 9 
PROVIDE THE BOARD WITH AN ANNUAL GROSS SALES REPORT F OR ALCOHOL, 10 
MINIATURE GOLF GAMES , AND FOOD THAT SHOWS THE LICEN SE HOLDER HAS MET 11 
THE REQUIREMENTS OF PARAGRAPH (1) OF THIS SUBSECTION . 12 
 
 (F) THE ANNUAL LICENSE FEE IS $1,500. 13 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 14 
1, 2023. 15
