[Brackets] indicate matter deleted from existing law. *sb0104* SENATE BILL 104 K3, C8 3lr0650 SB 926/22 – FIN (PRE–FILED) By: Senator Augustine Requested: October 31, 2022 Introduced and read first time: January 11, 2023 Assigned to: Finance A BILL ENTITLED AN ACT concerning 1 Labor and Employment – Apprenticeships and Representation on the 2 Apprenticeship and Training Council 3 FOR the purpose of requiring that the Apprenticeship and Training Council and 4 consultants to the Council include representation by individuals who are Black and 5 Latino; establishing the Apprenticeship 2030 Commission to examine and make 6 recommendations to expand access to apprenticeship to reduce skill shortages in 7 high–demand occupations and provide affordable training for career pathways for 8 young people in the public and private sectors; requiring the Governor to include 9 certain amounts in certain fiscal years in the annual budget bill for a certain purpose; 10 and generally relating to apprenticeships and representation on the Apprenticeship 11 and Training Council. 12 BY repealing and reenacting, with amendments, 13 Article – Labor and Employment 14 Section 11–403(b) 15 Annotated Code of Maryland 16 (2016 Replacement Volume and 2022 Supplement) 17 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 That the Laws of Maryland read as follows: 19 Article – Labor and Employment 20 11–403. 21 (b) (1) There is an Apprenticeship and Training Council as part of the Division 22 of Workforce Development and Adult Learning. The Council consists of 12 members all of 23 whom shall be appointed by the Governor of Maryland, with the advice of the Secretary 24 and with the advice and consent of the Senate of Maryland. 25 2 SENATE BILL 104 (2) Four of the members shall be representativ es of employee 1 organizations; one shall be an employee; five shall be representatives of employers; and two 2 shall be appointed from the general public. 3 (3) (I) The membership of the Council shall, to the extent practicable, 4 reflect the geographic, racial, ethnic, cultural, and gender diversity of the State and shall 5 include representation by individuals with disabilities AND INDIVIDUALS WHO ARE 6 BLACK AND LATINO. 7 (II) Consultants to the Council shall, to the extent practicable, reflect 8 the geographic, racial, ethnic, cultural, and gender diversity of the State and shall include 9 representation by individuals with disabilities AND INDIVIDUALS WHO ARE BLACK AND 10 LATINO. 11 (4) In advising the Governor, the Secretary shall give consideration to a 12 balanced geographic representation from all of Maryland and a representative sampling 13 and mix of Maryland industry. 14 (5) One member shall be appointed as Chairman by the Governor, with the 15 advice of the Secretary, and serve as Chairman at the pleasure of the Governor. The 16 Assistant State Superintendent, Career and Technology Education, and the Maryland 17 State Director of the Office of Apprenticeship, U.S. Department of Labor, shall serve as 18 consultants to the Council without vote. 19 (6) The Governor, with the advice of the Secretary may appoint up to three 20 additional consultants to the Council from the public at large. 21 SECTION 2. AND BE IT FURTHER ENACTED, That: 22 (a) (1) There is an Apprenticeship 2030 Commission. 23 (2) The purpose of the Commission is to e xamine and make 24 recommendations to reduce skill shortages in high–demand occupations and provide 25 affordable training for career pathways for young people in the public and private sectors. 26 (b) The Commission consists of: 27 (1) two representatives each from the Public Safety Apprenticeship 28 Workgroup, the Healthcare Apprenticeship Workgroup, and the Transportation 29 Apprenticeship Workgroup established in the Maryland Department of Labor, as directed 30 by the 2022 Joint Chairmen’s Report; 31 (2) the Chair of the Apprenticeship and Training Council, or the Chair’s 32 designee; and 33 SENATE BILL 104 3 (3) the Chair of the Career and Technical Education Committee, or the 1 Chair’s designee. 2 (c) The chair of the Commission shall be elected by the members of the 3 Commission. 4 (d) The Department of Legislative Services, with the assistance of staff from the 5 State agencies represented on the workgroups described in subsection (b)(1) of this section, 6 shall provide staff for the Commission. 7 (e) A member of the Commission: 8 (1) may not receive compensation as a member of the Commission; but 9 (2) is entitled to reimbursement for expenses under the Standard State 10 Travel Regulations, as provided in the State budget. 11 (f) The Commission shall: 12 (1) review the work of the individual workgroups described in subsection 13 (b)(1) of this section; 14 (2) make preliminary recommendations regarding funding needed to 15 expand public and private sector apprenticeship pathways; and 16 (3) work with any consultants contracted by the Department of Legislative 17 Services as required by the fiscal year 2024 operating budget to examine national and 18 international best practices. 19 (g) On or before December 1, 2024, the Commission shall report its findings and 20 recommendations to the Governor and, in accordance with § 2–1257 of the State 21 Government Article, the General Assembly. 22 (h) It is the intent of the General Assembly that in the event of a conflict between 23 a decision or policy of the Apprenticeship 2030 Commission and the Career and Technical 24 Education Committee established under § 21–209 of the Education Article related to youth 25 apprenticeships, the Career and Technical Education Committee’s decision or policy shall 26 control. 27 SECTION 3. AND BE IT FURTHER ENACTED, That, for each of fiscal years 2025 28 through 2027, the Governor shall include in the annual budget bill an appropriation in the 29 following amounts to the County Executive and County Council of Prince George’s County 30 to award grants to a nonprofit entity located in Prince George’s County to provide workforce 31 development services to at least 2,000 youth and adults in the community: 32 (1) for fiscal year 2025, $1,030,030; 33 4 SENATE BILL 104 (2) for fiscal year 2026, $1,106,996; and 1 (3) for fiscal year 2027, $1,119,482. 2 SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect 3 October 1, 2023. Section 2 of this Act shall remain effective for a period of 1 year and 9 4 months and, at the end of June 30, 2025, Section 2 of this Act, with no further action 5 required by the General Assembly, shall be abrogated and of no further force and effect. 6
