[Brackets] indicate matter deleted from existing law. *sb0356* SENATE BILL 356 R2 3lr2220 By: Senator Beidle Introduced and read first time: January 30, 2023 Assigned to: Finance A BILL ENTITLED AN ACT concerning 1 Transportation – Citizens Committee for the Enhancement of Communities 2 Surrounding BWI Thurgood Marshall Airport – Modification 3 FOR the purpose of altering the duties of the Citizens Committee for the Enhancement of 4 Communities Surrounding B altimore–Washington International Thurgood 5 Marshall Airport to include the development and advancement of additional 6 categories of projects; increasing the amount in the annual budget for the State 7 Department of Transportation designated by the State Secretary of Transportation 8 for certain grants; and generally relating to the Citizens Committee for the 9 Enhancement of Communities Surrounding Baltimore–Washington International 10 Thurgood Marshall Airport. 11 BY repealing and reenacting, with amendments, 12 Article – Transportation 13 Section 5–414 14 Annotated Code of Maryland 15 (2020 Replacement Volume and 2022 Supplement) 16 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17 That the Laws of Maryland read as follows: 18 Article – Transportation 19 5–414. 20 (a) There is a Citizens Committee for the Enhancement of Communities 21 Surrounding Baltimore–Washington International Thurgood Marshall Airport. 22 (b) (1) The Citizens Committee consists of 11 members who are appointed by 23 the Secretary after recommendation by the members of the legislative delegation from 24 legislative districts 12, 13, and 32 as follows: 25 2 SENATE BILL 356 (i) Two members of the Citizens Committee shall be recommended 1 by each of the delegates representing district 32; 2 (ii) One member of the Citizens Committee shall be recommended 3 by the delegates representing district 12; 4 (iii) One member of the Citizens Committee shall be recommended 5 by the delegates representing district 13; and 6 (iv) Three members of the Citizens Committee shall be recommended 7 by the senator representing district 32. 8 (2) The members shall be representatives of community associations that 9 are either wholly or partially situated: 10 (i) In the certified noise zone that was adopted under § 5–806 of this 11 title and effective March 23, 1998, for Baltimore–Washington International Thurgood 12 Marshall Airport; or 13 (ii) In a border extending 2 miles outside of the certified noise zone. 14 (c) (1) The term of a member of the Citizens Committee is 3 years. 15 (2) The terms of the members are staggered as required by the terms 16 provided for members of the Citizens Committee on October 1, 2001. 17 (3) At the end of a term, a member continues to serve until a successor is 18 appointed. 19 (4) A member who is appointed after a term has begun serves only for the 20 rest of the term and until a successor is appointed. 21 (d) From among the members of the Citizens Committee, the Secretary shall 22 appoint a chairman. 23 (e) (1) The Citizens Committee shall meet regularly at the call of the 24 chairman. 25 (2) The Secretary, or the Secretary’s designee, shall meet with the Citizens 26 Committee at least quarterly. 27 (f) A member of the Citizens Committee may not receive compensation or other 28 reimbursement for expenses. 29 (g) The Citizens Committee shall: 30 SENATE BILL 356 3 (1) Evaluate issues of livability in the communities located in the area 1 described in subsection (b)(2) of this section and the unique impacts on livability in these 2 communities arising from their close proximity to Baltimore–Washington International 3 Thurgood Marshall Airport; 4 (2) (I) Develop projects designed to [address]: 5 1. ADDRESS transportation issues that affect livability in 6 the communities; [and] 7 2. IMPROVE PUBLIC SAFETY; 8 3. IMPROVE THE QUALITY O F LIFE IN SURROUNDING 9 COMMUNITIES ; AND 10 4. IMPROVE EDUCATION ; AND 11 (II) ADVANCE PROJECTS BROUGHT TO THE CITIZENS 12 COMMITTEE BY NONPROFIT ORGANIZATIONS ; AND 13 (3) Make recommendations to the Secretary for the funding of projects 14 designed to address transportation issues that affect livability in the communities AND 15 THE OTHER MATTERS LI STED UNDER ITEM (2) OF THIS SUBSECTION . 16 (h) (1) The Secretary shall consider the recommendations of the Citizens 17 Committee. 18 (2) The Secretary may make grants–in–aid, under § 2–103(i)(2) of this 19 article, to fund transportation related projects recommended by the Citizens Committee. 20 (3) (i) The Secretary shall identify in the annual budget for the 21 Department an amount designated for the grants–in–aid authorized under this subsection. 22 (ii) In making a budget designation under this paragraph, the 23 Secretary shall consider the number of aircraft operations at Baltimore–Washington 24 International Thurgood Marshall Airport for the most recent available calendar year. 25 (iii) A budget amount designated under this paragraph shall include 26 an amount equal to at least [one dollar] $2 for every takeoff and landing of an aircraft that 27 occurs at Baltimore–Washington International Thurgood Marshall Airport for the most 28 recent available calendar year. 29 (i) Staff support for the Citizens Committee shall be provided by the Department. 30 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 31 1, 2023. 32
