A BILL ENTITLED 
 
AN ACT concerning 1 
 
Residential Construction or Significant Renovation – Electric Vehicle Charging 2 
 
FOR the purpose of establishing and altering certain requirements related to the 3 
installation of equipment for the charging of electric vehicles during the construction 4 
or significant renovation of certain housing units; clarifying that a county or 5 
municipal corporation may require a greater number of electric vehicle parking 6 
spaces under certain circumstances; and generally relating to electric vehicle supply 7 
equipment on new residential construction and residential construction undergoing 8 
significant renovation. 9

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 
That the Laws of Maryland read as follows: 16 
 
Article – Public Safety 17 
 
12–205. 18 
 
 (a) (1) In this section the following words have the meanings indicated. 19 
 
 (2) “Electric vehicle” means a vehicle that uses electricity for propulsion. 20 
 
 [(3) “Electric vehicle charging station” means a connected point in an 21 
electrical wiring installation at which current is taken to charge a battery or any other 22 
energy storage device in an electric vehicle.]  23  2 	SENATE BILL 477  
 
 
 
 (3) “ELECTRIC VEHICLE SUPP LY EQUIPMENT ” MEANS A DEVICE OR 1 
FACILITY FOR DELIVER ING ELECTRICITY TO A N ELECTRIC VEHICLE . 2 
 
 (4) “EV–READY PARKING SPACE ” MEANS A DEDICATED PA RKING 3 
SPACE THAT HAS A FUL L CIRCUIT INSTALLATI ON OF A MINIMUM 30–AMPERE, 4 
208/240–VOLT CIRCUIT PANEL C APACITY, RACEWAY WIRING , A NEMA 14–50R 5 
RECEPTACLE , AND CIRCUIT OVERPROT ECTION DEVICES . 6 
 
 (5) “EVSE–INSTALLED PARKING SP ACE” MEANS A DEDICATED 7 
PARKING SPACE WITH E LECTRIC VEHICLE SUPP LY EQUIPMENT THAT IS FULLY 8 
INSTALLED FROM THE E LECTRICAL PANEL TO T HE PARKING SPACE . 9 
 
 (6) “HOUSING UNITS” INCLUDES:  10 
 
 (I) SINGLE–FAMILY DETACHED HOUS ES; 11 
 
 (II) TOWN HOUSES ; AND 12 
 
 (III) MULTIFAMILY RESIDENT IAL BUILDINGS. 13 
 
 [(4)] (7) “Level 2 charging” means that the charging capability of the 14 
electric vehicle [charging station] SUPPLY EQUIPMENT : 15 
 
 (i) includes the ability to charge a battery or any other energy 16 
storage device in an electric vehicle through means of an alternating current electrical 17 
service with a minimum of 208 volts; and 18 
 
 (ii) meets applicable industry safety standards. 19 
 
 (8) “SIGNIFICANT RENOVATIO N” MEANS ANY RENOVATION S TO A 20 
HOUSING UNIT THAT IN CLUDE ELECTRIC PANEL UPGRADES THAT INCREA SE 21 
CAPACITY OF THE PANE L OR PARKING UPGRADES THAT INVOLVE TRENCHI NG IN OR 22 
AROUND PARKING SPACE S. 23 
 
 [(5)] (9) “Vehicle” has the meaning stated in § 11 –176 of the 24 
Transportation Article. 25 
 
 (b) This section applies only to: 26 
 
 (1) the construction of new housing units[, including: 27 
 
 (1) single–family detached homes; and 28

 (2) town houses]; AND 1 
 
 (2) THE SIGNIFICANT RENO VATION OF EXISTING H OUSING UNITS. 2 
 
 (c) If the construction of one or more new housing units will include at least one 3 
garage, carport, or driveway for each housing unit[, the builder or the builder’s agent shall 4 
provide each buyer or prospective buyer with the option to] OR IF AN EXISTING HO USING 5 
UNIT THAT INCLUDES A GARAGE, CARPORT, OR DRIVEWAY IS UNDER GOING 6 
SIGNIFICANT RENOVATI ON, THE CONSTRUCTION OR RENOVATION SH ALL include in 7 
or on [the] EACH garage, carport, or driveway: 8 
 
 (1) [an electric vehicle charging station] ONE EVSE–INSTALLED 9 
PARKING SPACE capable of providing at least Level 2 charging; or 10 
 
 [(2) a dedicated electric line of sufficient voltage to support the later 11 
addition of an electric vehicle charging station capable of providing at least Level 2 12 
charging.] 13 
 
 (2) ONE EV–READY PARKING SPACE . 14 
 
 [(d) The builder or builder’s agent shall give to each buyer or prospective buyer: 15 
 
 (1) notice of the options listed in subsection (c) of this section; and 16 
 
 (2) specific information about any available rebate programs related to the 17 
purchase or installation of electric vehicle charging stations.] 18 
 
 (D) (1) (I) IF THE CONSTRUCTION O F NEW TOWN HOUSES AN D 19 
MULTIFAMILY RESIDENT IAL BUILDINGS WILL N OT INCLUDE AT LEAST ONE GARAGE, 20 
CARPORT, OR DRIVEWAY FOR EACH RESIDENTIAL UNIT BUT WILL INCLUDE 21 
OFF–STREET COMMUNAL PARK ING, THE CONSTRUCTION SHA LL INCLUDE AT LEAST 22 
ONE COMMUNAL PARKING SPACE FOR EACH 25 RESIDENTIAL UNITS FEATURING AN 23 
EVSE–INSTALLED PARKING SP ACE CAPABLE OF PROVI DING AT LEAST LEVEL 2 24 
CHARGING. 25 
 
 (II) EACH COMMUNAL EVSE–INSTALLED PARKING SP ACE 26 
SHALL BE MARKED AS I NTENDED FOR ELECTRIC VEHICLE CHARGING ONL Y. 27 
 
 (2) NOTWITHSTANDING ANY O THER LAW, A COUNTY OR MUNICIPAL 28 
CORPORATION MAY REQU IRE THE CONSTRUCTION OF NEW TOWN HOUSES A ND 29 
MULTIFAMILY RESIDENT IAL BUILDINGS THAT W ILL NOT INCLUDE AT L EAST ONE 30 
GARAGE, CARPORT, OR DRIVEWAY FOR EACH RESIDENTIAL UNIT BUT WILL INCLUDE 31 
OFF–STREET COMMUNAL PARK ING TO INC LUDE A GREATER NUMBE R OF  32 
EVSE–INSTALLED PARKING SP ACES THAN ARE REQUIR ED UNDER PARAGRAPH (1) 33  4 	SENATE BILL 477  
 
 
OF THIS SUBSECTION . 1 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 2 
apply only prospectively and may not be applied or interpreted to have any effect on or 3 
application to any new construction or significant renovation for which a building permit 4 
is issued before the effective date of this Act. 5 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 6 
October 1, 2023. 7
