Maryland Corps Program. 31 10 SENATE BILL 551 21–201. 1 (a) In this [part] SUBTITLE the following words have the meanings indicated. 2 (b) “ADVISORY Board” means the MARYLAND CORPS PROGRAM ADVISORY 3 Board [of Directors of the Program]. 4 (c) “Corps participant” means an individual who participates in the Program. 5 (D) “DEPARTMENT ” MEANS THE DEPARTMENT OF SERVICE AND CIVIC 6 INNOVATION. 7 (E) “MSY PATHWAY” MEANS THE MARYLAND SERVICE YEAR OPTION 8 PATHWAY. 9 [(d)] (F) “MSY PATHWAY Fund” means the Maryland [Corps Program] 10 SERVICE YEAR OPTION PATHWAY Fund. 11 [(e)] (G) “Participating organization” means a BUSINESS, nonprofit 12 organization, or government agency that: 13 (1) has a focus on community or other service, service learning, 14 volunteerism, or other activities or experiences with a similar mission; 15 (2) hosts a program participant in a service role; and 16 (3) complies with Title VI of the Civil Rights Act of 1964, as amended, and 17 Title 20, Subtitle 6 of this article. 18 [(f)] (H) “Program” means the Maryland Corps Program. 19 [(g)] (I) “Wraparound services” includes: 20 (1) child care; 21 (2) transportation; 22 (3) housing; 23 (4) [mental] BEHAVIORAL health; 24 (5) crisis intervention; 25 (6) substance abuse prevention or treatment; 26 SENATE BILL 551 11 (7) legal aid; 1 (8) financial literacy programming; 2 (9) job search and application support; and 3 (10) college application support. 4 (J) “YA PATHWAY” MEANS THE YOUNG ADULT SERVICE YEAR OPTION 5 PATHWAY. 6 (K) “YA PATHWAY FUND” MEANS THE YOUNG ADULT SERVICE YEAR 7 OPTION PATHWAY FUND. 8 21–202. 9 (a) (1) There is a Maryland Corps Program in the State administered and 10 managed by the [Board] DEPARTMENT . 11 (2) THE PROGRAM HAS TWO PATHW AYS: 12 (I) THE YOUNG ADULT SERVICE YEAR OPTION PATHWAY; AND 13 (II) THE MARYLAND SERVICE YEAR OPTION PATHWAY. 14 (b) [(1) Except as provided in paragraph (2) of this subsection, the Program is 15 exempt from Division II of the State Finance and Procurement Article. 16 (2)] The Program is subject to Title 14, Subtitle 3 of the State Finance and 17 Procurement Article. 18 (c) The purpose of the Program is to: 19 (1) provide meaningful service opportunities to CORPS participants that 20 will address the social needs of the community; 21 (2) equip corps participants with the skills that will enable them to 22 successfully make the transition from high school to an institution of higher education or 23 to the workforce; and 24 (3) provide [scholarships] PROGRAM COMPLETION AW ARDS to corps 25 participants who have completed the Program [to be used at institutions of higher 26 education toward vocational certificates, associate’s degrees, or bachelor’s degrees]. 27 (d) The Program is subject to review under § 2–1220 of this article. 28 12 SENATE BILL 551 21–203. 1 (a) [(1) A Board of Directors shall administer and manage the Program. 2 (2) The Board is a body politic and corporate and is an instrumentality of 3 the State. 4 (b)] (1) THERE IS A MARYLAND CORPS PROGRAM ADVISORY BOARD. 5 (2) The ADVISORY Board consists of the following members: 6 [(1)] (I) a Board Chair, [jointly] appointed by the [President of the 7 Senate and the Speaker of the House] GOVERNOR; 8 [(2)] (II) two members jointly appointed by the President of the Senate 9 and the Speaker of the House: 10 [(i)] 1. one of whom must represent a service organization in the 11 State; and 12 [(ii)] 2. one of whom shall be: 13 [1.] A. a current participant in a public service program; or 14 [2.] B. a former participant in a public service program 15 whose participation ended during the preceding 3 years; 16 [(3)] (III) one member appointed by the President of the Senate; 17 [(4)] (IV) one member appointed by the Speaker of the House; and 18 [(5)] (V) [two] FOUR members appointed by the Governor, one of whom 19 shall be a representative from the [Governor’s Office of Service and Volunteerism] 20 MARYLAND STATE SERVICE COMMISSION. 21 [(c)] (B) In making appointments to the ADVISORY Board, the President, 22 Speaker, and Governor shall consider: 23 (1) the professional or personal experience of the individual in community 24 or other service, nonprofit management, civic engagement, or volunteerism; [and] 25 (2) the cultural, geographic, racial, ethnic, and gender diversity of the 26 State; AND 27 SENATE BILL 551 13 (3) AN INDIVIDUAL’S EXPERIENCE AND KNO WLEDGE IN WORKFORCE 1 DEVELOPMENT , INCLUDING REGIONAL W ORKFORCE NEEDS , TRAINING, CAREER 2 DEVELOPMENT PROGRAMM ING, AND WORKFORCE INVEST MENT BOARDS . 3 [(d)] (C) A member of the ADVISORY Board: 4 (1) may not receive compensation as a member of the ADVISORY Board; 5 but 6 (2) is entitled to reimbursement for expenses under the Standard State 7 Travel Regulations, as provided in the State budget. 8 [(e)] (D) (1) The term of a member of the ADVISORY Board is 4 years. 9 (2) The terms of the members are staggered as required by the terms 10 provided for members on June 1, [2022] 2023. 11 (3) A MEMBER MAY BE REAPPO INTED BUT MAY NOT SE RVE MORE 12 THAN TWO CONSECUTIVE FULL TERMS. 13 [(3)] (4) At the end of a term, a member continues to serve until a 14 successor is appointed and qualifies. 15 [(f)] (E) (1) A member appointed by the President may be removed by the 16 President for the reasons stated in paragraph (5) of this subsection. 17 (2) A member appointed by the Speaker may be removed by the Speaker 18 for the reasons stated in paragraph (5) of this subsection. 19 (3) A member appointed by the Governor may be removed by the Governor 20 for the reasons stated in paragraph (5) of this subsection. 21 (4) The ADVISORY Board Chair may be removed [jointly by the President 22 and the Speaker] BY THE GOVERNOR for the reasons stated in paragraph (5) of this 23 subsection. 24 (5) A member of the ADVISORY Board may be removed for: 25 (i) incompetence; 11 (II) RECRUITING CORPS PAR TICIPANTS; 12 (III) SEEKING GIFTS OR GRA NTS AND OTHER FINANC IAL 13 RESOURCES FOR THE BE NEFIT OF THE PROGRAM; AND 14 (IV) MAINTAINING RELATION SHIPS WITH CURRENT A ND 15 FORMER CO RPS PARTICIPANTS ; 16 (2) ADVISE THE DEPARTMENT ON BEST PR ACTICES FOR SERVICE AND 17 VOLUNTEERISM ; 18 (3) PROVIDE OVERSIGHT OF THE DESIGN , DEVELOPMENT , 19 IMPLEMENTATION , OPERATION, AND EXPANSION OF THE PROGRAM; 20 (4) PARTICIPATE IN PROGRAM–SPONSORED EVENTS ; AND 21 (5) ANY OTHER DUTIES AS DETERMINED BY THE DEPARTMENT . 22 [21–204. 23 (a) (1) The Board shall appoint an Executive Director. 24 (2) The Executive Director serves at the pleasure of the Board. 25 (3) The Board shall determine the salary of the Executive Director. 26 (b) (1) The Executive Director is the chief administrative officer of the 27 Program. 28 SENATE BILL 551 15 (2) The Executive Director shall manage the administrative affairs and 1 technical activities of the Program in accordance with the policies and procedures that the 2 Board establishes. 3 (c) (1) The Board may employ a staff in accordance with its budget. 4 (2) Staff employed under this section are State employees who: 5 (i) are subject to the requirements of Title 5 of the General 6 Provisions Article; and 7 (ii) may participate in the State Retirement and Pension System 8 under Division II of the State Personnel and Pensions Article.] 9 [21–205.] 21–204. 10 (a) THE DEPARTMENT SHALL ADMI NISTER AND MANAGE TH E PROGRAM. 11 (B) The [Board] DEPARTMENT is responsible for expanding service opportunities 12 in the State THROUGH THE PROGRAM with the following goals: 13 (1) creating a strong annual cohort bond of unity for [Program] CORPS 14 participants from urban, rural, and suburban areas of the State; 15 (2) [subject to subsection (d) of this section,] ensuring all [Marylanders] 16 INDIVIDUALS have equitable access to participate in the Program regardless of gender, 17 race, religion, national origin, sexual orientation, gender identity or expression, disability, 18 geography, NATIVE LANGUAGE , or protected veteran status; 19 (3) helping [Program] CORPS participants develop the critical job skills 20 necessary for creating a more equitable society as they serve their communities across the 21 State, using the lens of environmental, social, racial, and economic justice; and 22 (4) ensuring each district of the State can communicate its unique 23 community needs and choose the appropriate solutions. 24 (C) (1) THE DEPARTMENT SHALL ACT AS AN INTERMEDIARY W ITH THE 25 AMERICORPS PROGRAM TO SECURE FEDERAL FUNDI NG AND ALLEVIATE THE 26 ADMINISTRATIVE BURDE N ON STATE ORGANIZATIONS S EEKING TO PARTICIPAT E IN 27 AMERICORPS PROGRAMMING . 28 (2) IN WORKING WITH THE AMERICORPS PROGRAM UNDER 29 PARAGRAPH (1) OF THIS SUBSECTION , THE DEPARTMENT SHALL FOCU S ON 30 EXPANDING THE SERVICE O PPORTUNITIES IN : 31 16 SENATE BILL 551 (I) STATE AND LOCAL PARKS ; 1 (II) PUBLIC AND COMMUNITY HEALTH SECTORS ; AND 2 (III) THE CLEAN AND RENEWA BLE ENERGY SECTOR . 3 [(b)] (D) The [Board] DEPARTMENT shall adopt regulations regarding: 4 (1) selection criteria for regional operating partners with a global view of 5 the needs of the communities in which the regional operating partner works, who will 6 identify and implement placement priorities FOR EACH PROGRAM PATHWAY in 7 consultation with local community partners to expand capacity and create new service 8 programs as needed; 9 (2) eligibility requirements for participating organizations, classified by 10 the [Board] DEPARTMENT based on the number of service [members] PLACEMENTS the 11 organization’s grant will support, as: 12 (i) community employers; or 13 (ii) large–scale employers; 14 (3) prioritizing the placement of [Program] CORPS participants with 15 [large–scale employers] ORGANIZATIONS based on the organization’s demonstrated [need 16 for Program] ABILITY TO TRANSITIO N participants [who will transition] to full–time 17 employment, POSTSECONDARY EDUCAT ION, OR REGISTERED APPREN TICESHIPS 18 following completion of the [Program] SERVICE PLACEMENT ; 19 (4) a centralized process to facilitate efficient screening and placement of 20 [Program] CORPS participants INTO THE APPROPRIATE SERVICE PLACEMENT OF A 21 PROGRAM PATHWAY as well as effective measurement and evaluation of the CORPS 22 participant’s service experience; 23 (5) REASONABLE WORKPLACE ACCOMMODATIONS FOR C ORPS 24 PARTICIPANTS WITH DI SABILITIES; 25 [(5)] (6) stipends for CORPS participants, including: 26 (i) monetary payment of at least $15 per hour OR THE STATE 27 MINIMUM WAGE , WHICHEVER IS GREATER ; 28 (II) health insurance [benefits,] BENEFITS and the potential for 29 wraparound services; and 30 SENATE BILL 551 17 [(ii)] (III) requirements for large–scale employers to provide 1 matching funds; 2 [(6)] (7) [an education] A PROGRAM COMPLETION award of $6,000 for 3 participants that complete at least 9 months of [service,] SERVICE THAT MAY BE 4 AWARDED AS FOLLOWS : 5 (I) [which shall be deposited] BY DEPOSIT into a tax–exempt 6 Maryland 529 account established under Title 18, Subtitle 19 of the Education Article and 7 may only be used for qualified higher education expenses, as defined in § 18–1901 of the 8 Education Article; OR 9 (II) PAYMENT OF A CASH ST IPEND; 10 [(7)] (8) workforce development training and wraparound services 11 provided to [Program] CORPS participants by participating organizations OR STATE 12 AGENCIES; 13 [(8)] (9) additional training and support services provided to [Program] 14 CORPS participants after the completion of the CORPS participant’s service; 15 [(9)] (10) ongoing evaluation of opportunities to expand service in the 16 State to address the State’s workforce development needs, including opportunities within 17 State agencies for the creation and expansion of service opportunities within the agencies; 18 and 19 [(10)] (11) ongoing evaluation of the Program to ensure access and 20 effectiveness, including: 21 (i) demographics of corps participants, including race, ethnicity, 22 age, SEX, GENDER, education, and geography; 23 (II) WHETHER PROGRAM PATHWAYS ARE FACILITATING ENTRY 24 INTO PUBLIC SECTOR W ORKFORCE POSITIONS ; 25 [(ii)] (III) post–Program trajectories of corps participants; and 26 [(iii)] (IV) an evaluation of the needs served in the community by the 27 Program. 28 [(c) The Board may: 29 (1) Sue and be sued; 30 (2) Adopt a seal; 31 18 SENATE BILL 551 (3) Acquire, hold, and dispose of property for its corporate purposes; 1 (4) Sell, lease, or otherwise convey, in any manner that the Board considers 2 appropriate, any property it owns to accomplish the purposes of this subtitle; 3 (5) Enter into contracts and leases and execute any instrument necessary 4 or convenient, on the terms and for any corporate purpose that the Board considers 5 advisable; 6 (6) Use any other money available under this subtitle or any grant or 7 money from the State or federal government or any of their units or instrumentalities to 8 accomplish the purposes of this subtitle; 9 (7) Borrow money for a corporate purpose and mortgage or otherwise 10 encumber its property as security for the loan; 11 (8) Accept gifts, contributions, or loans of money, supplies, goods, and 12 services, and accept appropriations, allotments, and loans of money from the State or 13 federal government, a federal corporation, a unit or instrumentality of the federal 14 government, or a political subdivision or instrumentality of the State; 15 (9) Exercise a power usually possessed by a private corporation in 16 performing similar functions unless to do so would conflict with State law; and 17 (10) Do all things necessary or convenient to carry out the powers expressly 18 granted by this subtitle.] 19 21–205. 20 (A) (1) THERE IS A YOUNG ADULT SERVICE YEAR OPTION PATHWAY IN 21 THE PROGRAM. 22 (2) THE PURPOSE OF THE YOUNG ADULT SERVICE YEAR OPTION 23 PATHWAY IS TO: 24 (I) PROVIDE SERVICE PLAC EMENTS TO ELIGIBLE Y OUNG 25 ADULTS AS AN ADDITIO NAL OPTION TO IMMEDI ATELY PURSUING POSTS ECONDARY 26 EDUCATION OR CAREER AND TECHNICAL TRA INING; 27 (II) EQUIP CORPS PARTICIP ANTS WITH PROFESSION AL 28 DEVELOPMENT , MENTORING , JOB TRAINING , FINANCIAL LITERACY S KILLS, AND 29 OTHER SUPPORTS WHILE WORKING IN HIGH –IMPACT SERVICE PLACE MENTS; 30 SENATE BILL 551 19 (III) ASSIST IN ADDRESSING THE STATE’S GREATEST 1 CHALLENGES B Y CHANNELING THE NEX T GENERATION OF MARYLAND CITIZENS 2 INTO IMPACTFUL PUBLI C SERVICE; AND 3 (IV) STRENGTHEN A PIPELIN E OF TALENT INTO STATE AND 4 LOCAL GOVERNMENTS TO FILL PRESENT AND FUT URE STAFFING NEEDS . 5 (B) AN INDIVIDUAL MAY APP LY TO THE DEPARTMENT FO R A SERVICE 6 PLACEMENT IN THE YA PATHWAY UNDER THIS SE CTION IF THE INDIVID UAL IS: 7 (1) A MARYLAND RESIDENT ON SUBMISSION OF APPLIC ATION; AND 8 (2) WITHIN 3 YEARS OF GRADUATION FROM HIGH SCHOOL OR HAVING 9 OBTAINED A SIMILAR L EVEL OF EDUCATION CO MPLETION, INCLUDING AN 10 INDIVIDUAL WHO HAS O BTAINED A: 11 (I) MARYLAND HIGH SCHOOL DIPLOMA; 12 (II) MARYLAND HIGH SCHOOL DIPLOMA BY EXAMINATI ON; OR 13 (III) MARYLAND HIGH SCHOOL CERTIFICATE OF PROGRAM 14 COMPLETION. 15 (C) (1) THE DEPARTMENT SHALL SET TARGETS FOR PARTICIPATION IN 16 THE YA PATHWAY UNDER THIS SE CTION, INCLUDING: 17 (I) 200 CORPS PARTICIPANTS I N THE FIRST YEAR OF 18 IMPLEMENTATION ; AND 19 (II) 2,000 CORPS PARTICIPANTS I N THE FOURTH YEAR OF 20 IMPLEMENTATION . 21 [(d)] (2) The [Board] DEPARTMENT shall prioritize for participation in the 22 [Program] YA PATHWAY UNDER THIS SE CTION: 23 (I) individuals historically underrepresented in: 24 [(1)] 1. higher education enrollment or completion; or 25 [(2)] 2. employment [by]: 26 [(i)] A. BY large–scale and community employers; [or] 27 [(ii)] B. BY participating organizations; OR 28 20 SENATE BILL 551 C. IN PROFESSIONS AND O CCUPATIONS THAT REQU IRE 1 LICENSURE OR CERTIFI CATION; AND 2 (II) ORGANIZATIONS THAT P ROVIDE WRAPAROUND SE RVICES 3 TO CORPS PARTICIPANT S. 4 (D) THE DEPARTMENT SHALL DEVE LOP FOCUS AREAS FOR THE YA 5 PATHWAY UNDER THIS SE CTION FOR THE PURPOS E OF ADDRESSING PRIO RITY 6 STATE AND COMMUNITY I SSUES, INCLUDING: 7 (1) CLIMATE; 8 (2) EDUCATION; AND 9 (3) HEALTH. 10 (E) A CORPS PARTICIPANT WH O RECEIVES A SERVICE PLACEMENT IN THE 11 YA PATHWAY UNDER THIS SE CTION SHALL: 12 (1) PARTICIPATE IN ALL T RAINING RELATED TO T HE SERVICE 13 PLACEMENT ; 14 (2) WORK AT LEAST 30 HOURS PER WEEK ; 15 (3) BE PARTNERED WITH AN ON–SITE MENTOR; 16 (4) PERFORM THE DUTIES O F THE SERVICE PLACEMENT TO THE 17 SATISFACTION OF THE PARTICIPATING ORGANI ZATION AND THE DEPARTMENT ; 18 (5) PARTICIPATE IN PROGRAM–WIDE EVENTS; 19 (6) BE PAID $15 PER HOUR OR THE STATE MINIMUM WAGE , 20 WHICHEVER IS GREATER , FOR MANDATORY WORK H OURS OR MANDATORY 21 PROGRAM ACTIVI TIES; AND 22 (7) ON COMPLETION OF THE PROGRAM, BE NOTIFIED OF ALL 23 AVAILABLE POST –PROGRAM OPPORTUNITIES , INCLUDING REGISTERED 24 APPRENTICESHIPS . 25 (F) THE DEPARTMENT SHALL PROM OTE AND PUBLICIZE TH E AVAILABILITY 26 OF OPPORTUNITIES IN THE YA PATHWAY TO: 27 (1) HIGH SCHOOLS AND ADULT HIGH SCHOOLS IN THE STATE; 28 (2) COMMUNITY AND NONPRO FIT ORGANIZATIONS ; 29 SENATE BILL 551 21 (3) FAITH–BASED INSTITUTIONS ; AND 1 (4) EMPLOYERS THAT ARE P OTENTIAL SERVICE PLA CEMENT 2 PROVIDERS. 3 (G) (1) THERE IS A YOUNG ADULT SERVICE YEAR OPTION PATHWAY 4 FUND. 5 (2) THE PURPOSE OF THE YA PATHWAY FUND IS TO: 6 (I) PROVIDE STIPENDS TO CORPS PARTICIPANTS W ITH A 7 SERVICE PLACEMENT IN THE YA PATHWAY UNDER THIS SE CTION; 8 (II) PAY THE COSTS TO ADM INISTER AND PROMOTE THE YA 9 PATHWAY UNDER THE PROGRAM; AND 10 (III) ASSIST IN THE CREATI ON OF ADDITIONAL COR PS 11 PROGRAMS UNDER § 21–207 OF THIS SUBTITLE. 12 (3) THE DEPARTMENT SHALL ADMI NISTER THE YA PATHWAY FUND. 13 (4) THE YA PATHWAY FUND IS A CONTINUING , NONLAPSING FUND 14 THAT IS NOT SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT 15 ARTICLE. 16 (5) (I) THE STATE TREASURER SHALL HOLD THE YA PATHWAY 17 FUND SEPARATELY AND S HALL INVEST THE MONE Y IN THE YA PATHWAY FUND IN 18 THE SAME MANNER AS O THER STATE MONEY MAY BE IN VESTED. 19 (II) ANY INVESTMENT EARNIN GS OF THE YA PATHWAY FUND 20 SHALL BE CREDITED TO THE FUND. 21 (6) THE COMPTROLLER SHALL ACC OUNT FOR THE YA PATHWAY 22 FUND. 23 (7) THE DEPARTMENT : 24 (I) MAY ACCEPT ANY GIFT OR GRANT FROM ANY PE RSON FOR 25 THE YA PATHWAY FUND; 26 (II) SHALL USE ANY GIFT O R GRANT THAT IT RE CEIVES FOR THE 27 PURPOSES LISTED UNDE R PARAGRAPH (2) OF THIS SUBSECTION ; AND 28 22 SENATE BILL 551 (III) SHALL DEPOSIT WITH T HE STATE TREASURER ANY GIFT OR 1 GRANT THAT IT RECEIV ES FOR THE YA PATHWAY FUND. 2 (8) THE YA PATHWAY FUND CONSISTS OF : 3 (I) MONEY APPROPRIATED T O THE YA PATHWAY FUND UNDER 4 THE PROGRAM IN THE STATE BUDGET ; 5 (II) GIFTS OR GRANTS RECE IVED BY THE DEPARTMENT FOR 6 THE YA PATHWAY FUND; 7 (III) INVESTMENT EARNINGS OF THE YA PATHWAY FUND; AND 8 (IV) ANY OTHER MONEY FROM ANY OTHER SOURCE ACC EPTED 9 FOR THE BENEFIT OF THE YA PATHWAY FUND. 10 (9) ANY UNSPENT PORTION O F THE YA PATHWAY FUND MAY NOT BE 11 TRANSFERRED OR REVER T TO THE GENERAL FUND OF THE STATE BUT SHALL 12 REMAIN IN THE YA PATHWAY FUND TO BE USED FOR T HE PURPOSES SPECIFIE D IN 13 THIS SUBTITLE. 14 (10) BEGINNING WITH FISCAL YEAR 2024, AT THE END OF EACH F ISCAL 15 YEAR, THE DEPARTMENT SHALL PREP ARE AN ANNUAL REPORT OF THE YA 16 PATHWAY FUND THAT INCLUDES : 17 (I) AN ACCOUNTING OF ALL FINANCIAL RECEIPTS A ND 18 EXPENDITURES TO AND FROM THE YA PATHWAY FUND; AND 19 (II) THE FOLLOWING INFORM ATION: 20 1. THE TOTAL NUMBER OF CORPS PARTICIPANTS 21 DISAGGREGATED BY DEM OGRAPHIC CATEGORIES ; 22 2. THE TOTAL ANNUAL COS T OF THE YA PATHWAY 23 DISAGGREGATED BY THE SOURCE OF THE FUNDS ; 24 3. CORPS PARTICIPANT TR ANSITION AFTER PROGRAM 25 COMPLETION INTO HIGH ER EDUCATION , POSTSECONDARY EDUCAT ION, FULL–TIME 26 EMPLOYMENT , REGISTERED APPRENTIC ESHIPS, AND ANY OTHER POST –PROGRAM 27 OPPORTUNITY ; 28 4. 22 (2) COMMUNITY COLLEGES ; 23 (3) TRADE SCHOOLS ; 24 (4) FAITH–BASED INSTITUTIONS ; 25 (5) YOUTH WHO ARE DISCON NECTED FROM SCHOOL O R WORK; AND 26 (6) EMPLOYERS AND NONPRO FIT ORGANIZATIONS WI TH POTENTIAL 27 SERVICE PLACEMENTS F OR THE MSY PATHWAY UNDER THIS SE CTION. 28 [21–206. 29 SENATE BILL 551 25 (a) The Board shall act as an intermediary with the AmeriCorps Program to 1 secure federal funding and alleviate the administrative burden on State organizations 2 seeking to participate in AmeriCorps programming. 3 (b) In working with the AmeriCorps Program under subsection (a) of this section, 4 the Board shall focus on expanding the service opportunities in State and local parks and 5 in the public health sector.] 6 [21–207.] 7 [(a)] (E) (1) There is a Maryland [Corps Program] SERVICE YEAR OPTION 8 PATHWAY Fund. 9 [(b)] (2) The purpose of the MSY PATHWAY Fund is to: 10 [(1)] (I) provide stipends to corps participants WITH A SERVICE 11 PLACEMENT IN THE MSY PATHWAY UNDER THIS SE CTION; 12 [(2)] (II) provide PROGRAM COMPLETION [scholarships] AWARDS to 13 corps participants who have completed the Program [to be used at institutions of higher 14 education in the State toward vocational certificates, associate’s degrees, and bachelor’s 15 degrees]; 16 [(3)] (III) cover expenses incurred by the [Board] DEPARTMENT , 17 including expenses incurred to study the potential use of the Program as a workforce 18 development tool in the State; 19 [(4)] (IV) cover expenses incurred to study how alumni of the Program 20 could be better positioned to meet the current and future needs of employers in the State; 21 [and] 22 [(5)] (V) provide funding for the [Program] MSY PATHWAY UNDER 23 THIS SECTION to match gifts or grants received by the [Board] DEPARTMENT for the 24 MSY PATHWAY Fund; AND 25 (VI) ASSIST IN THE CREATI ON OF ADDITIONAL CORPS 26 PROGRAMS UNDER § 21–207 OF THIS SUBTITLE . 27 [(c)] (3) The [Board] DEPARTMENT shall administer the MSY PATHWAY 28 Fund. 29 [(d)] (4) The MSY PATHWAY Fund is a continuing, nonlapsing fund that is not 30 subject to § 7–302 of the State Finance and Procurement Article. 31 26 SENATE BILL 551 [(e) (1)] (5) (I) The State Treasurer shall hold the MSY PATHWAY Fund 1 separately and shall invest the money in the MSY PATHWAY Fund in the same manner 2 as other State money may be invested. 3 [(2)] (II) Any investment earnings of the MSY PATHWAY Fund shall be 4 credited to the Fund. 5 [(f)] (6) The Comptroller shall account for the MSY PATHWAY Fund. 6 [(g)] (7) The [Board] DEPARTMENT : 7 [(1)] (I) may accept any gift or grant from any person for the MSY 8 PATHWAY Fund; 9 [(2)] (II) shall use any gift or grant that it receives for the reasons stated 10 under [subsection (b) of this section] PARAGRAPH (2) OF THIS SUBSECTION ; and 11 [(3)] (III) shall deposit any gift or grant that it receives for the MSY 12 PATHWAY Fund with the State Treasurer. 13 [(h)] (8) The MSY PATHWAY Fund consists of: 14 [(1)] (I) money appropriated under [§ 9–2818 of this subtitle] 15 SUBSECTION (F) OF THIS SECTION ; 16 [(2)] (II) gifts or grants received by the [Board] DEPARTMENT for the 17 MSY PATHWAY Fund; 18 [(3)] (III) investment earnings of the MSY PATHWAY Fund; and 19 [(4)] (IV) any other money from any other source accepted for the benefit 20 of the MSY PATHWAY Fund. 21 [(i)] (9) The MSY PATHWAY Fund may be used only [for: 22 (1) providing stipends to corps participants; 23 (2) providing scholarships to corps participants who have completed the 24 Program to be used at institutions of higher education in the State toward vocational 25 certificates, associate’s degrees, and bachelor’s degrees; 26 (3) covering expenses incurred by the Board, including expenses incurred 27 to study the potential use of the Program as a workforce development tool in the State; 28 SENATE BILL 551 27 (4) covering expenses incurred to study how alumni of the Program could 1 be better positioned to meet the current and future needs of employers in the State; and 2 (5) Providing funding for the Program to match gifts or grants received by 3 the Board for the Fund] FOR THE PURPOSES DES CRIBED IN PARAGRAPH (2) OF THIS 4 SUBSECTION . 5 [(j)] (10) Any unspent portion of the MSY PATHWAY Fund may not be 6 transferred or revert to the General Fund of the State but shall remain in the MSY 7 PATHWAY Fund to be used for the purposes specified in this subtitle. 8 [(k) (1)] (11) (I) Beginning with fiscal year [2018] 2024, at the end of [the] 9 EACH fiscal year, the [Board] DEPARTMENT shall prepare an annual report of the MSY 10 PATHWAY Fund that includes: 11 1. an accounting of all financial receipts and expenditures to 12 and from the MSY PATHWAY Fund; AND 13 2. THE FOLLOWING INFORM ATION: 14 A. THE TOTAL NUMBER OF CORP S PARTICIPANTS 15 DISAGGREGATED BY DEM OGRAPHIC CATEGORIES ; 16 B. THE TOTAL ANNUAL COS T OF THE MSY PATHWAY 17 DISAGGREGATED BY THE SOURCE OF THE FUNDS ; 18 C. CORPS PARTICIPANT TR ANSITION AFTER PROGRAM 19 COMPLETION INTO HIGH ER EDUCATION , POSTSECONDARY EDUCAT ION, FULL–TIME 20 EMPLOYMENT , REGISTERED APPRENTIC ESHIPS, AND ANY OTHER POST –PROGRAM 21 OPPORTUNITY ; 22 D. THE NUMBER OF CORPS PARTICIPANTS EMPLOYE D BY 23 STATE OR LOCAL GOVERN MENT AGENCIES AFTER COMPLETION OF THE PROGRAM; 24 AND 25 E. TO THE EXTENT PRACTICABLE , WHAT FORMER CORPS 26 PARTICIPANTS ARE DOI NG 1 YEAR, 2 YEARS, AND 5 YEARS AFTER COMPLETI NG THE 27 PROGRAM. 28 [(2)] (II) The [Board] DEPARTMENT shall submit a copy of the report to 29 the General Assembly in accordance with § 2–1257 of this article. 30 [(l)] (12) The MSY PATHWAY Fund may be subject to an audit by the 31 Legislative Auditor. 32 28 SENATE BILL 551 [21–208.] 1 [(a)] (F) (1) The Governor shall include in the annual budget bill an 2 appropriation to the MSY PATHWAY Fund of: 3 [(1)] (I) $5,000,000 for fiscal year 2024; 4 [(2)] (II) $10,000,000 for fiscal year 2025; 5 [(3)] (III) $15,000,000 for fiscal year 2026; and 6 [(4)] (IV) $20,000,000 for fiscal year 2027 and each fiscal year thereafter. 7 [(b)] (2) It is the intent of the General Assembly that[: 8 (1)] appropriations made under [subsection (a) of this section] 9 PARAGRAPH (1) OF THIS SUBSECTION are in addition to any federal funding received for 10 State service or volunteer programming[; and 11 (2) Any federal funding received by the State for service or volunteer 12 programming shall be deposited into the Fund for use by the Program]. 13 [(c)] (3) Appropriations made under [subsection (a) of this section] 14 PARAGRAPH (1) OF THIS SUBSECTION and other funding received by the [Board] 15 DEPARTMENT FOR THE MSY PATHWAY UNDER THIS SE CTION shall be used to: 16 [(1)] (I) provide stipends to corps participants WITH A SERVICE 17 PLACEMENT IN THE MSY PATHWAY UNDER THIS SE CTION; 18 [(2)] (II) provide [scholarships] PROGRAM COMPLETION AW ARDS to 19 corps participants who have completed the Program [to be used at institutions of higher 20 education in the State toward vocational certificates, associate’s degrees, and bachelor’s 21 degrees]; 22 [(3)] (III) cover expenses incurred by the [Board] DEPARTMENT , 23 including expenses incurred in marketing and recruitment; and 24 [(4)] (IV) cover programmatic expenses to expand service opportunities 25 throughout the State, including[: 26 (i) In partnership with regional operating partners, creating and 27 maintaining an online platform through which individuals and corps participants can 28 search and apply for service opportunities throughout the State; 29 SENATE BILL 551 29 (ii) Expanding] EXPANDING the Chesapeake Conservation Corps 1 Program, as provided under §§ 8–1913 through 8–1924 of the Natural Resources Article[; 2 (iii) creating a Maryland Civilian Climate Corps to conserve and 3 restore State and local parks and engage in other climate or environmental projects; 4 (iv) creating a Maryland Historic Trades Corps to place young adults 5 and young veterans in regionally based work crews tasked with rehabilitation of State 6 historic resources; 7 (v) expanding the Maryland Conservation Corps to engage in 8 projects that manage natural resources and conserve parks; and 9 (vi) Providing staff for the Program]. 10 [(d) Marketing and recruitment conducted by the Program under subsection (c)(3) 11 of this section shall prioritize: 12 (1) Historically black colleges and universities, as defined in § 3–207 of the 13 State Finance and Procurement Article; 14 (2) Community colleges; 15 (3) High schools with low rates of matriculation to 2– and 4–year 16 institutions of higher education; 17 (4) Trade schools; and 18 (5) Youth who are disconnected from school or work.] 19 [21–209.] 21–207. 20 (A) (1) The [Board] DEPARTMENT shall explore the possibility of: 21 [(1)] (I) accessing federal or other grant funding for the Program; and 22 [(2)] (II) awarding corps participants with: 23 1. academic credit for their service; OR 24 2. CREDIT FOR PRIOR LEA RNING EXPERIENCE TOWARD 25 TRADE OR VOCATIONAL CERTIFICATION . 26 (2) THE DEPARTMENT SHALL CONS ULT WITH THE MARYLAND 27 HIGHER EDUCATION COMMISSION, INSTITUTIONS OF POST SECONDARY 28 EDUCATION, THE MARYLAND DEPARTMENT OF LABOR, AND ANY OTHER ENTITY 29 30 SENATE BILL 551 THE DEPARTMENT DETERMINES RELEVANT IN DETERMINING THE F EASIBILITY OF 1 IMPLEMENTING THE PRO VISIONS OF PARAGRAPH (1) OF THIS SUBSECTION . 2 (B) THE DEPARTMENT MAY USE MO NEY FROM THE YA PATHWAY FUND 3 UNDER § 21–205 OF THIS SUBTITLE AND THE MSY PATHWAY FUND UNDER § 21–206 4 OF THIS SUBTITLE TO : 5 (1) CREATE A MARYLAND CIVILIAN CLIMATE CORPS TO CONSERVE 6 AND RESTORE STATE AND LOCAL PARKS AND ENGAGE IN OTHER CLIMATE OR 7 ENVIRONMENTAL PROJEC TS; 8 (2) CREATE A MARYLAND HISTORIC TRADES CORPS TO PLACE 9 YOUNG ADULTS AND YOU NG VETERANS IN REGIO NALLY BASED WOR K CREWS 10 TASKED WITH REHABILI TATION OF STATE HISTORIC RESOUR CES; AND 11 (3) EXPAND THE MARYLAND CONSERVATION CORPS TO ENGAGE IN 12 PROJECTS THAT MANAGE NATURAL RESOURCES AN D CONSERVE PARKS . 13 21–208. 14 (A) ON OR BEFORE JUNE 1, 2027, THE DEPARTMENT SHALL CONTRACT 15 WITH A PUBLIC OR PRI VATE ENTITY TO CONDU CT AN INDEPENDENT EV ALUATION OF 16 THE PROGRAM. 17 (B) THE INDEPENDENT EVALU ATION SHALL EVALUATE : 18 (1) THE BENEFITS TO THE COMMUNITIES BEING SE RVED BY THE 19 PROGRAM; 20 (2) THE BENEFITS TO CORP S PARTICIPANTS WHO COMPLETED THE 21 PROGRAM, INCLUDING EFFICACY I N TRANSITIONING CORP S PARTICIPANTS TO 22 POSTSECONDARY EDUCAT ION, THE WORKFORCE , OR REGISTERED 23 APPRENTICESHIPS ; 24 (3) THE EFFICACY OF THE PROGRAM’S PROFESSIONAL 25 DEVELOPMENT PROGRAMM ING, TRAINING, AND MENTORING IN S UPPORTING THE 26 STATE’S WORKFORCE DEVELOPM ENT NEEDS; 27 (4) THE PROGRAM DESIGN , IMPLEMENTATION , AND OVERALL 28 EFFICIENCY IN DELIVE RING INTENDED OUTCOM ES; AND 29 (5) ANY ADDITIONAL PROGRAM METRICS DEVEL OPED BY THE 30 DEPARTMENT . 31 SENATE BILL 551 31 (C) ON OR BEFORE JULY 1, 2028, THE DEPARTMENT SHALL SUBM IT A 1 REPORT ON ITS FINDIN GS AND RECOMMENDATIO NS TO THE GOVERNOR AND , IN 2 ACCORDANCE WITH § 2–1257 OF THIS ARTICLE , THE GENERAL ASSEMBLY ON THE 3 RESULTS OF THE INDEP ENDENT EVALUATION CO NDUCTED IN ACCORDANC E WITH 4 THIS SECTION. 5 (D) BEGINNING ON OCTOBER 1, 2028, THE DEPARTMENT SHALL PUBL ISH 6 AN ONLINE DASHBOARD OF KEY PERFORMANCE I NDICATORS AS DETERMI NED IN 7 THE REPORT REQUIRED UNDER SUBSECTION (C) OF THIS SECTION. 8 [21–210.] 21–209. 9 On or before December 1 each year, the [Board] DEPARTMENT shall report to the 10 Governor and, in accordance with § 2–1257 of this article, the General Assembly regarding: 11 (1) the number and amount of stipends awarded under the Program; 12 (2) the BUSINESSES, nonprofit ORGANIZATIONS , or government agencies 13 with which corps participants are placed; 14 (3) the institutions, if any, that award academic credit for a corps 15 participant’s service; 16 (4) the number and amount of [scholarships] PROGRAM COMPLETION 17 AWARDS awarded under the Program; and 18 (5) [at which] THE POSTSECONDARY ED UCATIONAL institutions AT 19 WHICH corps participants use their [scholarships] PROGRAM COMPLETION AW ARDS. 20 SUBTITLE 11A. SERVICE YEAR OPTION PROGRAM. 21 24–11A–01. 22 (A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS 23 INDICATED. 24 (B) “DEPARTMENT ” MEANS THE DEPARTMENT OF SERVICE AND CIVIC 25 INNOVATION. 26 (C) “FUND” MEANS THE SERVICE YEAR OPTION PROGRAM FUND. 27 (D) “PARTICIPATING EMPLOYE R” MEANS A PUBLIC OR PR IVATE ENTITY 28 PARTICIPATING AS AN EMPLOYER UNDER TH E PROGRAM. 29 (E) “PROGRAM” MEANS THE SERVICE YEAR OPTION PROGRAM. 30 32 SENATE BILL 551 (F) “PROGRAM PARTICIPANT ” MEANS AN INDIVIDUAL WHO: 1 (1) HAS RECEIVED A HIGH S CHOOL DIPLOMA , GED, OR COMPARABLE 2 PROOF OF EQUIVALENT EDUCATIONAL LEVEL WI THIN 2 YEARS BEFORE APPLYIN G 3 FOR A SERVICE PLACEM ENT UNDER THE PROGRAM; OR 4 (2) QUALIFIES FOR A SERVI CE PLACEMENT UNDER A LTERNATIVE 5 CRITERIA ESTABLISHED BY THE SECRETARY. 6 (G) “SECRETARY” MEANS THE SECRETARY OF SERVICE AND CIVIC 7 INNOVATION. 8 (H) “SERVICE PLACEMENT ” MEANS THE JOB ASSIGNMENT DESIGNATE D TO 9 AN INDIVIDUAL PARTIC IPATING IN THE PROGRAM UNDER THIS SU BTITLE. 10 24–11A–02. 11 (A) THERE IS A SERVICE YEAR OPTION PROGRAM IN THE STATE. 12 (B) THE PURPOSE OF THE PROGRAM IS TO: 13 (1) PROVIDE SERVICE PLACE MENTS TO RECENT HIGH SCHOOL 14 GRADUATES AND OTHER INDIVIDUALS WITH SIM ILAR LEVELS OF EDUCA TION AS AN 15 ADDITIONAL OPTION TO PURSUING CAREER AND TECHNICAL TRAINING O R 16 POSTSECONDARY EDUCAT ION; 17 (2) EQUIP PROGRAM PARTICIPANTS WITH PROFESSIONAL 18 DEVELOPMENT , MENTORING , JOB TRAINING, AND OTHER SUPPORT WHILE WOR KING 19 IN HIGH–IMPACT SERVICE PLACE MENTS; 20 (3) HELP ADDRESS THE STATE’S GREATEST CHALLENGE S BY 21 CHANNELING THE NEXT GENERATION INTO PUBL IC IMPACT WORK ; AND 22 (4) STRENGTHEN A PIPELINE OF TALENT INTO STATE AND LOCAL 23 GOVERNMENTS TO FILL PRESENT AND FUTURE S TAFFING NEEDS . 24 (C) THE DEPARTMENT SHALL : 25 (1) ADMINISTER THE PROGRAM; AND 26 (2) PROVIDE STAFF FOR THE PROGRAM AS PROVIDED I N THE STATE 27 BUDGET. 28 24–11A–03. 29 SENATE BILL 551 33 (A) THE DEPARTMENT SHALL : 1 (1) DESIGN THE PROGRAM; 2 (2) IDENTIFY AND WORK WITH NONPROFIT ENTITIES WHO MAY 3 RECEIVE GRANTS TO SE RVE AS REGIONAL PROGRAM LEADERS ACROS S THE STATE; 4 (3) CREATE A STATEWIDE NE TWORK FOR ALL PROGRAM 5 PARTICIPANTS ACROSS THE STATE; 6 (4) PROMOTE AND COMMUNICA TE PROGRAM OPPORTUNITIES TO 7 HIGH SCHOOLS , RELIGIOUS INSTITUTIO NS, COMMUNITY ORGANIZATI ONS, AND 8 POTENTIAL PARTICIPAT ING EMPLOYERS ACROSS THE STATE; 9 (5) (I) DEVELOP AND MAINTAIN A CENTRAL APPLICATIO N 10 PROCESS; AND 11 (II) ASSIST APPLICANTS WIT H THE APPLICATION PR OCESS; 12 (6) BUILD AND MAINTAIN AN ACCURATE AND UP –TO–DATE ONLINE 13 PORTAL TO MANAGE OPE NINGS FOR SERVICE PL ACEMENTS; 14 (7) IDENTIFY PARTICIPATIN G EMPLOYERS WHO CAN PROVIDE A WIDE 15 ARRAY OF BENEFITS , INCLUDING MENTORING AND CAREER AND COLLE GE 16 COACHING; 17 (8) TO THE EXTENT PRACTIC ABLE, SELECT PROGRAM PARTICIPANTS 18 THAT REFLECT THE GEN DER, RACIAL, ETHNIC, AND GEOGRAPHIC DIVER SITY OF THE 19 STATE; AND 20 (9) EVALUATE THE OVERALL OPERATIONS OF THE PROGRAM IN 21 COLLABORATION WITH A N INDEPENDENT ENTITY . 22 (B) THE DEPARTMENT SHALL SET TARGETS FOR PROGRAM 23 PARTICIPATION , INCLUDING: 24 (1) 200 PROGRAM PARTICIPANTS IN THE FIRST YEAR OF 25 IMPLEMENTATION ; AND 26 (2) 2000 PROGRAM PARTICIPANTS IN THE FOURTH YEAR O F 27 IMPLEMENTATION . 28 34 SENATE BILL 551 (C) THE DEPARTMENT SHALL DEVE LOP PROGRAM FOCUS AREAS T O 1 ADDRESS PRIORITY ISS UES, INCLUDING: 2 (1) CLIMATE; 3 (2) EDUCATION; AND 4 (3) HEALTH. 5 24–11A–04. 6 (A) (1) WHILE WORKING IN A SE RVICE PLACEMENT , A PROGRAM 7 PARTICIPANT SHALL : 8 (I) WORK AT LEAST 30 HOURS PER WEEK ; AND 9 (II) PARTNER WITH AN ON –SITE MENTOR WHO PROV IDES: 10 1. JOB TRAINING; 11 2. CAREER AND POSTSECOND ARY EDUCATION 12 COUNSELING ; 13 3. FINANCIAL LITERACY SK ILLS; AND 14 4. AND BE IT FURTHER ENACTED, That this Act shall take effect July 23 1, 2023. 24 SECTION 5. AND BE IT FURTHER ENACTED, That the terms of the initial 25 members of the Maryland Corps Program Advisory Board under § 21–203 of the State 26 Government Article, as enacted by Section 4 of this Act, shall expire as follows: 27 (1) the terms of the one member appointed by the President of the Senate, 28 the one member appointed by the Speaker of the House, and two members appointed by 29 the Governor shall expire on June 30, 2025; and 30 38 SENATE BILL 551 (2) the terms of the chair of the Advisory Board, the two members jointly 1 appointed by the President and the Speaker, and two members appointed by the Governor 2 shall expire on June 30, 2026. 3 SECTION 6.
