AN ACT concerning 1 
 
Maryland Health Benefit Exchange and Maryland Department of Health 2 
– Health Care and Dental Care Coverage for Undocumented Immigrants – 3 
Report 4 
 
FOR the purpose of requiring the Maryland Health Benefit Exchange and the Maryland 5 
Department of Health to develop a report comparing options for offering affordable 6 
health care and dental care coverage to State residents who are ineligible for the 7 
Maryland Medical Assistance Program, the Maryland Children’s Health Program, 8 
or qualified health plans, or stand–alone dental plans due to the individuals’ 9 
immigration status; and generally relating to a study on providing health care and 10 
dental care coverage to undocumented immigrants. 11 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That: 13 
 
 (a) The Maryland Health Benefit Exchange and the Maryland Department of 14 
Health shall develop a report comparing options for offering affordable health care and 15 
dental care coverage to State residents who are ineligible for the Maryland Medical 16 
Assistance Program, the Maryland Children’s Health Program, or qualified health plans or 17 
stand–alone dental plans through the Maryland Health Benefit Exchange due to the 18 
individuals’ immigration status. 19 
 
 (b) The report required under subsection (a) of this section shall include a 20 
comparison of the cost to the State, the impact on the uninsured, potential benefits designs, 21 
and implementation considerations for: 22  2 	SENATE BILL 806  
 
 
 
 (1) offering health care and dental care coverage through: 1 
 
 (i) the Maryland Medical Assistance Program and the Maryland 2 
Children’s Health Program to individuals who are eligible technically and financially for 3 
the programs but for the individuals’ immigration status; and 4 
 
 (ii) qualified health plans and stand–alone dental plans offered 5 
through the Maryland Health Benefit Exchange to individuals who are eligible technically 6 
and financially to enroll in coverage through the Exchange but for the individuals’ 7 
immigration status; and 8 
 
 (2) offering health care and dental care coverage to the following groups: 9 
 
 (i) all eligible individuals; 10 
 
 (ii) only individuals under the age of 21 years; 11 
 
 (iii) only individuals who are at least 65 years old; and 12 
 
 (iv) only low–income individuals. 13 
 
 (c) On or before October 31, 2023, the Maryland Health Benefit Exchange and 14 
the Maryland Department of Health shall report their findings and recommendations to 15 
the House Health and Government Operations Committee and the Senate Finance 16 
Committee in accordance with § 2–1257 of the State Government Article. 17 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 18 
1, 2023. 19
