Remote Fetal Nonstress Tests 3
FOR the purpose of requiring the Maryland Medical Assistance Program to provide remote 4
ultrasound procedures and remote fetal nonstress tests under certain circumstances; 5
and generally relating to the Maryland Medical Assistance Program and remote 6
ultrasound procedures and remote fetal nonstress tests. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 23
That the Laws of Maryland read as follows: 24

(a) (1) The Secretary shall administer the Maryland Medical Assistance 3
Program. 4
(2) The Program: 5
(ii) Shall provide, subject to the limitations of the State budget, 6
comprehensive medical, dental, and other health care services, INCLUDING SERVICES 7
PROVIDED IN ACCORDAN CE WITH § 15–141.5 OF THIS SUBTITLE , for all eligible 8
pregnant women whose family income is at or below 250 percent of the poverty level for the 9
duration of the pregnancy and for 1 year immediately following the end of the woman’s 10
pregnancy, as permitted by the federal law; 11

(A) SUBJECT TO SUBSECTION S (B) AND (C) OF THIS SECTION , THE 13
PROGRAM SHALL PROVIDE REMOTE ULTRASOUND PR OCEDURES AND REMOTE 14
FETAL NONSTRESS TEST S USING CURRENT PROCEDURAL T ERMINOLOGY CODES IF: 15
(1) THE PATIENT IS IN A RESIDENCE OR A LOCATION OTHER THAN 16
THE OFFICE OF THE PATIENT’S PROVIDER; AND 17
(2) THE PROVIDER FOLLOWS THE SAME STANDARD OF CARE THAT 18
THE PROVIDER WOULD FOLLOW WHEN PROVIDIN G THE SERVICES ON –SITE. 19
(B) THE PROGRAM SHALL REQUIRE THAT A PROVIDER OFFERING A 20
REMOTE ULTRASOUND PRO CEDURE OR REMOTE FETAL NONSTRE SS TEST USE 21
DIGITAL TECHNOLOGY : 22
(1) TO COLLECT ANY HEALTH DATA FROM THE PATIENT AND 23
ELECTRONICALLY TRANS MIT THE INFORMATION IN A SECURE MANNER TO A 24
HEALTH CARE PROVIDER IN A DIFFERENT LOCAT ION FOR INTERPRETATI ON AND 25
RECOMMENDATION S; 26
(2) THAT IS COMPLI ANT WITH THE FEDERAL HEALTH INSURANCE 27
PORTABILITY AND ACCOUNTABILITY ACT OF 1996; AND 28
(3) THAT IS APPROVED BY T HE FEDERAL FOOD AND DRUG 29
ADMINISTRATION . 30
(C) (1) THE PROGRAM SHALL PROVIDE REIMBURSE MENT FOR A REMOTE 31 HOUSE BILL 1078 3
FETAL NONSTRESS TEST IN THE SAME MANNER AS AN ON–SITE FETAL NONSTRESS 1
TEST. 2
(2) A REMOTE FETAL NONSTRES S TEST FOR WHICH REIMBURSEM ENT 3
IS PROVIDED UNDER PARAG RAPH (1) OF THIS SUBSECTION SHALL REQUIRE TH E USE 4
OF REMOTE MONITORING SO LUTIONS THAT ARE CLE ARED BY THE FEDERAL FOOD 5
AND DRUG ADMINISTRATION FOR ON –LABEL USE FOR MONITO RING: 6
(I) FETAL HEART RATE ; 7
(II) MATERNAL HEART RATE ; AND 8
(III) UTERINE ACTIVITY. 9
(D) THE PROGRAM SHALL ISSUE GUIDANCE FOR PROGRAM PROVIDERS TO 10
CARRY OUT THIS SECTION. 11
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 12
October 1, 2024. 13
