BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 3 That the Laws of Maryland read as follows: 4 Article – Health – General 5 15–103. 6 (a) (1) The Secretary shall administer the Maryland Medical Assistance 7 Program. 8 (2) The Program: 9 (ii) Shall provide, subject to the limitations of the State budget, 10 comprehensive medical, dental, and other health care services, INCLUDING S ERVICES 11 PROVIDED IN ACCORDAN CE WITH § 15–141.5 OF THIS SUBTITLE , for all eligible 12 pregnant women whose family income is at or below 250 percent of the poverty level for the 13 duration of the pregnancy and for 1 year immediately following the end of the woman’s 14 pregnancy, as permitted by the federal law; 15 15–141.5. 16 (A) SUBJECT TO SUBSECTION S (B) AND (C) OF THIS SECTION , THE 17 PROGRAM SHALL PROVIDE REMOTE ULTRASOUND PR OCEDURES AND REMOTE 18 FETAL NONSTRESS TEST S USING CURRENT PROCEDURAL T ERMINOLOGY CODES IF: 19 (1) THE PATIENT IS IN A RESIDENCE OR A LOCATION OTHER THAN 20 THE OFFICE OF THE PATIENT’S PROVIDER; AND 21 (2) THE PROVIDER FOLLOWS THE SAME STANDARD OF CARE THAT 22 THE PROVIDER WOULD FOLLOW WHEN PROVIDIN G THE SERVICES ON –SITE. 23 (B) THE PROGRAM SHALL REQUIRE THAT A PROVIDER OFFERING A 24 REMOTE ULTRASOUND PRO CEDURE OR REMOTE FETAL NONSTRE SS TEST USE 25 DIGITAL TECHNOLOGY : 26 (1) TO COLLECT ANY HEALTH DATA FROM THE PATIENT AND 27 ELECTRONICALLY TRANS MIT THE INFORMATION IN A SECURE MANNER TO A 28 HEALTH CARE PROVIDER IN A DIFFERENT LOCAT ION FOR INTERPRETATI ON AND 29 RECOMMENDATION S; 30 (2) THAT IS COMPLI ANT WITH THE FEDERAL HEALTH INSURANCE 31 PORTABILITY AND ACCOUNTABILITY ACT OF 1996; AND 32 HOUSE BILL 1078 3 (3) THAT IS APPROVED BY T HE FEDERAL FOOD AND DRUG 1 ADMINISTRATION . 2 (C) (1) THE PROGRAM SHALL PROVIDE REIMBURSE MENT FOR A REMOTE 3 FETAL NONSTRESS TEST IN THE SAME MANNER A S AN ON–SITE FETAL NONSTRESS 4 TEST. 5 (2) A REMOTE FETAL NONSTRES S TEST FOR WHICH REIMBURSEM ENT 6 IS PROVIDED UNDER PARAG RAPH (1) OF THIS SUBSECTION SHALL REQUIRE TH E USE 7 OF REMOTE MONITORING SO LUTIONS THAT ARE CLEARED BY THE FEDER AL FOOD 8 AND DRUG ADMINISTRATION FOR ON –LABEL USE FOR MONITO RING: 9 (I) FETAL HEART RATE ; 10 (II) MATERNAL HEART RATE ; AND 11 (III) UTERINE ACTIVITY. 12 (D) THE PROGRAM SHALL ISSUE GUIDANCE FOR PROGRAM PROVIDERS TO 13 CARRY OUT THIS SECTION. 14 SECTION 2.
