AN ACT concerning 1 
 
Hospitals and Related Institutions – Residential Treatment Centers – 2 
Accreditation 3 
 
FOR the purpose of altering the definition of “accredited residential treatment center” for 4 
certain provisions of law governing hospitals and related institutions to include 5 
residential treatment centers accredited by the Commission on Accreditation of 6 
Rehabilitation Facilities or the Council on Accreditation; and generally relating to 7 
residential treatment centers. 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 
That the Laws of Maryland read as follows: 20 
 
Article – Health – General 21 
 
19–301. 22 
 
 (a) In this subtitle the following words have the meanings indicated. 23 
  2 	HOUSE BILL 1134  
 
 
 (b) “Accredited hospital” means a hospital accredited by the Joint Commission on 1 
Accreditation of Healthcare Organizations. 2 
 
 (c) “Accredited residential treatment center” means a residential treatment 3 
center that is accredited by [the]:  4 
 
 (1) THE Joint Commission on Accreditation of Healthcare Organizations; 5 
 
 (2) THE COMMISSION ON ACCREDITATION OF REHABILITATION 6 
FACILITIES; OR 7 
 
 (3) THE COUNCIL ON ACCREDITATION . 8 
 
 (j) “Nonaccredited residential treatment center” means a residential treatment 9 
center that is not accredited by [the]: 10 
 
 (1) THE Joint Commission on Accreditation of Healthcare Organizations; 11 
 
 (2) THE COMMISSION ON ACCREDITATION OF REHABILITATION 12 
FACILITIES; OR 13 
 
 (3) THE COUNCIL ON ACCREDITATION . 14

 (a) This section applies to: 16 
 
 (1) Nonaccredited hospitals found in violation of the standards adopted 17 
under this subtitle; 18 
 
 (2) Accredited hospitals: 19 
 
 (i) Found deficient as a result of the complaint review process; or 20 
 
 (ii) Subject to inspection by the Department under § 19–2302(e) of 21 
this title as a result of a serious or life–threatening patient care deficiency identified by the 22 
Joint Commission on Accreditation of Healthcare Organizations, the Centers for Medicare 23 
and Medicaid Services, or the Department; 24 
 
 (3) Accredited residential treatment centers subject to inspection by the 25 
Department under § 19–2302(e) of this title as a result of a serious or life–threatening 26 
patient care deficiency identified by the Joint Commission on Accreditation of Healthcare 27 
Organizations, THE COMMISSION ON ACCREDITATION OF REHABILITATION 28 
FACILITIES, THE COUNCIL ON ACCREDITATION , the Centers for Medicare and 29 
Medicaid Services, or the Department; and 30

 (4) Health care facilities that fail to achieve substantial compliance with 1 
the standards of an approved accreditation organization under § 19–2302(c)(2) of this title. 2 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 3 
October 1, 2024. 4
