BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 That the Laws of Maryland read as follows: 20 Article – Health – General 21 2 HOUSE BILL 1134 19–301. 1 (a) In this subtitle the following words have the meanings indicated. 2 (b) “Accredited hospital” means a hospital accredited by the Joint Commission on 3 Accreditation of Healthcare Organizations. 4 (c) “Accredited residential treatment center” means a residential treatment 5 center that is accredited by [the]: 6 (1) THE Joint Commission on Accreditation of Healthcare Organizations; 7 (2) THE COMMISSION ON ACCREDITATION OF REHABILITATION 8 FACILITIES; OR 9 (3) THE COUNCIL ON ACCREDITATION . 10 (j) “Nonaccredited residential treatment center” means a residential treatment 11 center that is not accredited by [the]: 12 (1) THE Joint Commission on Accreditation of Healthcare Organizations; 13 (2) THE COMMISSION ON ACCREDITATION OF REHABILITATION 14 FACILITIES; OR 15 (3) THE COUNCIL ON ACCREDITATION . 16 19–360. 17 (a) This section applies to: 18 (1) Nonaccredited hospitals found in violation of the standards adopted 19 under this subtitle; 20 (2) Accredited hospitals: 21 (i) Found deficient as a result of the complaint review process; or 22 (ii) Subject to inspection by the Department under § 19–2302(e) of 23 this title as a result of a serious or life–threatening patient care deficiency identified by the 24 Joint Commission on Accreditation of Healthcare Organizations, the Centers for Medicare 25 and Medicaid Services, or the Department; 26 (3) Accredited residential treatment centers subject to inspection by the 27 Department under § 19–2302(e) of this title as a result of a serious or life–threatening 28 HOUSE BILL 1134 3 patient care deficiency identified by the Joint Commission on Accreditation of Healthcare 1 Organizations, THE COMMISSION ON ACCREDITATION OF REHABILITATION 2 FACILITIES, THE COUNCIL ON ACCREDITATION , the Centers for Medicare and 3 Medicaid Services, or the Department; and 4 (4) Health care facilities that fail to achieve substantial compliance with 5 the standards of an approved accreditation organization under § 19–2302(c)(2) of this title. 6 SECTION 2.
