WES MOORE, Governor Ch. 881 – 1 – Chapter 881 (House Bill 39) AN ACT concerning Residential Service Agencies – Reimbursement – Personal Assistance Services (Homecare Worker Rights Act of 2024) FOR the purpose of authorizing the Maryland Department of Health to reimburse a residential service agency for personal assistance services only if the personal assistance services are provided by an individual classified as an employee; and generally relating to reimbursements to residential service agencies. BY repealing and reenacting, with amendments, Article – Health – General Section 19–4A–10 Annotated Code of Maryland (2023 Replacement Volume) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: Article – Health – General 19–4A–10. (A) Except as provided by federal law, licensure under this subtitle does not entitle a residential service agency to reimbursement by a third party payor. (B) THE DEPARTMENT MAY REIMBURSE A RESIDENTIAL SERVICE AGENCY FOR PERSONAL ASSISTA NCE SERVICES ONLY IF THE PERSONAL ASSISTA NCE SERVICES ARE PROVIDE D BY AN INDIVIDUAL C LASSIFIED AS AN EMPL OYEE. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect October 1, 2025 January 1, 2026. Approved by the Governor, May 16, 2024.
