AN ACT concerning 1 
 
Higher Education – Undocumented Students – Out–of–State Tuition Exemption 2 
Eligibility 3 
 
FOR the purpose of decreasing the number of years an individual or the individual’s parent 4 
or guardian must file taxes before the academic year for eligibility to receive an  5 
out–of–state tuition exemption; and generally relating to out–of–state tuition 6 
exemptions for undocumented students. 7 
 
BY repealing and reenacting, with amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 
That the Laws of Maryland read as follows: 14 
 
Article – Education 15 
 
15–106.8. 16 
 
 (b) Notwithstanding any other provision of this article, an individual shall be 17 
exempt from paying the out–of–state tuition rate at a public institution of higher education 18 
in the State, and shall be eligible for the tuition rates described under subsections (c) and 19 
(d) of this section, if the individual: 20 
 
 (4) Provides to the public institution of higher education documentation 21 
that the individual or the individual’s parent or legal guardian has filed a Maryland income 22 
tax return [annually] for the [3–year period] TAXABLE YEAR IMMEDIA TELY before the 23  2 	HOUSE BILL 473  
 
 
academic year in which the tuition rate exemption would apply; 1 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act sha ll take effect July 2 
1, 2024. 3
