AN ACT concerning 1 
 
Higher Education – Undocumented Students – Out–of–State Tuition Exemption 2 
Eligibility 3 
 
FOR the purpose of decreasing the number of years an individual or the individual’s parent 4 
or guardian must file taxes before the academic year for eligibility to receive an  5 
out–of–state tuition exemption; and generally relating to out–of–state tuition 6 
exemptions for undocumented students. 7 
 
BY repealing and reenacting, with amendments, 8 
 Article – Education 9 
Section 15–106.8(b)(4) 10 
 Annotated Code of Maryland 11 
 (2022 Replacement Volume and 2023 Supplement) 12 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 
That the Laws of Maryland read as follows: 14 
 
Article – Education 15 
 
15–106.8. 16 
 
 (b) Notwithstanding any other provision of this article, an individual shall be 17 
exempt from paying the out–of–state tuition rate at a public institution of higher education 18  2 	HOUSE BILL 473  
 
 
in the State, and shall be eligible for the tuition rates described under subsections (c) and 1 
(d) of this section, if the individual: 2 
 
 (4) Provides to the public institution of higher education documentation 3 
that the individual or the individual’s parent or legal guardian has filed a Maryland income 4 
tax return [annually] for the [3–year period] TAXABLE YEAR IMMEDIA TELY 2–YEAR 5 
PERIOD before the academic year in which the tuition rate exemption would apply; 6 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 7 
1, 2024.  8
