AN ACT concerning 1 
 
Montgomery County – School Bus Monitoring Cameras – Distribution of Fines 2

FOR the purpose of requiring that the fines collected by Montgomery County as a result of 4 
violations enforced on State highways by school bus monitoring cameras be 5 
distributed in a certain manner to be used only to enhance pedestrian safety at 6 
certain locations; and generally relating to the distribution of revenue generated by 7 
school bus monitoring cameras in Montgomery County. 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 
That the Laws of Maryland read as follows: 20

 (e) (4) (i) Except as provided in paragraph (5) of this subsection, from the 23 
fines collected by a political subdivision as a result of violations enforced by speed 24  2 	HOUSE BILL 761  
 
 
monitoring systems, school bus monitoring cameras, or bus lane monitoring systems, a 1 
political subdivision: 2 
 
 1. May recover the costs of implementing and administering 3 
the speed monitoring systems, school bus monitoring cameras, or bus lane monitoring 4 
systems; and 5 
 
 2. Subject to subparagraphs (ii), (iii), and (iv) of this 6 
paragraph, may spend any remaining balance solely for public safety purposes, including 7 
pedestrian safety programs. 8 
 
 (ii) 1. For any fiscal year, if the balance remaining from the fines 9 
collected by a political subdivision as a result of violations enforced by speed monitoring 10 
systems, after the costs of implementing and administering the systems are recovered in 11 
accordance with subparagraph (i)1 of this paragraph, is greater than 10% of the total 12 
revenues of the political subdivision for the fiscal year, the political subdivision shall remit 13 
any funds that exceed 10% of the total revenues to the Comptroller. 14 
 
 2. The Comptroller shall deposit any money remitted under 15 
this subparagraph to the General Fund of the State. 16 
 
 (iii) The fines collected by Prince George’s County as a result of 17 
violations enforced by speed monitoring systems on Maryland Route 210 shall be remitted 18 
to the Comptroller for distribution to the State Highway Administration to be used solely 19 
to assist in covering the costs of: 20 
 
 1. Examining the engineering, infrastructure, and other 21 
relevant factors that may contribute to safety issues on Maryland Route 210 in Prince 22 
George’s County; 23 
 
 2. Reporting its findings and recommendations on any 24 
solutions to these safety issues; and 25 
 
 3. Implementing any solutions to these safety issues. 26 
 
 (iv) 1. From the fines collected by Baltimore City as a result of 27 
violations enforced by speed monitoring systems on Interstate 83, any balance remaining 28 
after the allocation of fines under subparagraph (i)1 of this paragraph shall be remitted to 29 
the Comptroller for distribution to the Baltimore City Department of Transportation to be 30 
used solely to assist in covering the cost of roadway improvements on Interstate 83 in 31 
Baltimore City. 32 
 
 2. Fines remitted to the Baltimore City Department of 33 
Transportation under subsubparagraph 1 of this subparagraph are supplemental to and 34 
are not intended to take the place of funding that would otherwise be appropriated for uses 35 
described under subsubparagraph 1 of this subparagraph. 36

 (v) From the fines collected by Anne Arundel County as a result of 1 
violations enforced by speed monitoring systems on Maryland Route 175 (Jessup Road) 2 
between the Maryland Route 175/295 interchange and the Anne Arundel County–Howard 3 
County line, any balance remaining after the allocation of fines under subparagraph (i)1 of 4 
this paragraph shall be remitted to the Comptroller for distribution to the State Highway 5 
Administration to be used solely to assist in covering the cost of speed reduction measures 6 
and roadway and pedestrian safety improvements on Maryland Route 175 (Jessup Road) 7 
between the Maryland Route 175/295 interchange and the Anne Arundel County–Howard 8 
County line. 9 
 
 (vi) From the fines collected by the Town of Oxford as a result of 10 
violations enforced by speed monitoring systems at the intersection of Maryland Route 333 11 
(Oxford Road) and Bonfield Avenue in Talbot County, any balance remaining after the 12 
allocation of fines under subparagraph (i)1 of this paragraph shall be remitted to the 13 
Comptroller for distribution to the State Highway Administration to be used solely to assist 14 
in covering the cost of roadway and pedestrian safety improvements in and around the 15 
intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue. 16 
 
 (VII) FROM THE FINES COLLEC TED BY MONTGOMERY COUNTY 17 
AS A RESULT OF VIOLA TIONS ENFORCED BY SC HOOL BUS MONITORING CAMERAS ON 18 
STATE HIGHWAYS , ANY BALANCE REMAININ G AFTER THE ALLOCATI ON OF FINES 19 
UNDER SUBPARAGRAPH (I)1 OF THIS PARAGRAPH SH ALL BE REMITTED TO THE 20 
COMPTROLLER FOR DISTR IBUTION TO THE STATE HIGHWAY ADMINISTRATION TO 21 
BE USED ONLY TO ENHA NCE PEDESTRIAN SAFET Y AT LOCATIONS IN MONTGOMERY 22 
COUNTY WHERE THE VIOL ATIONS OCCURRED . 23

 (c) (1) A school bus monitoring camera may not be used in a local jurisdiction 26 
under this section unless its use is authorized by the governing body of the local jurisdiction 27 
by local law enacted after reasonable notice and a public hearing. 28 
 
 (2) If authorized by the governing body of the local jurisdiction, a law 29 
enforcement agency, in consultation with the county board of education, may place school 30 
bus monitoring cameras on school buses in the county. 31 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 32 
1, 2024. 33
