BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 8 That the Laws of Maryland read as follows: 9 Article – Environment 10 1–701. 11 (a) (1) In this section the following words have the meanings indicated. 12 (7) “Overburdened community” means any census tract for which three or 13 more of the following environmental health indicators are above the 75th percentile 14 statewide: 15 (i) Particulate matter (PM) 2.5; 16 (ii) Ozone; 17 (iii) National Air Toxics Assessment (NATA) diesel PM; 18 (iv) NATA cancer risk; 19 (v) NATA respiratory hazard index; 20 (vi) Traffic proximity; 21 (vii) Lead paint indicator; 22 (viii) National Priorities List Superfund site proximity; 23 (ix) Risk Management Plan facility proximity; 24 (x) Hazardous waste proximity; 25 (xi) Wastewater discharge indicator; 26 (xii) Proximity to a Concentrated Animal Feeding Operation 27 (CAFO); 28 HOUSE BILL 836 3 (xiii) Percent of the population lacking broadband coverage; 1 (xiv) Asthma emergency room discharges; 2 (xv) Myocardial infarction discharges; 3 (xvi) Low–birth–weight infants; 4 (xvii) Proximity to emitting power plants; 5 (xviii) Proximity to a Toxic Release Inventory (TRI) facility; 6 (xix) Proximity to a brownfields site; 7 (xx) Proximity to mining operations; and 8 (xxi) Proximity to a hazardous waste landfill. 9 (8) “Underserved community” means any census tract in which, according 10 to the most recent U.S. Census Bureau Survey: 11 (i) At least 25% of the residents qualify as low–income; 12 (ii) At least 50% of the residents identify as nonwhite; or 13 (iii) At least 15% of the residents have limited English proficiency. 14 Article – Transportation 15 2–103.1. 16 (a) (1) In this section the following words have the meanings indicated. 17 (2) “Capital project” means: 18 (i) Any project for which funds are expended for construction, 19 reconstruction, or rehabilitation of a transportation facility by the Department or of a 20 transportation facilities project by the Maryland Transportation Authority; or 21 (ii) Capital equipment, as defined by the Secretary. 22 (4) “Major capital project” means any new, expanded, or significantly 23 improved facility or service that involves planning, environmental studies, design, 24 right–of–way, construction, or purchase of essential equipment related to the facility or 25 service. 26 SUBTITLE 9. MAJOR HIGHWAY CAPACITY EXPANSION PROJECTS. 27 4 HOUSE BILL 836 2–901. 1 (A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS 2 INDICATED. 3 (B) “CARBON DIOXIDE EQUIVA LENT” MEANS THE MEASUREMEN T OF A 4 GIVEN WEIGHT OF A GR EENHOUSE GAS THAT HA S THE SAME GLOBAL WA RMING 5 POTENTIAL, MEASURED OVER A SPEC IFIED PERIOD OF TIME , AS 1 METRIC TON OF 6 CARBON DIOXIDE . 7 (C) “GREENHOUSE GAS ” INCLUDES CARBON DIOX IDE, METHANE, NITROUS 8 OXIDE, HYDROFLUOROCARBONS , PERFLUOROCARBONS , AND SULFUR 9 HEXAFLUORIDE . 10 (D) “GREENHOUSE GAS EMISSI ONS” MEANS EMISSIONS OF G REENHOUSE 11 GASES IN THE STATE, MEASURED IN METRIC T ONS OF CARBON DIOXID E 12 EQUIVALENTS . 13 (E) “IMPACT ASSESSMENT ” MEANS A MAJOR HIGHWA Y CAPACITY 14 EXPANSION PROJECT IM PACT ASSESSMENT . 15 (F) “INDUCED DEMAND ” MEANS THE SITUATION THAT A RISES WHEN AN 16 EXPANDED ROAD BECOME S CONGESTED DUE TO ADDITIONAL DRIVERS U SING THE 17 ROAD BECAUSE IT WAS EXPANDED. 18 (G) “MAJOR CAPITAL PROJECT ” HAS THE MEANING STAT ED IN § 2–103.1 19 OF THIS TITLE. 20 (H) (1) “MAJOR HIGHWAY CAPACITY EXPANSION PROJECT” MEANS A 21 MAJOR CAPITAL PROJEC T: 22 (I) WHOSE TOTAL COST FOR ALL PHASES EXCEEDS 23 $10,000,000; AND 24 (II) THAT: 25 1. INCREASES HIGHWAY CAP ACITY; 26 2. IMPROVES HIGHWAY CAPA CITY THROUGH THE USE 27 OF INTELLIGENT TRANS PORTATION SYSTEMS OR CONGESTION MANAGEMEN T 28 SYSTEMS; OR 29 HOUSE BILL 836 5 3. A DEDICATED BUS LANE. 17 (I) “OVERBURDENED COMMUNIT Y” HAS THE MEANING STAT ED IN § 1–701 18 OF THE ENVIRONMENT ARTICLE. 19 (J) “UNDERSERVED COMMUNITY ” HAS THE MEANING STAT ED IN § 1–701 20 OF THE ENVIRONMENT ARTICLE. 21 (K) “VEHICLE MILES TRAVELE D” MEANS THE TOTAL NUMBER OF ON–ROAD 22 MILES TRAVELED BY VEHICLES IN A GEOGRAPHIC REGI ON OVER A 1–YEAR PERIOD. 23 2–902. 24 (A) THE REQUIREMENTS OF T HIS SUBTITLE ARE IN ADDITION TO AND MAY 25 NOT SUPPLANT ANY HEA LTH AND SAFETY GOALS ESTABLISHED UNDER STATE OR 26 LOCAL LAW S OR REGULATIONS . 27 6 HOUSE BILL 836 (B) THIS SUBTITLE DOES NO T APPLY TO: 1 (1) A MAJOR HIGHWAY CAPACITY EXPANSION P ROJECT THAT WAS , 2 BEFORE JULY 1, 2024, SUBMITTED FOR APPROV AL FOR INCLUSION IN , OR FUNDED 3 FOR CONSTRUCTION UNDER: 4 (I) THE STATEWIDE TRANSPORTATION IMPROVEMENT 5 PROGRAM; 6 (II) A METROPOLITAN PLANNING ORGANIZATION 7 TRANSPORTATION IMPROVEMENT PROGRAM; OR 8 (III) THE CONSOLIDATED TRANSPORTATION PROGRAM; OR 9 (2) A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT FOR WHICH 10 AN ASSESSMENT COMPARA BLE TO THE IMPACT ASSESSMENT REQUIRED UNDER 11 THIS SUBTITLE WAS PE RFORMED. 12 2–903. 13 (A) THE DEPARTMENT SHALL ESTABLISH A PR OCESS FOR PERFORM ING 14 MAJOR HIGHWAY CAPACITY EXPANSION PROJECT IMPACT ASSESSMENTS . 15 (B) (1) AN IMPACT ASSESSMENT SHALL INC LUDE AN ANALYSIS AND 16 ESTIMATES OF A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT’S: 17 (I) QUANTITATIVE NET CHANGE IN: 18 1. GREENHOUSE GAS EMISSI ONS FOR THE SIXTH YEAR 19 AFTER THE PROJECT IS COMPLETE; AND 20 2. VEHICLE MILES TRAVELE D IN THE PROJECT AREA 21 FOR THE SIXTH YEAR A FTER THE PROJECT IS COMPLETE; AND 22 (II) IMPACT ON GREENHOUSE GAS EMISSIONS AND VE HICLE 23 MILES TRAVELED CAUSED BY ANY INDUCE D DEMAND CREATED BY THE PROJECT. 24 (2) THE ANALYSIS AND ESTI MATES SPECIFIED UNDER PARAGRAPH 25 (1)(II) OF THIS SUBSECTION S HALL BE DETERMINED U SING THE BEST AVAILA BLE 26 DATA AND MODELING TO OLS, SUCH AS: 27 (I) THE STATE HIGHWAY INDUCED FREQUENCY OF TRAVEL 28 CALCULATOR; 29 HOUSE BILL 836 7 (II) THE NATIONAL CENTER FOR SUSTAINABLE 1 TRANSPORTATION ’S INDUCED TRAVEL CALCULATOR; OR 2 (III) ANY OTHER IMPACT ASSESSMENT TOOL USED FOR 3 MEASURING INDUCED DE MAND FOR GRADE SEPAR ATION PROJECTS . 4 2–904. 5 (A) (1) THE DEPARTMENT SHALL PERFORM A N IMPACT ASSESSMENT 6 FOR A MAJOR HIGHWAY CAPACITY EXPANSION PROJECT BEFORE THE PROJEC T 7 MAY BE CONSIDERED FOR INCLUSION IN THE STATEWIDE TRANSPORTATION 8 IMPROVEMENT PROGRAM OR THE CONSOLIDATED TRANSPORTATION PROGRAM. 9 (2) A METROPOLITAN PLANNING ORGANIZATION SHALL : 10 (I) PERFORM AN IMPACT ASSESSMENT FOR A MAJOR 11 HIGHWAY CAPACITY EXPANSION PROJECT BEFORE THE PROJECT MAY BE 12 CONSIDERED FOR INCLU SION IN A METROPOLITAN PLANNING ORGANIZATION 13 TRANSPORTATION IMPROVEMENT PROGRAM; AND 14 (II) SUBMIT AN IMPACT ASSESSMENT PERFORMED UNDER THIS 15 SECTION TO THE DEPARTMENT FOR REVIEW AND APPROVAL . 16 (B) THE DEPARTMENT SHALL USE THE INFORMATION COLLECTE D IN THE 17 IMPACT ASSESSMENT REQUIRED IN SUBSECTION (A) OF THIS SECTION TO 18 DETERMINE WHETHER A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT MEETS 19 THE FOLLOWING REQUIR EMENTS: 20 (1) THE PROJECT WILL NOT INCREASE GREENHOUSE GAS 21 EMISSIONS; 22 (2) THE PROJECT WILL NOT INCREASE VEHICLE MIL ES TRAVELED; 23 (3) THE PROJECT CONFORMS WITH THE GREENHOUSE GAS 24 EMISSIONS REDUCTION TARGETS SPECIFIED IN § 2–1205 OF THE ENVIRONMENT 25 ARTICLE; AND 26 (4) THE PROJECT CONFORMS WITH THE VEHICLE MIL ES TRAVELED 27 REDUCTION TARGET S SPECIFIED IN THE 2024 ANNUAL ATTAINMENT REPORT ON 28 TRANSPORTATION SYSTEM PERFORMANCE . 29 8 HOUSE BILL 836 (C) (1) IF THE DEPARTMENT DETERMINES THAT A MAJOR HIGHWAY 1 CAPACITY EXPANSION PROJECT DOES NOT SATISFY EAC H REQUIREMENT 2 SPECIFIED IN SUBSECTION (B) OF THIS SECTION , THE DEPARTMENT OR , FOR AN 3 IMPACT ASSESSMENT PERFORMED BY A METROPOLITAN PL ANNING 4 ORGANIZATION , THE METROPOLITAN PLANNING ORGANIZATION SHALL: 5 (I) ALTER THE SCOPE OR DE SIGN OF THE PROJECT ; 6 (II) DEVELOP A MITIGATION PLAN IN ACCORDANCE WITH § 7 2–905 OF THIS SUBTITLE ; OR 8 (III) HALT PROJECT DEVELOPM ENT AND OMIT THE PROJECT 9 FROM THE RELEVANT T RANSPORTATION IMPROVEMENT PROGRAM OR THE 10 CONSOLIDATED TRANSPORTATION PROGRAM. 11 (2) THE DEPARTMENT OR A M ETROPOLITAN PLANNING 12 ORGANIZATION SHALL PERFORM SUBSEQ UENT IMPACT ASSESSMENT S ON A MAJOR 13 HIGHWAY CAPACITY EXP ANSION PROJECT ALTERED IN A CCORDANCE WITH 14 PARAGRAPH (1) OF THIS SUBSECTION UNTIL THE DEPARTMENT DETERMINES THAT 15 THE PROJECT SATISFIES EA CH REQUIREMENT SPECIFIED IN SUBSECTION (B) OF 16 THIS SECTION. 17 2–905. 18 (A) IF THE DEPARTMENT DETERMINES THROUGH A N IMPACT ASSESSMENT 19 THAT A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT WILL RESULT IN A NET 20 INCREASE IN GREENHOUSE GAS EMISS IONS OR VEHICLE MILE S TRAVELED AND 21 THE PROJECT IS NOT G OING TO BE ALTERED O R HALTED UNDER § 2–904(C) OF 22 THIS SUBTITLE , THE DEPARTMENT OR A METROPOLITAN PLANNING 23 ORGANIZATION SHALL DEVELOP AND IMPLEMENT A MITIGATION PLAN TO 24 ELIMINATE THE NET INCREASE IN GREE NHOUSE GAS EMISSIONS OR VEHICLE 25 MILES TRAVELED . 26 (B) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION, A 27 MITIGATION PLAN DEVELOPED UNDER THIS SECTION SHALL INCLUDE ONE OR 28 MORE OF THE FOLLOWIN G MITIGATION ACTIONS : 29 (I) TRANSIT EXPANSION , INCLUDING: 30 1. REGULAR FIXED BUS ROUTES; 31 2. ARTERIAL BUS RAPID TR ANSIT; 32 HOUSE BILL 836 9 3. HIGHWAY BUS RAPID TRA NSIT; 1 4. RAIL TRANSIT; AND 2 5. INTERCITY PASSENGER R AIL; 3 (II) TRANSIT SERVICE IMPROVEMENTS , INCLUDING: 4 1. INCREASED SERVICE LEV ELS; 5 2. TRANSIT FARE REDUCTIO NS OR INCENTIVES; AND 6 3. BUFFERED AND SHELTERE D SIDEWALKS. 10 (2) A MITIGATION ACTION MA Y BE INCORPORATED IN THE 11 MITIGATION PLAN FOR A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT IF: 12 (I) THE NECESSARY FUNDING SOURCES ARE IDENTIFI ED AND 13 SUFFICIENT AMOUNTS A RE COMMITTED ; 14 (II) THE MITIGATION ACTION IS FOCUSED ON AREAS IN 15 ACCORDANCE WITH SUBS ECTION (C) OF THIS SECTION; AND 16 (III) PROCEDURES ARE ESTABL ISHED TO ENSURE THAT THE 17 MITIGATION ACTION CONFORMS WITH THE RE QUIREMENTS UNDER § 2–904(B) OF 18 THIS SUBTITLE. 19 (C) (1) THE BENEFITS PROVIDED BY A MITIGATION ACTION SHALL 20 FOCUS ON AREAS IN THE FOLLOWING ORDER OF PRIORITY: 21 (I) OVERBURDENED COMMUNITIES OR UNDERSERVED 22 COMMUNITIES IMPACTED BY THE MAJOR HIGHWAY CAPACI TY EXPANSION 23 PROJECT; 24 (II) AREAS WITHIN OR ASSOCIATED WITH AT LEAST ONE OF 25 THE COMMUNITIES IMPA CTED BY THE PROJECT ; 26 (III) OVERBURDENED COMMUNITIES OR UNDERSERVED 27 COMMUNIT IES; 28 HOUSE BILL 836 11 (IV) THE REGION IN WHICH THE MAJOR HIGHWAY CAPACI TY 1 EXPANSION PROJECT IS LOCATED; OR 2 (V) BENEFITS TO THE ENTIRE STATE. 3 (2) THE DEPARTMENT OR A METROPOLITAN PLANNING 4 ORGANIZATION SHALL IN CLUDE IN A MITIGATIO N PLAN AN EXPLANATIO N ON THE 5 FEASIBILITY OF AND R ATIONALE FOR SELECTI NG A MITIGATION ACTI ON LOCATED 6 IN AN AREA SPECIFIED IN PA RAGRAPH (1)(III) THROUGH (V) OF THIS SUBSECTION . 7 (D) (1) A METROPOLITAN PLANNIN G ORGANIZATION SHALL SUBMIT A 8 MITIGATION PLAN DEVE LOPED UNDER THIS SEC TION TO THE DEPARTMENT FOR 9 REVIEW AND APPROVAL . 10 (2) (I) THE DEPARTMENT SHALL APPROVE A MITIGATION PLAN IF 11 THE DEPARTMENT DETERMINES THAT THE MITIGATION PLAN COMPLIES WITH 12 THIS SECTION AND THE REQUIREMENTS UNDER § 2–904(B) OF THIS SUBTITLE. 13 (II) THE DEPARTMENT OF THE ENVIRONMENT SHALL 14 DEVELOP A METHODOLOG Y FOR THE DEPARTMENT TO DETERMI NE IF A 15 MITIGATION PLAN FOR A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT IS 16 SUFFICIENT FOR REDUC ING GREENHOUSE GAS E MISSIONS. 17 (3) (I) IF THE DEPARTMENT DOES NOT A PPROVE A 18 METROPOLITAN PLANNIN G ORGANIZATION ’S MITIGATION PLAN SU BMITTED UNDER 19 THIS SECTION, THE METROPOLITAN PLA NNING ORGANIZATION SHALL A DDRESS 20 ANY ISSUES RAISED BY THE DEPARTMENT AND RESUBM IT THE PLAN TO THE 21 DEPARTMENT FOR APPROV AL. 22 (II) IF A METROPOLITAN PLANNING ORGANIZATION’S 23 RESUBMITTED MITIGATION PLAN STILL DOES NOT CONFORM WIT H THE 24 REQUIREMENTS OF THIS SECTION AND § 2–904(B) OF THIS SUBTITLE , THE 25 DEPARTMENT MAY RESTRI CT AND REDIRECT ANY FUNDING THAT WOU LD HAVE 26 BEEN ALLOCATED BY TH E DEPARTMENT TO THE METROPOLITAN PLANNING 27 ORGANIZATION, INCLUDING FUNDING FROM : 28 1. GREENHOUSE GAS EMISSI ONS FOR THE SIXTH YE AR 8 AFTER THE PROJECT IS COMPLETE; AND 9 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 22 1, 2024. 23
