Baltimore City – Alcoholic Beverages – 40th Alcoholic Beverages District – 2

FOR the purpose of establishing a Class M–F (Municipal Family Fun Center) alcoholic 4 
beverages license in the 40th alcoholic beverages district in Baltimore City; 5 
authorizing the Board of License Commissioners for Baltimore City to issue a certain 6 
Class B beer, wine, and liquor license to a restaurant in a certain location; 7 
authorizing a certain Class A license issued for a certain location to remain 8 
unexpired until a certain date for the purpose of renewal; and generally relating to 9 
alcoholic beverages in Baltimore City. 10

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13

 This title applies only in Baltimore City. 16 
 
12–1001.5. 17 
 
 (A) THERE IS A CLASS M–F (MUNICIPAL FAMILY FUN CENTER) LICENSE 18 
FOR USE AT A MUNICIP AL BOWLING ALLEY AND SKATING RINK LOCATED ON THE ODD 19 
SIDE OF THE 1600 BLOCK OF PENNSYLVANIA AVENUE. 20 
 
 (B) THE BOARD MAY ISSUE THE L ICENSE TO AN INDIVID UAL WHO: 21 
 
 (1) IS AUTHORIZED BY THE MAYOR AND CITY COUNCIL OF 22 
BALTIMORE CITY THROUGH A MANAGE MENT AGREEMENT TO SE LL FOOD, BEER, 23 
WINE, AND LIQUOR FOR ON –PREMISES CONSUMPTION ; AND 24 
 
 (2) HAS EXECUTED A MEMOR ANDUM OF UNDERSTANDI NG WITH THE 25 
UPTON WEST COMMUNITY ASSOCIATION. 26 
 
 (C) THE LICENSE AUTHORIZE S THE HOLDER TO SELL B EER, WINE, AND 27 
LIQUOR FOR ON –PREMISES CONSUMPTION . 28 
 
 (D) THE HOURS OF SALE FOR ALCOHOLIC BEVERAGES ARE: 29 
 
 (1) FROM 11:30 A.M. TO 11 P.M. MONDAY THROUGH THURSDAY; 30

 (2) FROM 11:30 A.M. TO MIDNIGHT ON FRIDAY; 1 
 
 (3) FROM 9 A.M. TO MIDNIGHT ON SATURDAY; AND 2 
 
 (4) FROM 9 A.M. TO 11 P.M. ON SUNDAY. 3 
 
 (E) THE BOARD SHALL ADOPT REG ULATIONS TO CARRY OU T THIS SECTION, 4 
INCLUDING REGULATION S CONCERNING THE HOL DING OF EVENTS THAT ARE 5 
CLOSED TO THE PUBLIC . 6 
 
 (F) THE LICENSE HOLDER MA Y NOT: 7 
 
 (1) PARTICIPATE IN OR PU BLICIZE, IN OR OUTSIDE OF THE LICENSED 8 
PREMISES, A PUB CRAWL AUTHORIZ ED UNDER § 12–1101.1 OF THIS TITLE; OR 9 
 
 (2) EXCEPT FOR AN EVENT THAT IS CLOSED TO TH E PUBLIC, ALLOW 10 
AN OPEN BAR TO BE OP ERATED. 11 
 
 (G) THE ANNUAL LICENSE FE E IS $500. 12 
 
12–1603. 13 
 
 (b) Except as provided in subsection (c) of this section, the Board may not issue a 14 
new license in: 15 
 
 (1) the 40th alcoholic beverages district; 16 
 
 (2) the 41st alcoholic beverages district; 17 
 
 (3) the 43rd alcoholic beverages district; 18 
 
 (4) the 44th alcoholic beverages district; and 19 
 
 (5) the 45th alcoholic beverages district. 20 
 
 (c) The Board may issue: 21 
 
 (1) in the alcoholic beverages districts specified in subsection (b) of this 22 
section: 23 
 
 (i) a 1–day license; or 24 
 
 (ii) a Class B beer, wine, and liquor license to a restaurant that: 25 
 
 1. has a minimum capital investment, not including the cost 26 
of land and buildings, of $200,000 for restaurant facilities; and 27  4 	SENATE BILL 1008  
 
 
 
 2. has a minimum seating capacity of 75 individuals; 1 
 
 (16) a Class C beer, wine, and liquor license in the 3600 block of Hickory 2 
Avenue in the 40th alcoholic beverages district to a holder of a Class C beer and light wine 3 
license; [and] 4 
 
 (17) a Class A–7 beer, wine, and liquor license in the 1200 block of West 5 
North Avenue in the 40th alcoholic beverages district, if: 6 
 
 (i) the applicant executes a memorandum of understanding with the 7 
Penn North Community Association; 8 
 
 (ii) alcoholic beverages are sold only as part of a gift basket or floral 9 
arrangement; and 10 
 
 (iii) the applicant does not hold or apply for a Class BWLT beer, wine, 11 
and liquor (on–premises) tasting license; AND 12 
 
 (18) A CLASS B BEER, WINE, AND LIQUOR LICENSE F OR A RESTAURANT 13 
ON THE EVEN SIDE OF THE 400 BLOCK OF WEST 29TH STREET IN THE 40TH 14 
ALCOHOLIC BEVERAGES DISTRI CT IF: 15 
 
 (I) THE APPLICANT EXECUT ES A MEMORANDUM OF 16 
UNDERSTANDING WITH T HE GREATER REMINGTON IMPROVEMENT ASSOCIATION; 17 
AND 18 
 
 (II) THE BOARD WAIVES A MINIMU M SEATING REQUIREMEN T 19 
UNDER ITEM (1)(II)2 OF THIS SUBSECTION . 20 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding § 12 –2202 21 
of the Alcoholic Beverages and Cannabis Article, a Class A license issued for a premises on 22 
the odd side of the unit block of East West Biddle Street shall be considered unexpired until 23 
the end of July 1, 2025, for the purpose of being renewed to the current license year. 24 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 25 
1, 2024. Section 2 of this Act shall remain effective for a period of 1 year and 1 month and, 26 
at the end of July 31, 2025, Section 2 of this Act, with no further action required by the 27 
General Assembly, shall be abrogated and of no further force and effect. 28
