CHAPTER ______ AN ACT concerning 1 Education – Armed Services Vocational Aptitude Battery – Student Information 2 FOR the purpose of requiring public schools in the State to notify students taking the 3 Armed Services Vocational Aptitude Battery (ASVAB) and parents or guardians of 4 students taking the ASVAB of the option to prohibit the release of a student’s ASVAB 5 test scores to military recruiters; repealing the requirement that certain schools 6 provide certain notice to certain individuals regarding the release of student 7 information and ASVAB test scores; and generally relating to public schools and the 8 availability of student information and ASVAB test scores. 9 BY repealing and reenacting, with amendments, 10 Article – Education 11 Section 7–111 12 Annotated Code of Maryland 13 (2022 Replacement Volume and 2023 Supplement) 14 2 SENATE BILL 1042 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 That the Laws of Maryland read as follows: 2 Article – Education 3 7–111. 4 (a) Subject to subsection (b) of this section, each public school under the 5 jurisdiction of a county board that provides access to its buildings and grounds or its 6 student information directory to any person or group which makes students aware of 7 occupational or educational options shall provide access on the same basis to official 8 recruiting representatives of the military forces of this State and the United States for the 9 purpose of informing students of educational and career opportunities available in the 10 military. 11 (b) (1) A public school subject to this section shall provide notice to each 12 student and to the parent or guardian of each student enrolled at the school that, in 13 accordance with federal law, the student or the parent or guardian of the student may 14 request that the student’s name, address, and telephone number not be released to military 15 recruiters. 16 (2) The notice described under paragraph (1) of this subsection shall: 17 (i) Be included in a clear and conspicuous manner and in the same 18 size type as the other statements on the card requesting emergency contact information 19 that is distributed by the public school to each student or parent or guardian of the student; 20 and 21 (ii) Request that the student or the parent or guardian of the student 22 indicate if the student’s name, address, and telephone number are not to be released to 23 military recruiters by checking the box “Do not release contact information”. 24 (3) On or before October 1 and March 1 of each school year, the principal 25 of each public school in a county shall submit a list to the county board that includes the 26 name, address, and telephone number of each student whose contact information is not 27 released to military recruiters as directed under paragraph (2)(ii) of this subsection. 28 (c) (1) In this subsection, “ASVAB” means the Armed Services Vocational 29 Aptitude Battery. 30 (2) Each public school in the State that administers the ASVAB shall, 2 31 WEEKS BEFORE ADMINIS TERING THE EXAM, NOTIFY STUDENTS TAKI NG THE ASVAB 32 AND THE PARENT OR GU ARDIAN OF STUDENTS T AKING THE ASVAB OF THE OPTION 33 TO choose “Option 8” as the score reporting option for military recruiter contact to prohibit 34 the general release of any student information to military recruiters. 35 SENATE BILL 1042 3 (3) Each public school that administers the ASVAB shall[: 1 (i) Send a written notice to the ASVAB representative coordinating 2 the school’s administration of the ASVAB of the requirement set forth in paragraph (2) of 3 this subsection; and 4 (ii) Notify] NOTIFY students taking the ASVAB and the parent or 5 guardian of students taking the ASVAB of the release of student information requirements 6 set forth in [paragraphs (2) and] PARAGRAPH (4) of this subsection. 7 (4) A student or a student’s parent or guardian WHO CHOOSES “OPTION 8 8” AS THE SCORE REPORTI NG OPTION OR FOR WHOM “OPTION 8” IS CHOSEN BY THE 9 COUNTY BOARD may choose to LATER release the student’s personal information and 10 ASVAB scores by individually submitting the required forms to the military services 11 authorizing the release of the information to: 12 (i) Recruiting representatives of the military services; 13 (ii) Registered apprenticeship programs; 14 (iii) Youth apprenticeship programs under Title 18, Subtitle 18 of 15 this article; and 16 (iv) Employers registered with: 17 1. The Maryland Department of Labor; or 18 2. Local Workforce Development Boards. 19 (5) NOTHING IN THIS SUBSE CTION MAY BE CONSTRU ED TO LIMIT A 20 COUNTY BOARD ’S ABILITY TO CHOOSE “OPTION 8” AS THE SCORE REPORTING 21 OPTION FOR MILITARY RECRUITER CONTACT TO PROHIBIT THE GENERAL RELEASE 22 OF ANY STUDENT INFOR MATION TO MILITARY R ECRUITERS FOR PUBLIC SCHOOLS 23 THAT ADMINISTER THE ASVAB IN THE COUNTY. 24 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 25 1, 2024. 26
