BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 That the Laws of Maryland read as follows: 19 Article – Transportation 20 13–954. 21 (a) In this section, “motor vehicle” means a: 22 (1) Class A (passenger) vehicle; 23 2 SENATE BILL 1092 (2) Class B (for hire) vehicle; 1 (3) Class C (funeral and ambulance) vehicle; 2 (4) Class D (motorcycle) vehicle; 3 (5) Class E (truck) vehicle; 4 (6) Class F (tractor) vehicle; 5 (7) Class H (school) vehicle; 6 (8) Class J (vanpool) vehicle; 7 (9) Class M (multipurpose) vehicle; 8 (10) Class P (passenger bus) vehicle; 9 (11) Class Q (limousine) vehicle; 10 (12) Class R (low speed) vehicle; or 11 (13) Vehicle within any other class designated by the Administrator. 12 (b) (1) In addition to the registration fee otherwise required by this title, the 13 owner of any motor vehicle registered under this title shall pay a surcharge of [$17.00] 14 $40.00 per year for each motor vehicle registered. 15 (2) (I) [$2.50] $7.50 of the surcharge collected under paragraph (1) of 16 this subsection shall be paid into the Maryland Trauma Physician Services Fund 17 established under § 19–130 of the Health – General Article. 18 (II) THE GOVERNOR ANNUALLY SHA LL ALLOCATE AT LEAST 19 $9.00 OF THE SURCHARGE COLLECTED UNDER PARAGRAPH (1) OF THIS 20 SUBSECTION TO THE R ADAMS COWLEY SHOCK TRAUMA CENTER. 21 (III) THE BALANCE OF THE SURCHARGE COLLECTED UNDER 22 PARAGRAPH (1) OF THIS SUBSECTION S HALL BE PAID TO THE MARYLAND 23 EMERGENCY MEDICAL SYSTEM OPERATIONS FUND ESTABLISHED UNDER § 13–955 24 OF THIS SUBTITLE. 25 13–955. 26 (a) In this section, “Fund” means the Maryland Emergency Medical System 27 Operations Fund. 28 SENATE BILL 1092 3 (b) (1) There is a Maryland Emergency Medical System Operations Fund. 1 (2) The Comptroller shall administer the Fund, including accounting for 2 all transactions and performing year–end reconciliation. 3 (3) The Fund is a continuing, nonlapsing fund which is not subject to § 4 7–302 of the State Finance and Procurement Article. 5 (4) Interest and earnings on the Fund shall be separately accounted for and 6 credited to the Fund, and are not subject to § 6–226(a) of the State Finance and 7 Procurement Article. 8 (c) The Fund consists of: 9 (1) Registration surcharges collected under § 13–954 of this subtitle; 10 (2) All funds, including charges for accident scene transports and 11 interhospital transfers of patients, generated by an entity specified in subsection (e) of this 12 section that is a unit of State government; and 13 (3) Revenues distributed to the Fund from the surcharges collected under 14 § 7–301(f) of the Courts Article. 15 (d) Expenditures from the Fund shall be made pursuant to an appropriation 16 approved by the General Assembly in the annual State budget or by the budget amendment 17 procedure provided under § 7–209 of the State Finance and Procurement Article, provided 18 that any budget amendment shall be submitted to and approved by the Legislative Policy 19 Committee prior to the expenditure or obligation of funds. 20 (e) The money in the Fund shall be used solely for: 21 (1) Medically oriented functions of the Department of State Police, Special 22 Operations Bureau, Aviation Division; 23 (2) The Maryland Institute for Emergency Medical Services Systems; 24 (3) The R Adams Cowley Shock Trauma Center at the University of 25 Maryland Medical System; 26 (4) The Maryland Fire and Rescue Institute; 27 (5) The provision of grants under the Senator William H. Amoss Fire, 28 Rescue, and Ambulance Fund in accordance with the provisions of Title 8, Subtitle 1 of the 29 Public Safety Article; and 30 (6) The Volunteer Company Assistance Fund in accordance with the 31 provisions of Title 8, Subtitle 2 of the Public Safety Article. 32 4 SENATE BILL 1092 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 1 1, 2024. 2
