Department of Veterans and Military Families” 18 Annotated Code of Maryland 19 (2021 Replacement Volume and 2023 Supplement) 20 BY adding to 21 Article – State Government 22 Section 9–902.1 23 Annotated Code of Maryland 24 (2021 Replacement Volume and 2023 Supplement) 25 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 26 That the Laws of Maryland read as follows: 27 2 SENATE BILL 411 Article – State Government 1 8–201. 2 (b) The principal departments of the Executive Branch of the State government 3 are: 4 (21) Veterans [Affairs] AND MILITARY FAMILIES. 5 Subtitle 9. Department of Veterans [Affairs] AND MILITARY FAMILIES. 6 9–901. 7 (a) In this subtitle the following words have the meanings indicated. 8 (b) “Board” means the Board of Trustees of the Maryland Veterans Trust. 9 (c) “Department” means the Department of Veterans [Affairs] AND MILITARY 10 FAMILIES. 11 (d) “Secretary” means the Secretary of Veterans [Affairs] AND MILITARY 12 FAMILIES. 13 (e) “Trust” means the Maryland Veterans Trust. 14 (f) Except as otherwise provided in this subtitle, “veteran” means an individual 15 who served on active duty in the armed forces of the United States, other than for training, 16 and was discharged or released under conditions other than dishonorable. 17 9–902. 18 (a) There is a Department of Veterans [Affairs] AND MILITARY FAMILIES, 19 established as a principal department of the State government. 20 (b) The head of the Department is the Secretary of Veterans [Affairs] AND 21 MILITARY FAMILIES who shall be: 22 (1) a veteran who has an honorable discharge from active service with a 23 uniformed service of the United States; and 24 (2) appointed by the Governor with the advice and consent of the Senate. 25 9–902.1. 26 SENATE BILL 411 3 (A) THE SECRETARY SHALL APPOI NT A DEPUTY SECRETARY OF MILITARY 1 FAMILY POLICY AND PROGRAMS. 2 (B) THE DEPUTY SECRETARY SHALL SERVE AT THE PLEASURE OF T HE 3 SECRETARY. 4 (C) THE DEPUTY SECRETARY IS ENTITLED TO THE SALARY PROVID ED IN 5 THE STATE BUDGET . 6 (D) THE DEPUTY SECRETARY SHALL DIREC T POLICY AND PROGRAM S 7 RELATED TO MILITARY FAMILIES. 8 9–908. 9 (b) There is a Veterans’ Memorials and Monuments Program administered by the 10 Department [of Veterans Affairs]. 11 9–914. 12 (b) The Board of Trustees shall consist of the following 11 members: 13 (1) the Secretary [of Veterans Affairs], ex officio, or the Secretary’s 14 designee, who shall serve as the chair; 15 9–933. 16 There is a War Memorial Commission in the Department [of Veterans Affairs]. 17 9–934. 18 (a) (2) Of the 10 Commission members: 19 (i) 5 shall be appointed by the Secretary [of Veterans Affairs], with 20 the approval of the Governor; and 21 (ii) 5 shall be appointed by the Mayor of Baltimore City. 22 9–943. 23 (b) (1) The director shall develop mechanisms for outreach to be disseminated 24 by direct mail and through community–based veterans organizations, the Department [of 25 Veterans Affairs], the Department of Human Services, the Maryland Department of 26 Health, and any other State agency or unit the director considers appropriate. 27 9–951. 28 4 SENATE BILL 411 (a) The Commission consists of the following members: 1 (1) the designee of the Secretary [of Veterans Affairs]; 2 SECTION 2. AND BE IT FURTHER ENACTED, That, as provided in this Act: 3 (a) The Department of Veterans and Military Families is the successor of the 4 Department of Veterans Affairs. 5 (b) In every law, executive order, rule, regulation, policy, or document created by 6 an official, an employee, or a unit of this State, the names and titles of those agencies and 7 officials mean the names and titles of the successor agency or official. 8 SECTION 3. AND BE IT FURTHER ENACTED, That nothing in this Act affects the 9 term of office of an appointed or elected member of any commission, office, department, 10 agency, or other unit. An individual who is a member of a unit on the effective date of this 11 Act shall remain for the balance of the term to which appointed or elected, unless the 12 member sooner dies, resigns, or is removed under provisions of law. 13 SECTION 4. AND BE IT FURTHER ENACTED, That any transaction or 14 employment status affected by or flowing from any change of nomenclature or any statute 15 amended by this Act and validly entered into or existing before the effective date of this Act 16 and every right, duty, or interest flowing from a statute amended by this Act remains valid 17 after the effective date of this Act and may be terminated, completed, consummated, or 18 enforced as required or allowed by any statute amended by this Act as though the 19 amendment had not occurred. If a change in nomenclature involves a change in name or 20 designation of any State unit, the successor unit shall be considered in all respects as 21 having the powers and obligations granted the former unit. 22 SECTION 5. AND BE IT FURTHER ENACTED, That: 23 (a) The continuity of every commission, office, department, agency, or other unit 24 is retained. 25 (b) The personnel, records, files, furniture, fixtures, and other properties and all 26 appropriations, credits, assets, liabilities, and obligations of each retained unit are 27 continued as the personnel, records, files, furniture, fixtures, properties, appropriations, 28 credits, assets, liabilities, and obligations of the unit under the laws enacted by this Act. 29 SECTION 6. AND BE IT FURTHER ENACTED, That letterhead, business cards, 30 and other documents reflecting the renaming of the Department of Veterans Affairs to be 31 the Department of Veterans and Military Families may not be used until all letterhead, 32 business cards, and other documents already in print and reflecting the name of the 33 Department before the effective date of this Act have been used. 34 SECTION 7. AND BE IT FURTHER ENACTED, That the publisher of the 35 Annotated Code of Maryland, in consultation with and subject to the approval of the 36 SENATE BILL 411 5 Department of Legislative Services, shall correct, with no further action required by the 1 General Assembly, cross–references and terminology rendered incorrect by this Act. The 2 publisher shall adequately describe any correction that is made in an editor’s note following 3 the section affected. 4 SECTION 8. AND BE IT FURTHER ENACTED, That this Act shall take effect July 5 1, 2024. 6
