Department of Veterans and Military Families” 18 Annotated Code of Maryland 19 (2021 Replacement Volume and 2023 Supplement) 20 BY adding to 21 Article – State Government 22 2 SENATE BILL 411 Section 9–902.1 1 Annotated Code of Maryland 2 (2021 Replacement Volume and 2023 Supplement) 3 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 4 That the Laws of Maryland read as follows: 5 Article – State Government 6 8–201. 7 (b) The principal departments of the Executive Branch of the State government 8 are: 9 (21) Veterans [Affairs] AND MILITARY FAMILIES. 10 Subtitle 9. Department of Veterans [Affairs] AND MILITARY FAMILIES. 11 9–901. 12 (a) In this subtitle the following words have the meanings indicated. 13 (b) “Board” means the Board of Trustees of the Maryland Veterans Trust. 14 (c) “Department” means the Department of Veterans [Affairs] AND MILITARY 15 FAMILIES. 16 (d) “Secretary” means the Secretary of Veterans [Affairs] AND MILITARY 17 FAMILIES. 18 (e) “Trust” means the Maryland Veterans Trust. 19 (f) Except as otherwise provided in this subtitle, “veteran” means an individual 20 who served on active duty in the armed forces of the United States, other than for training, 21 and was discharged or released under conditions other than dishonorable. 22 9–902. 23 (a) There is a Department of Veterans [Affairs] AND MILITARY FAMILIES, 24 established as a principal department of the State government. 25 (b) The head of the Department is the Secretary of Veterans [Affairs] AND 26 MILITARY FAMILIES who shall be: 27 (1) a veteran who has an honorable discharge from active service with a 28 uniformed service of the United States; and 29 SENATE BILL 411 3 (2) appointed by the Governor with the advice and consent of the Senate. 1 9–902.1. 2 (A) THE SECRETARY SHALL APPOI NT A DEPUTY SECRETARY OF MILITARY 3 FAMILY POLICY AND PROGRAMS. 4 (B) THE DEPUTY SECRETARY SHALL SERVE AT THE PLEASURE OF T HE 5 SECRETARY. 6 (C) THE DEPUTY SECRETARY IS ENTITLED TO THE SALARY PROVIDED IN 7 THE STATE BUDGET . 8 (D) THE DEPUTY SECRETARY SHALL DIREC T POLICY AND PROGRAM S 9 RELATED TO MILITARY FAMILIES. 10 9–908. 11 (b) There is a Veterans’ Memorials and Monuments Program administered by the 12 Department [of Veterans Affairs]. 13 9–914. 14 (b) The Board of Trustees shall consist of the following 11 members: 15 (1) the Secretary [of Veterans Affairs], ex officio, or the Secretary’s 16 designee, who shall serve as the chair; 17 9–933. 18 There is a War Memorial Commission in the Department [of Veterans Affairs]. 19 9–934. 20 (a) (2) Of the 10 Commission members: 21 (i) 5 shall be appointed by the Secretary [of Veterans Affairs], with 22 the approval of the Governor; and 23 (ii) 5 shall be appointed by the Mayor of Baltimore City. 24 9–943. 25 (b) (1) The director shall develop mechanisms for outreach to be disseminated 26 by direct mail and through community–based veterans organizations, the Department [of 27 4 SENATE BILL 411 Veterans Affairs], the Department of Human Services, the Maryland Department of 1 Health, and any other State agency or unit the director considers appropriate. 2 9–951. 3 (a) The Commission consists of the following members: 4 (1) the designee of the Secretary [of Veterans Affairs]; 5 SECTION 2. AND BE IT FURTHER ENACTED, That, as provided in this Act: 6 (a) The Department of Veterans and Military Families is the successor of the 7 Department of Veterans Affairs. 8 (b) In every law, executive order, rule, regulation, policy, or document created by 9 an official, an employee, or a unit of this State, the names and titles of those agencies and 10 officials mean the names and titles of the successor agency or official. 11 SECTION 3. AND BE IT FURTHER ENACTED, That nothing in this Act affects the 12 term of office of an appointed or elected member of any commission, office, department, 13 agency, or other unit. An individual who is a member of a unit on the effective date of this 14 Act shall remain for the balance of the term to which appointed or elected, unless the 15 member sooner dies, resigns, or is removed under provisions of law. 16 SECTION 4. AND BE IT FURTHER ENACTED, That any transaction or 17 employment status affected by or flowing from any change of nomenclature or any statute 18 amended by this Act and validly entered into or existing before the effective date of this Act 19 and every right, duty, or interest flowing from a statute amended by this Act remains valid 20 after the effective date of this Act and may be terminated, completed, consummated, or 21 enforced as required or allowed by any statute amended by this Act as though the 22 amendment had not occurred. If a change in nomenclature involves a change in name or 23 designation of any State unit, the successor unit shall be considered in all respects as 24 having the powers and obligations granted the former unit. 25 SECTION 5. AND BE IT FURTHER ENACTED, That: 26 (a) The continuity of every commission, office, department, agency, or other unit 27 is retained. 28 (b) The personnel, records, files, furniture, fixtures, and other properties and all 29 appropriations, credits, assets, liabilities, and obligations of each retained unit are 30 continued as the personnel, records, files, furniture, fixtures, properties, appropriations, 31 credits, assets, liabilities, and obligations of the unit under the laws enacted by this Act. 32 SECTION 6. AND BE IT FURTHER ENACTED, That letterhead, business cards, 33 and other documents reflecting the renaming of the Department of Veterans Affairs to be 34 the Department of Veterans and Military Families may not be used until all letterhead, 35 SENATE BILL 411 5 business cards, and other documents already in print and reflecting the name of the 1 Department before the effective date of this Act have been used. 2 SECTION 7. AND BE IT FURTHER ENACTED, That the publisher of the 3 Annotated Code of Maryland, in consultation with and subject to the approval of the 4 Department of Legislative Services, shall correct, with no further action required by the 5 General Assembly, cross–references and terminology rendered incorrect by this Act. The 6 publisher shall adequately describe any correction that is made in an editor’s note following 7 the section affected. 8 SECTION 8.
